  1. Sorry to interrupt but I find this case very interesting. I am in the same boat having no knowledge of any PPI paid by us until my wife contacted a claims company last year. They told us we had paid PPI from 1989 until 1993 and I submitted a claim myself. This claim was accepted and a refund made at which time I was also advised that Gold Account fess could be claimed. We had an account until 2006 but I have just received the same reply from NatWest that my claim is out of date. I will write to the Ombudsman because until our PPI claim we had no idea current account fees could be reclaimed.
  2. Can anyone assist with a concern that I have regarding my monthly mortgage payments with NatWest? I have recently remortgaged with NatWest and took out a tracker mortgage of the base rate plus 2.69 %. Over the years I have had further loans which means that my mortgage is recorded as three sections. That is the total loan outstanding split into loans a, b and c. On receiving my notification of the monthly payments the three sections where noted as follows; A - base rate plus 2.69 % equals 4% B - base rate plus 2.69 % equals 4% and C - base rate plus 2.69 % equals 3.19% with each section showing the monthly amount to be paid. I have written to NatWest pointing out that they should all be 3.19% to which I have received a reply that the percentage figures quoted are wrong and they will all be 3.19% although NatWest will not send a further statement confirming the monthly payments, they have removed the section showing the percentages and just left the same monthly payments. Does anyone know where I can find a system or other means of checking that the amount outstanding, the period of loan left and percentage rate mean that the monthly payments are correct ? I am concerned that I am still paying 4% on two parts of the mortgage. With thanks Dave
  3. The Government is, I understand, working on giving insurance companies direct access to DVLA. As soon as this comes in there may be an awful lot of drivers who find that their insurance is no longer valid and possibly receive additional demands considering the price that would have been set had all matters been disclosed. Irrespective of this you should always disclose points and I agree with Bandit127, the increase appears somewhat excessive just for points unless you have not been driving long and managed to use a special deal with the original quote and points mean that you no longer qualify.
  4. Sorry for the delay in my reply. Basically I claimed the outstanding charge that was being put to me and for unnecessary letters. So I explained that BSB believed I owed say £30, I explained what I had done to rectify this, how BSB failed to respond, how I had to deal with 2 collectors. So to settle the amount I submitted a claim for £30 on the basis that I would pay this to settle the debt even thought it was wrong and as such I was claiming the charge back. I also claimed £12 per letter that was unjustified but only written due to BSB's failures

  6. Just a quick thread to pass on a successful claim I have made against BSkyB, which may be of use to others in a similar position as I was. I finished my contract with BSkyB as the prices kept increasing without any explanation. Having ceased my contract I received a final payment charge, which I didn't agree with and so wrote to them saying such. Despite a number of letters, I send letters to keep a record of the paper trail, I often found I did not even receive a single reply. Then without warning I received a demand from Wescot Credit Services regarding the debt. I wrote to Wescot explaining that the debt was in dispute and give them their due they cancelled their involvement. I again wrote to BskyB who once again failed to reply but forwarded the debt to Pastdue Credit Solutions. PCS were a pain the the backside repeatedly writing demanding payment with warnings of debt collectors, Court hearings and bad credit ratings. They even asked for a copy of all the letters I had sent BSkyB. To settle this dispute I submitted a Small Claims Court claim against BskyB in which I claimed the disputed amount (just over £30), costs for unnecessary letters I was having to write both to BSkyB and the debt collectors, and the cost of the claim. I was more than willing to sit in the Court and explain my disputed charge and the reason for my costs. Just prior to the deadline date I received a telephone call from BSkyB that they would accept liability and pay the amount paid as well as cancel all debt. A cheque soon followed for just over £130. I claimed the amount they said that I owed as I was quite happy to use that part of the claim to settle the charge although this was unnecessary as they wrote the debt off. So if you think your action is fair and justified submit your own costs to the S.C. Court and invite the other party to dispute your claim.
  7. I am not sure if this is of any help but I'll mention it anyway. A colleague of mine rented property and on leaving was told that he would not receive his deposit back and that he would be charged for all work required to clean/improve the address and for lost rent as the property was no longer let whilst this work was ongoing. The landlord added that unless the full amount, once decided, was paid he would reclaim through the small claims court. In reply my colleague pointed out that he would dispute this but in the mean time he required the details of something like the national register that he was registered under. I am not aware of the full details as he has moved away but apparently landlords must register in a certain way. Within 24 hrs the full deposit was refunded to his bank account and the matter was deemed as settled with no further amounts due. Someone may be able to clarify what this is but to me he/she sounds like a rogue landlord.

