  3. Thank you, Steven. Yes I will keep everyone informed of my progress. Having been through it all before with Nationwide I have much more confidence and the possibility of going to court is not daunting at all. I have right on my side and that is a powerful place to be. Cheers. Juliana:)
  4. Hello Everyone I have just started dealing with GE Money over a default notice they have given me - in an otherwise blameless credit record. I am about to start legal proceedings. I read Bankfodder's post recommending posting on the forum before taking action. So here I am. GE Money do not have a leg to stand on as I have all the paperwork showing my final payment clearing my account with House of Fraser. They must have handed this over to a debt collection agency because 2 years later, while in Australia for a year, I was told I had an outstanding amount. I knew I had paid so I just told my connections back home to bin the letters. I was in the bush for a year - contact home was very limited. When I got home I was pestered by a very aggressive and unpleasant series of phone calls from a dca accusing me of lying. Very threatening. Now that I know what these collection agencies are about I would say it bordered on intimidation and demanding money with menaces. I then came across this wonderful site and sent away for my statements (data subject access - DSA) which duly arrived and lo and behold, there was the final H of F statement , nil balance, AND 2 years later some bogus amount deemed to be £70 owing for card insurance. What with tracing fees, arrears letter charges and retail interest charges it all added up to some £244! Now - the really interesting thing is - this collection firm evapourated into thin air after I received my Data Access Request! I haven't heard from them again. I am left with the default to clear. Their 14 days is up today. I shall give them one more day as it is a bank holiday. I sent my letter requesting they remove the default recorded delivery and have kept the receipt. I have had no reply from GE Money. I have the LBA ready and waiting. Has anyone been down this path with GE money? It would be good to get some feedback. Thank you.
  5. Having read further it looks to me as though cahoot are in deep ****. The interest has gone up to over 19% for some! Surely there must be some protection for customers when this situation arises? Not everyone will be able to 'jump ship'. Anyone?

  7. Yes - stick to your agenda. They are doing what they all do. Prevaricating and buying themselves time hoping that you will be intimidated and put off. I'm going to see if Halifax will give me a credit card and pay the flexiloan back as a purchase. I have checked with Cahoot and they are happy with this arrangement. You can only balance transfer from credit card to credit card apparently. Halifax has this great 12month 0% on purchases deal at the moment if you apply for it online. 9 months offline. But I shall be watching you progress with Cahoot. I should receive my settlement figure in the next few days. It would be good to get some feedback about our rights re this enormous hike in interest. I have a sense that you are on the right track.

  9. Yes - thank you, lee6370. I shall see what they have put in the post to me. And thank you Tobes. For anyone reading this thread don't beleive a word of what Nationwide say until you have it all in writing. This seems to be the message and advice from my experience.
  10. Hello Everyone As I have not yet had written confirmation of settlement from Nationwide I have just been onto the Nationwide Credit Card section and spoken to Adam Slater. He told me a letter was sent out on 19 July. He has assured me that my credit card account has been cleared and re-instated and will have a credit of the £40 I paid them (penalty charges) and that my default has been removed. He also assured me that he will put this in writing again and in the post today. I said again that I would not be advising the court of settlement until I had received this. Charles Bacon's letter of settlement was dated 17 July. But its still not settled and today is the 26 July.
  11. Well - I might initiate something with Nationwide in that case. Perhaps we can keep in touch via the forum and let everyone know how it progresses. What do you say to that, Tobes? Should it be a new thread, mods? How did you word your Moneyclaim?
  12. Yes. That's OK. Dont panic. It buys them time, makes you panic and hopefully bottle out - but not while you are here on this forum. Ha! Next thing is you'll get an Allocation Questionnaire to fill in. It's all in the FAQ's and the Libraries. Take some time to go through it all. All is going to plan. You have the Power!
  13. Wow! I see what you mean! That looks as tho it will be the starting point for my run in with GE Money. That is a completely dodgy story! Back to Nationwide. I'd still like to hear from anyone who has taken them on re. an unjust default. Need a bit of support and feedback before I go ahead and file another claim against them for the Notice they have served me. Anyone?
  14. What's the DCA? So from that comment, Alan, looks like the way to go now is to file a claim for removal of the default. I notice you are doing that with Onetel. How is that going? Anyone taken on Nationwide? How did it go with them?

