  1. I have absolutely no idea when i signed but the loan came thru for the sept 98 start of term. I presume I signed way before July as I would have applied as soon as I was able to and I believe that was some months before term started.
  2. Hello I took out student loans 95, 96 and 98 all for the same course, I did not take out a loan in 97 due to a sandwich year. I made payments for a few years then stopped as I simply could not afford to pay the loan and pay my rent. I have not contacted SLC in over 6 years. I recently received a letter from link claiming I owe for the 98 loan. Does the lack of contact make this SB and does the fact that I did not take a loan in 97 mean I have a new style loan as well as an old style one?
  3. I have recently returned to this country after a period working overseas. I have received a letter from Westcot regarding a debt which I never knew I had. Because of the length of time abroad, If I do owe the money within the next 2 month I think this debt would be statue barred in any case. Should I respond or try to wait out the two months. The debt is for a non payment of a credit card at £250. I did not claim any bank charges etc but I know they will be some that i could reclaim. Surely if I did owe this money there would be a CCJ somewhere? Why have Westcot not gone to this stage already? Sorry for all the questions but the letter came as a bit of a shock.
  4. Hi Is there anyone in this forum who is trying to claim charges back from a flexible mortgage. I had a oneaccount but need some help in working out interest on my charges when the account is linked to a mortgage. i have tried the spreadsheets but keep getting lost. 5. Hi Folks Ive been using the template spreadsheets to calculate my interest before court. (Thank you Vampress) However I have a problem. As Im claiming charges from an old One Account the balance of the account is always negative owing to the fact that the mortgage works like a current account and of course until the mortgage was redeemed i always owed money on the account. When i try to calculate the interest on penalties( which i want to do as the total penalties is considerable) the account balance is always negative but so is the agreed overdraft facility. The spreadsheet wants this figure as a positive number. Please help as the laptop has almost gone thru the window twice today. Your assistance as ever is gratefully received.
  6. Thanks bookworm I didnt write my question clearly tho. Not for me anyway. Can I claim it or can they keep it? sorry for being so dense but it is sunday evening.
  7. Hi just wondering if someone can help. i sent my S.A.R - (Subject Access Request) and have so far only received some statements frm my credit card. shabbey have credited my account (which has been sold to a debt collector) with a figure which they say is all the charges over and above the £12 which they now say they are entitled to charge. Whilst i wait for the statements from old business, mortgage and current accounts i was just wondering can they do that? Can i still claim the £12 part of the charges which they have so far not refunded?? thanks
  8. Hi Ive just received some statements for my sisters account. Apart from penalty charges I notice that she has been charged an overdraft usage fee. Not familar with this bank at all can someone please tell me is this a penalty charge which i can try to claim back for her. Seems odd that they have charged her £25 per month then charged interest on the amount she went overdrawn? Any advice would be appreciated. thanks:)
  9. Hi potential value is in the region of 10K does this make any difference to how i wish to proceed. thanks
  10. Hello again I am indispute with a very large newspaper group. A few years ago i collected tokens in a national newspaper to obtain a £10 cruise. I complied with all their conditions and got offered a cruise in March 2005 but because of the massive amount of interest in this offer my cruise was cancelled. I wrote asking when i would be offered another cruise but got no response. The telephone number given out to all of us waiting for info was a recorded message saying "they were looking into this and please be patient". Eventually the recorded message changed to "submit your details and we will assess again if you are eligible". I wrote again submitting my details and low and behold I am no longer eligible. Their letter also states that there were more conditions over and above the ones which were advertised in the T&C with the offer however, they wiil not tell me what these are and they will no longer enter into any discussion with me. I believe from looking on the holiday truths website that this matter will be aired on working lunch soon. I want my cruise for £10. I believe i have complied with all the T&C that were first indicated to me and they have breached the contract, so i am planning on instigating legal action. With the exception of the newspapers that i bought and the time taken to write letters etc i have not actually paid out any money. However i still believe that I should be able to have a cruise for £10. I want to price up the original cruise that was offered to me and sue them for the cost of this minus the £10. This is very similar to the farce a few years ago with a well known vacuum cleaner co. Do you think because I have not actually lost any money i would stil be successful? I was really looking forward to that cruise. Go on cheer me up and say yes please!
  11. Hi I am in dispute with a building company for poor workmanship. Whilst i am confident to chase the company via either a judgement or via a statutory demand (ltd co.) I have a query. I have organised a surveyor to indicate what problems there are but I have only organised a quotation from another builder to rectify the works. Can i just claim this amount or do i actually have to pay a second builder first then try to claim for the invoice. I cannot really afford to pay out a second time without getting some of my money back first. Legally speaking is the money due now as the contract has been breached and the work is defective, or is it only due when i actually pay out for it to be repaired? I am leaning towards a statutory demand because of speed. I know i can do this without a judgement although I may have to argue my case more. I realise that the company may just dispute the amount and could succeed in getting the demand set aside but as they will not answer any of my letters nor will they put together details of what they consider to be an acceptable refund for me I am hitting a brick wall. When i do get through to the Director of the company he consistently tells me my money is safe and he is on with the refund. But thats as far as it ever gets. I am also in the middle of selling this property because I am sick of the hassle and the subsequent debt I have been landed in. How do i stand if I have commenced proceeding but then sell the property before the outcome is determined. I will have had no choice but to take a reduction in price simply because the property is in such a bad condition now. Your help is greatly appreciated.
  12. Hello Just thought i would introduce myself. Thanks for a brilliant website. I have finally found a way of getting my money back. I entered a spiral of debt when my business starting experiencing cash flow problems. Despite my best efforts I am still working with an informal voluntary arrangement. The stress is awful. I am reading thru your FAQ slowly but at last Im starting to smile. I have a query though which i have not found an answer for yet. Is there any way of asking the bank to give me details of a closed account if I dont know the account number. I know I closed the account due to having lots of charges but that was approx 5 years ago. Thank you.