  9. I was with Sky and on joining paid the joining charges and a month in advance. Years later we left because their prices had risen excessively but they demanded payment up until the date of leaving. I have written over four letters asking why I pay in advance and then have to pay up to the date of leaving but Sky refuse to answer. As for telephone calls I have given up with them as staff appear to know nothing apart from to ask me to pay the £38. Sky forwarded the debt to one debt collector who promptly returned it as in dispute so rather than reply Sky have notified another who are not accepting that it is in dispute. I'll pay as soon as someone answers my letters if the amount is due but I am quite sure they are not answering because I am right. Sky are just unable or unwilling to discuss anything and they have the audacity to send repeatedly leaflets and 'phone calls inviting us to rejoin. I am pondering whether to invite the debt collector to take me to court or pay the £38 and reclaim the fee in the small claims court but leaning towards the latter.

  11. Epsom, I to have a dispute with BT possibly similar to yours and find your comments very interesting. I telephoned BT to leave due to increasing prices and was offered a new rate of £25.00 per month. Having been with BT for 20 + years I took it but for the second month was charged £43.00. I contacted BT by telephone and was told that it was due to outstanding payments from before the new rate. I therefore accepted this and the following month was again £25.00. Unfortunately the fourth month payment was £68. I cancelled the contract and left but have been sent an outstanding charge for early termination of £53. I have written three letters but all they do is ignore my questions about the increased charges and include a list of my payments which I already know. I have discovered by 'phone though that the payment of £25 would never cover my usage. They never told me this at the outset probably because I would have declined the contract. I have so far refused to pay and have received notification that the debt will be passed to a debt collector. I have told them that I am disputing the debt but they have in turn replied that it doesn't matter, the debt can still be recovered. I am presently writing to Otelo and hopefully they will support me but I can only wait and see

