  1. Got an e-mail from johniedepp asking for help, but can't find his message on the thread. Can anyone help so I can respond.
  2. Trying to finalise the paperwork for the submission of a "Summary Cause Summons" in the Sheriff Court (in Scotland) - claim £1,025 before contractual interest is added. I note on the templates a para under court costs referring to "interest pursuant to section 69 of the County Courts Act....". Does this apply in Scotland?
  3. Communications have been by letter and phone. I have BOS's (Bank of Scotland - this will be a claim in the Scottish Courts) offers in writing. My calculations follow from the SAR and the copy statements BOS provided. I calculated the interest charge rate based on the interest charged on the statement - this is an average of retail transactions and cash withdrawals. From memory I believe the APR's on credit cards are about 22%, so my figure seemed ok. On the insurance, I was taking the stance that if the balance had been reduced - by the "penalties" not being applied - then the premium charged would have been less. I cleared the balance for my daughter, as she was moving abroad temporarily, so the balance is zero. She is now back home. The BOS card is run by HBOS. There were no defaults. Thanks for the on-going help and guidance.
  4. I am helping my daughter to try and recover charges on her credit card - a mixture of overlimit fees - £552 - and late payment charges/fees - £345. BOS CC refunded £287 after my first call to them. Subsequent correspondence and LBA has resulted in them offering a further £161.50 - total of £448.50 "represent 50% of charges since the account was opened". No mention of any interest on the charges. I tried a friendly call to get them to increase the offer but was told this was final. Before preparing the court papers, can anyone confirm if we are entitled to recover the repayment insurance as well. I have calculated it at £8 - not a lot, but it is the principal. I have calculated the interest due on the total amount at £404.65, using a rate of 21.26%, on the period August 02 to current date. This I calculated based on the interest added at the end of each billing period. The final transactions were processed in October 06. Finally, I had tried to settle this "amicably" in August 06, offering to clear the balance on the account. Further interest charges were added totalling £57.62 and I have a letter from one of the Customer service team agreeing that I had tried to settle and offering to refund this as part of the settlement. Do I include this in the claim as well? Any guidance appreciated.
  5. Thanks for the guidance - the "high" rate of interest is based on what I calculated they were charging on the credit card, so I think it should be ok to use. I assume that I will add the "judicial" rate to the claim. Should I move this to a thread of my own? I have been struggling to understand this.

  8. I am helping my daughter to try and recover charges etc from BOS. We wrote to BOS on 24 November cliaming charges and interest totalling £1595. We received a response on 29 November saying our complaint had been passed to Customer Relations. Have now received another letter from a "Redress Assessor, Core Business, Customer Relations" saying they were investigating and would respond by 24 January 2007. Both letters referred to their complints leaflet. Should we wait until then or proceed with the next letter? Advice appreciated.
  9. Well it has taken me a week to get to this point - something like trying to teach old dogs new tricks! I am trying to help my daughter recover excessive charges on her bank account and her credit card - both with BOS. Letter sent to BOS about the bank account 4 weeks ago, before joining CAG - no response yet. Lots of faxes and letters sent regarding the credit card - some charges refunded. Been told no more charges will be refunded. Want me to pay £100 to get copies of statements so that I can see how charges have been applied. Credit limit on the card was £3,000 - balance before I cleared it was £3,600! Accept Daughter was partly to blame, but... How many other people in the same boat? Appreciate any help on both issues.
