Hiya Car:) I agree its rediculous I invited them to take me to court and they wouldnt do it and why is that. I think we all know why.... You see they can't reproduce the rubbish agreemnent they 'recreated, in court can they.............. if they were so sure thay would of whacked me right between the eyeballs with the TRUE copy.... of course the 'cannot' part would then be there wouldnt it..... Okey Dokey ! They completed ignored my letter and have passed it on to Newmans DCA now:rolleyes:. Here we go again, no notice of assignment and have received the next round of Dear Sir/Madam letters. 1st (i ignored) headed URGENT sent 2nd class, 2nd (sent 2nd class and needing an answer in 5 days) NOTICE OF INTENTION TO RECOVE DEBT stating : Dear Sir/Madam, TAKE NOTICE we are instructed to commence COURT PROCEDDINGS for recovery of the above amount. TAKE FURTHER NOTICE that this can be avoided if we hear from you within 5 DAYS from the postmark date (emmmmm..... sent 2nd class !!!! yeh u numpties!) If you have made payment, you must contact this office IMMEDIATELY with the full details to avoid any further action. signed MR NUMPTY .................................................................. Gary you have helped believe me:D I never received a DN and my S.A.R showed a suspect entry on it under collections (it was manually entered I believe when I told them they never sent me a DN before terminating my account) all letters ever sent showed as TO CORRESPONDENCE ADDRESS apart from this one;) Many thanks XXXX Milly XXX

Hi Gary can you do me a favour I never received a DN though they reckon one was sent, though my S.A.R never mentions one being sent to correspondence address. I queried a the letter ref number on my S.A.R - L9211, the data controller said that meant DEFAULT NOTICE when asked. What is the letter ref on yours as two others I have seen match eachother being L9220, but not the ref number noted on my S.A.R. I never received a DN. milly XX

God havent updated since 7th May...time flies. I am adding this shortcut as I posted on Lexis thread concerning Computer generated Default Notice references as I received a letter from the Data Controller saying that the code I asked about on my S.A.R meant DN. the plot thickens as regards to the DEFAULT NOTICE reference given L9211, as being the DN............. it does not match this one here on these different threads, both have a reference being L9220: http://www.consumeractiongroup.co.uk/forum/show-post/post-2176963.html and the Default Letter reference code matches this one too!!!! http://www.consumeractiongroup.co.uk/forum/show-post/post-1736431.html I would of thought that the reference codes used by HBOS computer would be universal as it seems above So need your help peeps....what does your reference say??? As I said this probably explains why it did not say SENT TO CORRESPONDENCE ADDRESS on my S.A.R. I am believing that this has been manually entered on the collections log as if the computer automatically produced one ( of which I have my doubts as I had only missed 1 payment by the 18 August) it would of matched under deatils of any other automatically produced letter. so peeps please look at the code for me, on the letters it is normally down the side, 5 digits starting with L. BOS did the same wiv me remember, sent out a 10 November statement (alterd by the way) i think in january, its on my thread, loads of weird things:rolleyes: Said the agreemnent wasnt ended and then a few days later a letter from Blair Witch demanding the full balnce , oh and then another statement.... hello lexis, hope alls okay, been busy with new pups:D Waiting to hear back from moorcroft after the CPR request. Gone strangely quite.... Heard from BOS though data controller, saying that they do NOT have to provide any further info since my last S.A.R. Then a letter comes with the remaining answers to the S.A.R and basically refuse to send any copy of letters referred to on S.A.R or telephone notes. diddley squat:mad: By the way I asked what this letter code was and the data controller lists it as a DN letter reference (which we all know I never received and they WILL not send a copy) Could you tell me the reference number on yours as I all I have is a code (I have noted it says on my S.A.R nowt about sending to corespondence address, unlike other letters that were sent) this but no DN reference: L9211. Hi This happened to my O/H he ended up with a 48 month HP term with Black Horse financial Still the plus side is at the end of the term he will have more equity in the car and WILL own it in a years time and definitely have a LARGE deposit in it more than PCP as the whole car will be his. I did the BMW select option as I do not wish to BUY the car at the end of the agreed term. I normally trade it in for another every two years and use the deposit from the remaining value. I MUST warn you though at present the cars are not getting what they should for them and you could find yourself in negative equity with the car as O/H found out when he wanted to trade it back to BMW for a new M3 over halfway in the loan, the car had deflated and he would of had to carry over a £6K negative to the new finance deal. so HP does not work if you do NOT pay full term. However in one year he will be able to sell the car and it should ralise at least £16- 18K so worth the wait. So please please make sure that the Black Horse PCP is AS good as the BMW finance one and that you simply can hand the car back,as whatever the car is worth I will NOT end up in negative or have to pay them anything( I probably won't get anything out of the car now due to the current climate, but at least I won't have a debt) NO deposit like I used to but NO debt. milly XX
