Nothing in the post today so i rang the court and they haven't sent my file back to the judge yet It's now 11 days past the dead line and the court have done nothing, what's the point of a court order if it's not enforced It's only a couple of weeks to my hearing, perhaps something will happen before then. -

What are YB's tactics now, the court order said that if they didn't file and serve before the 12th of April their defence would be struck out without further notice. well i don't understand why they haven't contacted me at all in the past two months, no offer, no court bundle, no letter of any sort. Do they not care if their defence is struck out ? I rang the court and the file will be before the judge in the next day or two so i await to see what YB do next. -

YB will drag things out for as long as they can and you'll have to be prepared to take it all the way, but remember the law is on your side and they will pay back every penny taken, once you squeeze them hard enough BTW welcome to the YB forum and good luck, not that you'll need it Moss -

Well the last day for YB to comply with the court order was yesterday and i haven't had anything. I have just rang the court and they haven't received anything either. The lady at the court said the file will be before the judge within the next 5 days, so hopefully not long now -

Mazzab, the judge in my case agreed to the draft order but gave each side 28 days to comply, so i had plenty of time to do the bundle, the most time consuming job was my statement of evidence. The rest was printing and filing 550 pages into 3 bundles Phew !!! Today is the last day for YB to submit their bundles but surprise surprise they haven't bothered -

Yes looks normal, they have 28days from the 5th April to submit a defence which they will leave to the last day or so, then the court will issue AQ's, so you could check out filling in the AQ and the proposed Draft Order and don't forget to include a request for disclosure of CYNtheSYS -

Doo, Thanks Caro, i think iv' e got brain fog today !!! so we'll see, i haven't heard a thing from YB for a couple of months now, I'm beginning to think they have forgotten me Their next offer had better be for the full amount with full interest or it will be rejected and they will go past the dead line and Moss will get judgment. -

Thanks Zoot, Iv' e just got of the phone with the court and they said it didn't matter when i filed my papers as long as it was within my allotted 28 days, and that YB's 28 days wouldn't, start until my 28days were up, which seem a bit unfair as they have 56 days to do nothing Still on the bright side i might get an offer for the full amount this week as the 12th is on Mon. -

Well on 28th Mar i applied for their defence to be struck out and judgement to be given. Today i have received a letter from the court stating "When time for the defendant to comply has expired, i.e. 12 Apr 2007, the file will be referred back to the District Judge for directions" Yet in the Order issued at AQ stage, it says at the start of my directions that "The claimant shall within 28 days of service of this Order send to the Defendant and to the court" and then lists directions, which i complied with on 20th Feb Then at the start of YB's directions it says. "The defendant shall within 28 days thereafter file and serve a response to the claimants schedule, stating in respect of each item claimed" followed by a list of orders for them, followed by "if the defendant fails to comply with this order, the defence will be struck out without further order. Well it doesn't say within 56 days of service YB should comply, it says within 28 days thereafter, so what's going on have the court got it wrong or is this normal procedure and iv' e got it wrong. -

Yes, you give three copies to the court, they stamp them with the court seal and send a copy back to you. -

I'd do 4 because i took 3 into court and they lost them, fortunatley i had saved a copy so took the 3 more in. -

I wrote to my branch, sent them a SAR and spoke to them on the phone asking for copies of documents i had signed when opening my account and only managed to get a copy of my Index card. They did say i didn't have a contract as such only the T&C's when opening the account and when i pressed them for a copy they could only come up with an up to date copy. -

I too would like a copy of the video, but i would imagine that it would be copyrighted and if used in court could YB object. I have also looked at the transcript of the programme on the BBC web site and there is no mention of YB's costing system. Hopefully something useful will emerge soon.

I would keep the pressure up on them regarding compliance with your SAR, so send them a LBA and complain to the ICO . Looking at other threads i would think you will have your statements in the next few days, so i wouldn't start a claim with the statements you have as it won't hurt to wait a few days, also since the Whistleblower programme you might want to use S 32 of the limitations act and go back to the start of your account with YB if you did open it more than 6 years ago. -

HI Hilary, hope your mum in law is getting better. A lot of peep's have had the same re-opening your case letter, i ignored it and carried on . You have sent them a LBA and and given them time to respond so stick to your time schedule, if you wait for them to re-open you are handing control to them. Good to see you back, you'll have the longest claim on the forum. Moss -

Sit down with your highlighter pen and mark all charges applied to your account due to your breaches, so that's all the charges you didn't agree to, then transfer them onto a spread sheet which you will find in the bank templates library. Then have a good read of the FAQ's here is a link http://www.consumeractiongroup.co.uk/forum/faqs-please-read-these/ Then when you are confident you understand the various steps proceed with your claim, don't rush in and make mistakes, you will only get stressed, and if you do get stuck or are unsure then the folks on here are brilliant and you will get the help you need. -

wait and see what the judge orders, you could check out the court bundle and statement of evidence, i was given 28 days but got the order a week after the judge had issued it, so still had time but there is quite a bit of work to produce 3 schedules and the sooner you get yours to YB the sooner they have to reply. -

I sent my second SAR last Friday with another £10 and have requested charges data back to 1995, this will be round two. I haven't heard any thing as yet and I'm expecting them to ask for proof of identity, but will start a new thread when i get going. I don't think you need the dates as under a SAR request they should send you any data that they hold on you that you ask for. There will be fob off's but we know our rights and they will comply.
