I have just read that due to the debt being less then £5,000 and covered by the consumer act that the company should not be adding interest???? they are adding £500 PA. what it does not do however is tell me how to stop them adding the interest lol!!! any offers!
  2. LTSB will only let you apply the right of appropriation on 2 occashions after that they will close your account ! but with them as a bank it's a good thing they close it! They are the worst bank ever to deal with.
  3. Hi Guys. Wow this site has changed i don't know my way round any more so please be paitent and help if you can. History. Back in 2005 I was taken to court for a CCJ of £1,300. I tried to defend the case and managed to get it set a side so that i could get all my bank statements together to help prove that i did not owe the said amount. Whilst the CCJ was set aside the company issued proceedings for a charging order. when i went to court to defend the charging order i lost. the judge just would not listern to anything i had to say. I was getting advice at the time from the CAB whom basically said if the company get a charging order do not worry too much as i will only have to pay it when my house was sold!!! ha right. It was only when i joined this site in 2007 that i began to look into things further. I found that whilst I was arguing the charging order the company had also gotten the CCJ without me knowing. Armed with a lot more confidence through this site i decided to fight back. I sent of a cheque for £10 and a request for all my data info. this was never provided so I started court proceedings. However the company managed to get a stay on these proceedings and not long after I got really ill again and as time went on I for got all about it. Whats happened now!!! The company have gotten in touch stating they want paying and if not will initiate court proceedings which will involve the bailiffs. the debt has gone from £1,300 to £9,000. I have writtern to the court to request that the stay be removed from my Date Protection court case. I have also completed a N244 and requested that they CCJ be set aside since i was not awere they had been granted one and I also said if the court could not comply with this request could they make an order to suspend any action until my counter claim has been heard. I have since found out that this company is checking my credit file on a weekly basis, can I stop this??? Am I doing the right thing and if not what should i be doing to sort it out thats if it can be sorted. I no I have sat on this for a long time but i really have been seriously ill. I am still ill and time seems to be flying by. I have made an appointment for the CAB on monday but to be honest they were not very good the first time. Please if some one could advice me what to do. Also I think the original debt is made up of chargers if that helps it was a HFC credit agreement. Thanks guys Pen x
  4. Hi Guy's we desperitly need some advice but it's a bit complicated. I have posted it in the parking ticket section but they sugested i post here as well! in around 2008 My daughter who lives in London sold her car to my son who lives in yorkshire she was moving in to rented accommodation so sold her car as well. she filled and sent of the change of keeper details. But did not inform them of where she was moving too as there was no need since she was no longer the owner. Today she received a letter from a bailif company demanding £1000 plus for 2 parking fines, i gather they would be from when my son had the car. My son knew about 1 of them because he went to the council offices and filled in the forms to appeal against it but heard nothing more from them. he to has moved house a few times. both were students hence the house moves. We did contact the council officed involved and they agreed that they sent the ticket to a completly different address to the one she lives at. The address on the warrent is not the address she lives at either. Her main worry is she is sharing the house with other students and any one of them could allow the bailif in with out thinking. what do we do? neither of them can afford such a large fine. who does my daughter have to contact to say the car was not her's and what can my son do? we did think of filling a out of time form but on that form it states it has to be completed by the registered owner which she no longer is can someone please advise us were in a right panic????

My daughter phoned the council and the agreed they did not send the parking ticket to her address but one she lived in 4 years ago. So the address on the warrent is not the one she lives in. don't know if thats relevant. however when she moved she also sold the car so there was no need to inform swansea of her new address just the new keeper details which she did, I was told i have to file a out of time declaration but on reading that form it states it must be completed but the registered keeper which is no longer her!! can anyone tell us which form she needs to fill in please.

