  1. A big thank you to you all who helped and gave advice, had a reply from barclaycard today, predictably last day before their self imposed deadline. Letter acknowledges fault lies with them and admits they cannot even tell me where the £54 comes from as I paid the account in full. Also admits fault with them telling me the matter was resolved and all detail would be removed from my credit file and this not happening. Annoyingly it mentions aobut the six years and being statute barred and that this would not be the case as they had contact with me in January 2011 - never mind that the contact was querying the debt and in no way was the debt acknoweldged by myself. I'm actually in shock as they have sent me a cheque for £300 in view of the distress and inconvenience I have been caused and in apology for the poor service. I wasn't expecting that and even if I had thought they might compensate me would have expected £20 or something. So big result, still hate Barclays and all their companies though
  2. Just an update to say had a letter from them saying they are investigating and sorry I've encountered a problem with their service blah blah blah, will reply fully by Oct 26th so they've given themselves a month.

Just to confirm I have never had any communication form them, I just have a letter that confirmed what was said over the phone that account number changed for security reasons blah blah. I'll draft a letter to the Data Controller and post it her if I need help. Sorry got my figures mixed up its £54 not £45. just to be clear they have never contacted me about the debt, since I paid it back in 2001, the only contact has been from me querying it.
  5. I’ve got a bit of an ongoing issue with Barclaycard and my credit report and wondered if any of you good people could help. In my past I had a DMP but in 2001 I was able to remortgage my house enabling me to repay all my debts. Barclaycard had stopped sending me statements because I was on an arrangement to pay so I had to ring them and ask how much was outstanding on my account. I repaid the amount they had told me by cheque the following day and heard no more from them. Obviously as this was some time ago I had always assumed that this recorded was now removed from my credit record. To my amazement there is an with Barclaycard account on my record which has £45 outstanding and the account is still live, the strange thing is it’s not under the account number that I had. I contacted Barclaycard about this record and spoke to someone who was extremely rude, he assured me that this was indeed my account and that the account number had been changed for security reasons, he told me this account would remain on my record forever unless I repaid the money. At no time did I agree that this debt was mine. What can I do? Is it not true that this account should have been removed from my account after six years of no contact or repayment? How can I get it removed? I know it’s only £45 but it really sticks in my throat to pay it and no doubt that means another six years before it’s removed. What I don’t understand is why they didn’t contact me about it at the time if it’s residual interest or something. Is there anything else I can do?

  7. Thanks guys, excellent advice from you both, I'll let you know how I get on. My experience with Halifax is not good, due to a 5 yr old satisfied CCJ they refuse to upgrade my account but if you don't try then you don't get. I'm more likely to cry than get aggressive! Sam

Hi, I've an account with Halifax thats going to go overdrawn tomorrow by £25, this is a first for me, I'm assuming that paying money in on the same day won't work as the DD is showing as being paid on my Credit card statement already, by the looks of it they are gong to charge me £58, £30 for the paid DD and £28 for going overdrawn. Does anyone have any experience with ringing them up and asking them to waive it? Is this likely to be successful or am I gonig to have to start off claiming it back with letters etc, I'm so cross with myself for letting this happen! Its a cardcash account so cannot even ring and ask for temp overdraft today! Grateful for any advice. Sam

Hi guys, my court date is for 2nd March and I've still got another couple of weeks to get my court bundle in but I'll definitely be continuing, the judge ordered that my claim stay in small claims and I'm only claiming for an ERC, I had no late or missed payments or anything that would have required manual intervention of £2000 to repay my mortgage, the mortgage wasn't even fixed rate, it was a tracker at 2.5% above base rate. I am happy to go to court as its like has already been said I've incurred costs already and therefore have nothing to lose. Sam

I'm so pleased it was ok after al lthe worry with JAMorgan, did they set a court date or will that be done later, the barister sounds lovely, at least he was genuine and honest, Eversheds would sack him if they knoew - LOL! We've only a three weeks until Dogwashes court date so lots of us are getting close now! Sam

Eversheds tried a Case Management Conference and a move to multi track against me with IGroup, I wrote a letter to the court who dismissed the idea and set a date for small claims of 2nd March so I'm just bideing my time and getting my court bundle ready. Eversheds are in the intimidation game, believe me I've had dealings with them before when they registered a CCJ against my debt despite me making regular payments, keep with it guys, we will be successful in the end, there is no doubt about it.   18. Dolly, I've posted it below, its based on Zoots recommendations and other posts on the forum. Sam "Dear Judge *****, I have received a copy of the Allocation Questionnaire from the defendants (Igroup) solicitor requesting that this case be heard via the multi-track route. I would like to take the opportunity to dispute this requests on the grounds set out below: 1 This is a consumer dispute and should be allocated to small claims which is designed particularly for consumers. 2 I filed the claim believing it would be dealt with in small claims and did not anticipate the costs involved with multi-track. 3 My claim at £1928.64 plus interest and costs is well below the small claims £5000 limit. 4 Under the overriding objectives of the Civil Procedure rules there is an obligation on the court to ensure parties are placed on an equal footing. As the defendant is a huge financial institution it would be unfair to place this in fast track or multi-track as they would have the advantage in being able to bear the risk of costs whereas I do not, neither do I have access to specialist legal teams. 5 The points of law relied upon are well established and settled law with no complex issues of interpretation. Thus there is no need for it to go to a higher court. 6 Despite communication with the defendant they have failed to respond satisfactorily to my request for a breakdown of their costs in order to satisfy me that the charges incurred are lawful. I trust that the points I have made might be taken into account on making your decision."
  19. Dolly, please don't give up, thats why they are making things so difficult so that people give up, don't let them win. When I returned home after Christmas I received a copy of IGroups allocation questionnaire, they also requested multi track for the same reasons as yours have said, they sugested their evidence would take 2.5 days to give, they also said complex law involved blah blah. I wrote a letter (if you want a copy just PM me) to the court and received a letter from the court this morning stating the court date and confirming it will stay in small claims track and the case shall last no longer than 2 hours!!! They are obviously wise to the bad practices going on I'm actually quite excited now, we will all give you any support you need and I'm sure we can come up with a court buddy for you if it comes to it. In the AQ Eversheds also requested there be a hearing to discuss the track suitability, obviously to intimidate me but court ignored this and made the decision without a hearing!
  20. Hi Guy, sounds like you've been through the mill, there are plenty on here going for GE Money as they seem to have taken over lots of our mortgage companies, mine was also with IGroup. You can expect them to play hardball via Eversheds but I do believe we will get there in the end, good luck Sam
  21. Yeah! Things are moving on, I've had a letter this morning from the court to say the case has been allocated to small claims track despite their request, court date is 2nd March. Bring it on, I'm so pleased I wrote the letter to the court, they have obviously had enough of these organisations and their delays and intimidation, they've also said that the case should last no lnoger than 2hrs, bit different to their 2.5 days!!! If it was me I would just issue the warrant, thats because I don't work well over the phone, I'm not very good at thinking on my feet, if you think you can handle a phone call with them and manage not to get involved in any conversation about the case merits etc then go for it, it would certainly save you a lot of hassle if they spring into action after the warrant is issued.   23. Congratulations, how did it happen? Did they just send you a letter or did you contact them, there is hope for the rest of us with Eversheds then, I don't currently have a court date but they have requested a hearing so lets wait and see! Sam