  16. OK. No - they only issued the default notice after litigation had begun. From your own experience what do you suggest I do now, Alan? Is it in the FAQ's? Yes - it is. Just found it. I dont have a problem going into action again. Anyone else in the same situation? jwright

  18. Hello Everybody Nationwide seem to have renegued on their agreement to remove my default notice. Yesterday I recieved this letter from C.B. Re Notice persuant to Section 10 of the Data Protection Act 1998 We are in receipt of your Notice dated 7 June 2006 but received on 11 July 2006 We are unable to comply with your request to stop processing your personal data as we beleive that this is unjustified on the following grounds: The processing is necessary for the performance of your contract with us You have given us consent to process your information in this manner OK - where do I go from here, please? I have consulted the FAQ's and found a section there. From it I have put this letter together to send. Is it enough? " Charles Bacon I have received your letter dated 21 July regarding the above notice. ( 7.06.06 should have read 07.07.06 - the recorded delivery will have verified this) I am also in receipt of your letter dated 17 July asking me to confirm that I will notify the court that my claim has been settled. Since it was entirely due to your unfair penalties that put me in default I refuse to settle and I will proceed to court unless this default entry is removed. If I am proved right in court, I will take the view that your default notice is defamatory and is a breach of your duty of trust. I trust that you will concede to my request. When I get an assurance in writing from you that the default notice has been removed then, and only then, will I inform the court as you have asked. Until then I am proceeding with my claim. " Please advise! What's the matter with these people?!!
  19. Just thought that I'd add this. Before contacting the court to inform them of settlement make certain that the bank have honoured their side of the claim. When I contacted Nationwide yesterday to make sure they were playing the game it would appear that the default has gone through to Experian. Also, although they had credited my credit card with the £42, I could not get at it because they have closed the account! I told them firmly that I was not prepared to inform the court of settlement until I have written confirmation from them that my good name has been restored and I am in receipt of my money. Following a flurry of phonecalls I was told that I would receive a cheque in the post for the amount owed and a letter confirming cancellation of the default. I will not get in touch with the court until these are in my possession! I told them this. As has been said many times on this forum - dot all the 'i's' and cross all the 't's' before you inform the court that your claim is settled. All the best to you all. I'm off to the Co-Op to to reclaim more money.

These banks have created such a powerful hold on us all psychically - but I never doubted all the good advice from this forum and I had nothing to lose. I am also blessed with a great deal of patience. I am now going to take on the Co-Op for considerably more. My loins are girded with the success of this claim! Anyone who is struggling with their own doubts and fears is welcome to pm me for personal support and encouragement. More power to all of you!!
  21. YES!!! ITS DONE! Letter from the lovely Charlie arrived just now: He says: 'Although Nationwide considers that it has a valid defence to your claim, it is uneconomic to defend it any further. Consequently the full amount of your claim and the court fee of £30, making a total of £110, has been credited to your account. Please confirm that you will advise the court that your claim has now been settled.' So-o-o, go to it people! Its all coming back to you. Hang in there. Dont lose heart. Mine was £80 pounds. I sense they made me wait in the hope that I would give up as it was such a small amount. If any of you need any encouragement just pm me. I will give you every support.   22. Here's what to do if you get defaulted after litigation has begun - as I have. Thank you cillitbanger (Served 04.07 with 14 days to make a payment into my account. I have chosen not to make a payment). Go to the very first letter in the template library: S10 data protection one - and fire it off. I've sent copies to both Charles Bacon and Stephanie Kershaw (the computer generated default notice signature). Recorded delivery. Wait to see what happens next. btw I keep getting calls from the Nationwide: just kids doing their job - but they all wish me luck! Some of them seem to know whats going on.
  23. OK - They have now defaulted me. As they hadn't defaulted me at the time of my Letter Before Action I didn't include the passage about defaulting in my claim. What should I do now? Who do I contact? Charles Bacon? The Lending Control section who sent me the Default Notice? Help - please! I have a letter to OFT to go and an email draughted to Lending Control - Unsecured Debt Recovery. Just need to be sure before sending it that I have covered everything. Or - please point me in the right direction on the forum for advice on this. This is a credit card, remember. . . am doing advanced searches but nothing relevant is coming up. Thanks.
  24. Yes - and all for £80! Perhaps they think I'm going to give in for such a small amount. Or they hope that these tactics may deter others who are only claiming for small amounts. I've got nothing to lose. I'll go right on, with the support of this site, until I've got it back. Then I shall move on to the Co-op and GE Money!
