Shumba v Clydesdale Bank
moss replied to Shumba's topic in Yorkshire Bank and Clydesdale Bank and Northern Bank
Sorry that's right, you claim the 8% interest when you raise a claim at court but if you are also claiming the portion of overdraft interest debited against an overdrawn balance you should add this at the prelim stage. -
Shumba v Clydesdale Bank

That's right you don't add the interest until you raise a claim at court. The schedule is a list of charges, dates and amounts that you are claiming -

I have just rang the court again and managed to get through. I asked the woman (who was in pre-judgement dept) how long they would give YB to pay up and she said that "if after a reasonable time they hadn't paid i could send in the bailiffs" so i said couldn't the court order that they pay within 7 days and she said that they just require that "they pay within a reasonable time". so can i request that YB are ordered to pay within a specified time and would 7 days be reasonable ? -

Well, i have had a letter from the court this morning saying that YB's defence has been struck out and i have permission to enter judgement. I have just rang the court but the switchboard said they are on strike so i couldn't get through. I will write a letter to request judgement and post it latter. Looks like I'm nearly there Folks !!! :-D -

You don't need to do a schedule of charges for the AQ. Take a look at this http://www.consumeractiongroup.co.uk/forum/bank-templates-library/11644-allocation-questionnaires-guide-completion.html and this http://www.consumeractiongroup.co.uk/forum/general/53570-new-strategy-allocation-questionaires.html Then when you do your AQ attach the draft order and ask for disclosure of CYNthesys. There's a list of contents needed for the court bundle with the bundle that you have down loaded, plus in the thread above there is a excellent guide that will help you do your statement of evidence, assuming the judge agrees to the draft order and you can mention CYNthesys in the statement . Hopefully there will soon be a transcript of the whistleblower programme and you can put that in your bundle as well. Don't worry you will have plenty of time too read up and get your head around things before the court bundle time. -
Hi Chatsworth, and welcome. You could start by reading this. http://www.consumeractiongroup.co.uk/forum/faqs-please-read-these/31460-example-step-step-instructions.html

Shumba v Clydesdale Bank

They try to make themselves look scary, but ask yourself this, can big shot international PLC's change the Law to suit themselves ? NO. you can guarantee they have looked at every angle of this by now and the best they can do is to look scary and delay you as much as possible in the hope you will give up. So keep it simple, stick to the plan and eventually the only option they will have left is to pay up If you start your own thread on this forum you will get all the help and advice you need and while you are waiting for your statements, read as much as you can starting with the FAQ's Welcome aboard, Moss -

Your case is a bit difficult to follow, i see you have started 4 threads. But yes you have to send a schedule of charges with your court bundle as well as copy statements. I also had to do a statement of evidence to go with the bundle from the template library . -

Sarah, I think you and i have fallen down the back of Kirsty Ross's filing cabinet, I sent them my court bundle 2 months ago and i haven't had there's. Indeed i haven't heard from them for a small e-on, Perhaps they think if they put their heads in the sand and ignore us we'll go away:rolleyes: Moss -

Now i am vexed, the court have just phoned me to tell me they've had a search but cant find my file, they said to ring back tomorrow and they will try and resolve the matter, what ever that means!!! It's bad enough with YB making things awkward, but what happens if my file is lost at this stage ? i have copies of my paper work (about 250 pages) but theres YB's and the courts papers. I hope i don't have to start again. -

I have just rang the court again as it's now 13 days past the court order deadline and my file still hasn't been in front of the judge. The lady in the listings dept said she didn't know where my file was and that she could see on the screen that it was overdue to be sent before the judge. Now i am worried that they have lost my file again!!! :-| Any way she is going to ring me later today with an update. -

Lousecutiepie, the court will write to you and tell you how they want to proceed. You could also give them a ring and ask them what the next step is, they are generally very helpful.
