  1. Notice of stay rec'd from Durham C C .

     

    Para 3 states ' If no application is made to lift the stay or seek further directions before the earliest of the dates provided for in para 1 above the claim shall stand dismissed without further order.'

     

    Anyone clarify this please. Does this refer to the 'Draft Directions' rerquested in my AQ. Completely confused. Any help please.

  2. Latest update. AQ due Sept 3 sent in good time, presumably YB had the same timescale.

    Letter rec'd today from the Court advising that YB have until Sept 12 to submit their AQ otherwise an award will be made due to default.

    I wait with baited breath.

    I little more advice required, SECTION G 'Other information'. Within these forums a Draft order for Directions is mentioned.

     

    What is it

     

    Is it necessary to complete this or, if not, is it advisable, and is there any advantage in doing so.

     

    Your guidance would be appreciated.

  5. Following advice from various forums, I have now joined the ranks of all you claimants who are waging the long hard battle against the vultures and am hoping for some guidance.

     

    I am at the stage ready to submit a LBA. The initial letter was based upon the premise that I had been operating a Business Account and the appropriate letter was submitted.

     

    As I expected, the usual response was received from YB refusing and quoting the Terms and Conditions, from which has arisen my first problem which I hope someone can advice.

     

    During the period during which the account was operating, all correspondence re the account was addressed to me by name although the name printed on the cheques was the Company name. On each monthly statement, charges were levied as Bank Charges, the amount variable according to the number of transactions applicable during the month, normal Business account practice as I assumed. These charges are NOT subject to my claim as I assume they were legitimate charges.

     

    HOWEVER, the copy of the aforesaid conditions provided by YB state

     

    (1) Free banking is available while your account remains in credit or within an agreed overdraft limit.

     

    If these are the correct terms submitted by YB does this mean that the account is being treated as personal rather than business and I have submitted an incorrect initial letter and what effect will this have?

     

    Also surely it would mean that they have breached this condition and should be liable to refund these non-overdraft monthly fees paid during the past 6 years, a sum far higher the the amount of my claim for penalty charges.

     

    Advice desperately needed before I proceed

Have now received Bank Statements and am about to analyse them for charges.Obviously,Refused DDs,Unauthorized Overdraft etc are easily identifiable but I find it difficult in identifying any interest charged The only interest charges showing are those linked to the regular monthly Bank Charges, I am correct in assuming that these charges and interest are 'normal' charges, which would not be reclaimable or do unfair charges apply to ALL bank charges shown.

     

    I am anxious to commence my claim correctly and seek some guidance please.

  7. Hi everyone. First time on the site and am looking to join the the growing army of claimants and feel confident that you will keep me right in the process.

     

    I'll be looking at charges incurred on an account which I closed in 2004. Any problems in this?

     

    First naive question. Where do I send my first letter asking for details of said charges....Local Branch or Head Office.