  13. Can anyone assist? I previously had a loan which I cleared and each quarter would receive a statement showing outstanding capital, the monthly payment split into capital and interest following by the remaining capaital outstanding. I would pay say £90.00 each month and this amount would be split into increasing capital payments and decreasing interest payments. I presently have a loan with the BoS who have top loaded my loan. I wish to dispute the charges and have asked the BoS to provide me with a statement showing my payments split as my previous lender but the BoS have refused point blank stating that it is too much work. I therefore wish to calculate my own payments so that I can dispute the BoS charges. Does anyone know of a programme/site or the formula to work out my monthly payments in the method I wish to use. My previous lender were quite helpful when I spoke with them but could not help as they just input the figures when they start a loan and the computer calculates the monthly payments and splits the payments for capital and interest.   14. This is just a quick line of advice if anyone else is in the same position that I was a few months ago. Nat West recently changed the dates that the monthly statements were issued for current accounts. They also amended the date that charges would be collected to 21 days after the statement was issued. My monthly fees/charges were normally taken at the end of each month after I had been paid but following the change was taken during the final week of the month. This meant that the account was empty and the charges took me over my overdraft limit resulting in more charges. I complained to the bank and was posted from branch to branch with no one able to assist or stating that leaflets had been posted advising of the changes. I therefore wrote a letter of complaint to the main office for complaints pointing out that leaflets were no use, I should have been told in writing. The end result is that all of my charges/fees have been refunded and my statement date has been amended to ensure that the charges are taken at teh end of the month. Apparently the date was initially changed, so I was told, because the FSA instructed the banks to be more open with charges. I still have not worked that one out but just incase anyone has the same problems as I did, this is how I resolved it. There was no necessity for anything other than my letter.
  15. I took out a loan a couple of years ago with the BOS and found out within a few months that the loan had been top loaded with the interest. With the assistance from this site I wrote to the bank and resolved the matter, albeit with no change in the loan but a payment of £50.00 from the BOS due to them failing to address my questions regarding top loading. I now wish to transfer the loan to a previous lender I have used and have asked for a settlement figure. My previous lender would forward quarterly statements showing capital and interest payments, for example - The monthly payment would be displayed as Repayment £120, capital £100, interest £20 and amount outstanding £3000. The following month would quote similar to Repayment £120, capital £102, interest £18 and amount outstanding £2880 and so on. I have asked the BOS for a similar breakdown for my payments which have been running for about two years but they have replied that there is too much worked involved and they will not do so, despite two requests. Can the bank refuse to provide this information to me? They just want me to pay the amount due to settle the debt.
  16. It may depend on the police force as some forces have driver improvement schemes. A friend of mine set off a speed camera and at a similar speed as you and was offered the chance to pay for a driver improvement scheme which she did. The charge was about £90.00 but no points. For your speed you can probably be offered 3 points and a £60.00 fine if you agree accept the offence. Failing to answer the notice can mean, if found guilty in Court, an automatic 6 points and a larger fine.
  17. I obtained a loan with the Bank of Scotland to cover a number of debts. Unbeknown to me the bank front loaded my loan and thanks to advice from this site I have resolved this matter and the bank have paid me £50.00 for the lack of replies to my enquiries. I now wish to transfer the loan to a lender I used previously and have asked the Bank of Scotland for a settlement figure and a breakdown of my capital and interest payments. My previous lender would forward quarterly statements including monthly payments broken down into repayment, interest and remaining debt. I.e. it may state payment £100, capital £80, interest £20, remaining £3000. followed by payment £100, capital £82, interest £18, remaining £2900, and so on. I have asked the Bank of Scotland to provide me with such a breakdown for my payments but they have replied "we cannot provide the details on a month to month basis due to the volume of information involved" despite me asking on two occassions by letter. Can I demand that the bank provide me with this information or can they refuse? The settlement figure appears to show that I have paid little from the capital of my loan and paid a huge portion of the interest. I know that the initial payments do cover the larger portion of interest that final payments but despite paying £134 a month my debt for two years on a five year loan has decreased from £6500 to just under £5300.   18. Thanks Ron, I have spent years ensuring that my mortgage will finish on time by increasing payments when I had to remortgage for any reason but not increasing the period. Whilst undergoing a review with my lender I was told that I owed £7700 on the loan which I disputed. On writing to BoS asking why my loan was increased I received three letters stating that they were unable to explain (between July and late September). Only when I contacted the Ombud did they reply quoting that it was top loaded. My loan was £6500, interest is £1500 therefore my starting figure is £8000. On asking for a settlement calculation I have been told in reply that it cannot be done. It would involve a complex actuarial breakdown and computers have been programmed to provide an acurate figure Dave
  19. Can anyone let me have any advice? I took out a loan with the BoS for £6500 but later found a much better loan. On enquiring as to my outstanding debt I was shown that I owed £7700 after just less than a year of regular payments. I have since been told by someone from a Building Society that this 'top loading' is not allowed. Does anyone know if this is correct? I am so anoyed with the Bank as they now want me to pay £6100 to settle even though I have paid almost £1500. With thanks

  21. Thank you for all your help. I have applied to the unclaimed asset register and am considering the fee of twenty five pounds. When the policy was taken out my grandad would have been either working for Tate and Lyle Sugar Refineries or in his own engineering business. It will have started with the old pounds, shillings and pence and will, if still about, be very small.
  22. I did wonder about the engine. I have, over the years, owned about 10 Rover/MG vehicles (including Austin Morris, etc) and note that my second car, a Rover 25 has 'Rover' across the engine.

  25. I think that the work did not take 4.5 hours. I called and spoke to a mechanic and he appeared rather sheepish as to the charge and put me through to service/sales. I am making a few more enquiries at the moment.
