  1. Just back for one last time to donate and with one last question (I promise!!) Money was safely returned to my account and I had a letter asking me to sign and return. One paragraph said this: "Kindly sign and return the enclosed copy of this letter to us in order that we may have the judgement removed" Is it OK to sign this?
  2. To be honest I used these: courtesy of hagenuk: some t & c's from 2004 Attached Filespersonal_banking_terms.pd f this needs adobe to open. I went in with armfuls of paperwork, it could have all been blank for all the judge knew. I was however never asked to send in anything other than a more detailed Particulars of Claim.
  3. Thanks Lattie, you've been the biggest star of all, especially in the last 24 hours. The judge asked me three questions. Did I have any bother parking? (honestly!), had I heard from the bank and had I incurred and costs getting to court. Apart from that, he told me about my error about interest calculation, told me how much he worked it out to be and then said he hoped I enjoyed the rest of my day. Then he read me out what he had written down (the judgement) and said I would receive a copy in the post. The whole thing took about two minutes! You cannot allow yourself to be intimidated by going to court (easy to say now I know). I had even talked myself through the worst case scenario that I lost and had to pay HSBC's expenses. If your ready for everything it shouldn't hold any fears.
  4. To be honest thats what I understood as well, however the judge said that I couldn't claim from the date of the charge, just from the date which I filed the claim. Thanks to everyone for the congratulations! Just enjoyed a celebratory Magners in the Pub garden down the road (and to celebrate a day off work!). Freakyleaky, wasn't too bothered going into court to be honest. I already knew HSBC were't there (you can ask the usher). I might have been a bit different if they had been. Like I said earlier, the thought of asking them how much it costs to write to you, how do you know, who does know then, etc, actually kind of made me want them to be there!

  6. I was allocated 10 minutes this morning, but courts seem to vary from 5 minutes to 1hr and 30 mins. It actually took about 2 minutes.
  7. :D I WON!!! :D Guess what? A now show from the bank and the judge kindly ticked my box!!!!!!!! Just a maximum of 14 days now before the cheque that will change my life comes thudding onto the doormat. The biggest thank you in the world ever to everyone who has helped. Not just on this thread but on the hundreds of others that I have read. Nearly every one has a different vital snippett of information on it. If you could add up all the fees for legal advice contained on this site, even HSBC would consider coming to court to defend it! I calculated my interest from the date of the charge, but the judge put me right and altered my claim from the date I filed so its a few quid short of what I had claimed but never mind. Also a note to anyone who's court date is looming. Out of four cases at my court against Banks this morning, I was the only one who turned up. It really was a case of popping your head round the corner and saying Hi to the judge. PLEASE go along. I'm sure the banks have come out smiling on the three other cases as there must be more than a few people who don't bother going. Once again, thank you all so much. I really can't wait to make my donation to this site. When you first read some of the threads on here it can seem so confusing. If you just take the time to re-read them over again it all becomes very clear and if your not sure, just ask. To be honest, it would have been worth going up against HSBC in court, just to ask some of the suggested questions on the guidance notes for court day!

  10. Ok, a long night printing and revising ahead! In court at 10AM tommorow morning. Having read a lot of other threads, it would appear that by asking for no other directions except POC's, the judge is not expecting a long day with this one!
  11. Ok, court date is just a day away (wednesday morning). So far we've heard nothing from anyone. I have read on a lot of other threads about the court bundle, however I haven't been asked for any further details other than the Particulars Of Claim which I sent. I am assuming I need to get all this ready for Wednesday but will it be admissable in court? Obviously I'm fairly sure they won't show up but what is likely to happen now?
  12. I submitted the schedule of simple charges as per the excel sheet from this site. Does every charge need to be more detailed then or just attach the schedule to the POC from the link you've given me (with a few alterations)?
  13. Permission to Defendant to file and serve an amended defence thereafter if so advised by 4pm on XXXXX. If I were to fax DG Solicitors, would that count as serving them? Problem is, I've just returned from holiday and it has to be done by tommorow. Local Court is not a problem but its a bit of a trek to Birmingham!
  14. Thanks for all your help so far. The case has been transferred to my local court and we have had a 'General Form of Judgement or Order'. On it it says: 'Claimant shall file and serve a fully particularised particulars of claim' I don't have long to get that done but what does it mean?

  17. Just an update. I received an offer from Colin which was about £300 short which I politely declined. A couple of days later received two more offers (in the same envelope!) about £400 and £450 short. Anyway, the LBA 14 days is up now and I am filing with MCOL. Does anyone have a link to a template for 'Particulars of Claim'? I can only find the template for the N1 form. Or do I use the same wording?
  18. I have replaced this: I am very disappointed that you have failed to respond to my letter of the [XXDATEXX]. with this: "I am in receipt of your letter dated 19th January 2007. However, this sets out no clear timetable to which you intend to work to. In an organisation the size of yours, I consider the 14 days to be ample time in which to consider my request." Can someone quickly confirm this will be ok!! Thanks in advance.
  19. One quick question, what should I replace the first paragraph with in the LBA seeing as I have received a reply from the bank.
  20. 1st letter went off on the 10th Jan claiming £2406.00. Standard 'we'll get back' to you letter received dated 19th January. LBA off on Thursday 25th. So far it's all very straightforward but to anyone just starting, make sure you read, read and re-read again everything. Don't rush into it. There's always someone who's had the same response/experience as you and theres some great advice on here.

  23. Hello! I've had all my statements from HSBC and calculated my charges. Just one question though, on the 28th of each month, I have had 'total charges' charged to my account. These are normally £28.00, £56.00 or £74.00 depending on how many transactions there have been whilst overdrawn. Can I reclaim these or is it just the £30.00 charges for returned cheques and DD's? Thanks in advance.