  7. wow i didn't expect anyone to reply thank you I will hunt out the first letter i got from them and get back to you. thanks guys ok found the info but it appears to be a bit jumbled up. the offence was committed on the 5th oct at 14, 27hrs driving 36 miles in a 30 mile zone. on the 9/10/09 I received first PIN I have signed part 2 saying i don't know who was driving and i dated it 13/10/09 ( i posted mine by recorded delivery) 30th/10/09 letter from the police thanking me for my correspondence and enclosing photographic evidence. The enclosed another PIN for me to complete this was also dated 9/10/09. I did not read all the letter i assumed they just wanted me to fill in another PIN so yet again I filled the PIN but on the back of this I signed my name as the driver which was a mistake but for some reason I could not read the small print. I also enclosed a letter explaining why i could not name the driver and requested that the send me a photo of the front of my car to assist me to identify them. On the road in question there are 2 cameras about 40 feet apart on each side of the road. However I did not date this letter but the police have rubber stamped it as the 4th feb 2010. I did date the PIN which was sent with the letter as the 13/10/09 obviously i got the date wrong as i sent it the next day 31/10/09. I always get letters and numbers the wrong way round. however the police have rubberstamped this the 14/02/2010. On the 9/11/09 I received a reminder again it stated notice of prosecution and overleaf was all the same boxes tofill in so I just ignored it because i had sent it to them less then 2 weeks before. Now i have a requisition to attend court in Northwich which is hundreds of miles away. Having reread their letter not I have noticed that not only were they thanking me for my correspondence and asking me to complete another PIN the letter went on to ask for all the names of the drivers!!!!!!!! this i did not do. Now what i am being charged with is failing to give information relating to a driver of a vehicle contrary to section 172(3) and schedule 2 of the road traffic act. This is a right mess. I thought they were just sending me a lot of PINs on The 9/11/09 i received another PIN which was a reminder. I ignored this as i knew i had already completed one and had proof of posting. To be honest I think they have confuesed me with sending me so many PINs to fill in after filling 2 in I gave up providing them with the same information. any help on what to do know.   8. Hi I received a speeding ticket caught by camera. this may sound corny but it happens to be true. I am a disabled driver with a motability car and i have 2 other drivers my son and husband on my insurance. The speeding fine was for a road 2 blocks from me on the way to where my other son lives. I honestly don't know who was driving me to my sons on the day i got the ticket or if i was driving myself. I wrote on the form i got from the police that i was the registered keeper but it could have been any one of us driving that day which really is the truth, none of us have ever been charged with speeding before. I have asked my son and husband if they were driving and they too can't remember. Now i am being taken to court what should i do. should i just own up and say it was me even if i am in doubt? I don't want to pay a £1000 fine so would it be better to just admit to it? what would happen if i plead guilty at this late stage. any advice please pen x

  10. I'm still fumming over this, don't know what to do next, appeal at court is a no no just incase i get the same judge? I phoned the ombudsman and they can't help as the complaint it over 9 months old. Any ideas guy's. i will be paying them tomorrow, luckly i have been putting the cost for elec away each month although i am going to have to find the costs from somewhere as i had not banked on them, I hate the very thought of them getting away with it. anyone any ideas!!!

Hi All. despite having all the evidence showing that we had overpaid at least £500, plus warrant fees ect and the judge agreeing that we had over paid by that much we still lost. whilst going through the bills he saw a (credit payment thank you) for £560 and had the nerve to tell us it was a refund! that was what we had paid for that quarter in electric cards but would he listen NO, with regards to SP not providing with a statement of account from start of account ( they only provided us with one year which did not even relate to the card meter) he said well! the information was not really needed. as to chargers, it was only when i pointed out that we could not work out exactly how much they owed us because they had not provided us with a statement of account he went loopy, giving SPs dirty looks for being so stupid, because of it he could only award them 900 in costs. e said we had no chance of winning so wasted the courts time. I had no chance with him as a magistrate. I now have to find near on £4,000 I could cry. never again will i try to fight someone in court

In court tomorrow at 10am only I don't hold out much hope of winning we still did not receive the statement of account from SP as ordered by the court. last time i felt the magistrate was all in favor for SP as he would not allow us to put forward any questions, every time we asked to say something he would say NO! yet listen to everything SP had to say. If we lose we lose but what will hurt most is having to pay the £2,980 costs they are applying for. I always thought there was no costs for claims under £5,000 how wrong was I. Any last minute advice from anyone. We sent in our defence on time what little it was seeing that we could not get our Data information or statement of account to ascertain exactly how much they do owe us and how much we have paid. thanks everyone pen x
  13. Liverpool council. thanks lamma. I have been in contact with the court who issued the warrant and they are sending me some form by email. not sure what it is yet or what i have to write on it. the bailiff did say he would call back on Tuesday with 2 other men. how intimidating is that.

  15. Hi awhile ago while I was on the way to court re banking charges. I saw a accident so stopped my car in a safe place and placed my blue badge on show. the accident was outside the court house and was a really serious one. a lot of court office where they as witnesses. I could not leave the victim as i was holding towels ect around her head. it was really a serious accident and is long on this site somewhere under TSB. The reason being because of this accident i was too late to attend the hearing so the judge throw out the case. Anyway I got a parking fine, so much for doing a good dead. I totally forgot all about it until a few months ago when i received a letter from the bailiffs saying pay up or they will remove my car which is a mobility one. I phoned the council concerned and told them what had happened as i did not receive any letters to dispute the fine. The council said there is nothing I can do as they have sold the fine on to the bailiffs. today a bailiff knocked on my door demanding £385 which i did not have. they said i had until Tuesday to get it or they will come with a van and remove my goods, he then handed me a warrant. There is no way i can afford to pay, also it was not my fault. I would not just drive by as it was a life or death situation. what can I do. can I stop this warrant??? please help. Thanks pen,
  16. hi emma. doubt that would do as they only have a nick name for him, no surname, I know this because i asked them to check the registry roll but because they didn't have his full name they said they could'nt it only contained previous tenants who they can't contact either because they were listed at the same address, i suppose that was obvious really. another point is he is not doing any maintenance work which needs doing and they don't know if they can use the rent to pay for urgent repairs.
  17. Hi. again this is for my son's friends lol!! who needs them. Ok five of them rented a student house and all paid their deposits. The landlord said he would call each month to check the house and collect the rent. that was 9 months ago and they have not seen anything of him since. They all have the rent £17,000 of it in their bank accounts but are so worried about spending it, They have no way of contacting him, no phone number or address, I think they found the house through an Ad. What can they do. I think he may be in prison or even dead somewhere, lets face it who would not collect that amount of money? If he is just playing silly buggers it's a bit unfair on these guys to be expected to keep hold of it, plus the dept is still growing every month they live there which is for another 6 months. any sujestions please. Hi michele. thank you for replying. we have not chosen the new flooring yet for the simple reason that the amount the insurance is offering to pay won't cover it. the floor we have down cost us near to £5000 insurance are offering £2,500. what we want is the very same flooring we already have and can still be bought. we thought the insurance would arrange for a contractor to come out and do the work so that we would not be involved however they say it does not work like that. they give us a list of suppliers in our area and we decide what we want. we called one of these suppliers today and spoke to them giving them the rooms measurements. they said we have no chance of getting the same quality solid wood block flooring for the price the insurance have quoted. the said the labour alone would take 3 days to fit it plus because it has been glued down using a substance called michelin? a sort of tar stuff it's quite a big job. also the parts of the concrete floor will have to be re-leveled. also the flooring was put in before the kitchen cabinets so they too will have to be taken out. the same thing with the skirting boards as the flooring is flush with the walls under the skirting, all this could involve redecorating and i am unsure how they can move the kitchen cupboards with worktops etc as the tops have been glued into place against the tiles on the wall. It really is a big job yet i don't think the assessor has taken all this in to account. also we still have the leak under the floor. the flooring needs ripping up so we can determine what is causing it and repair it so that it does not course more damage. who's responsibility is that. will the fitters who fit the floor also refit the kitchen? if not who will and who pays for it. thanks michele i'm truly grateful for your advice.   19. Hi. we have had a water leak under the floor, do not no the course but we contacted our insurer because we have a solid wood floor and it's started to lift. The assessor came out to assess the damage. we have now received a mandate to give to the supplier of our new flooring who we have to choose from a home comforts magazine. however the cost of the mandate won't cover the cost of our new floor. The insurance have made no mention of the leak or repairing it, we assume it's under the floor some where. what can we do? even if the mandate did cover the flooring, the damage would happen again unless the leak is found and repaired. also are we obliged to use a supplier from this magazine. we want the same wood flooring not a cheaper version and we were quite happy with the work done by the local contractor who we originally got to lay the floor but they are not part of the assessors network. another thing. I have been told that i have to pay the excess of £300 to the contractor who will be supplying the new floor. I am disabled so don't have a spare £300 at this time of year. thanks
  20. I received a letter today from Drydens who are SP solicitors stating they have applied to the court for judgement against me on the grounds that they did not received my defence. !! I phoned the court to ask if they could do this as I sent them, and the court my defence within the 14 day timescale. The court usher said that the case has gone to the judge for directions but they confirmed my defence has been logged.??? I hope the judge reads the whole file and checks that my defence was recived and not just make a award against me because SP are stating they did not receive it! would the judge do that do you think? I have sent Drydens another copy of my defence just to be on the safe side.
