  1. I have never seen such a pathetic default Notice in all my life!! My final response letter arrived today with my Default notice they sent me!! Going to put it up in a minute
  2. Hello ladies I am hopping mad with Capital One Received final response letter now. They wont remove default even though it comprises £25 penalty charges and wont budge. They told me the offer still stands of part payment towards charges and told me I can complain to Financial Ombudsman. Right.. my questions.. will the FOS make them take the default off and refund the charges? I am more concerned about the Default. As this one was done only a few months ago.. which means another 6 years of blackened name!!!!! This company is so freaking incompetent. My final response was from Ruchir Gaur... no doubt the Tea boy in the 'executive office'
  3. Stick at it I really hope you win against this lot! They don't stick to any laws from what I have experienced myself. I am sending a very stern letter tomorrow and if it's not resolved will begin with the Courts myself!
  4. If it's not yours, it has to be removed. If it is yours for an account you have forgotten about, you have to establish that. I would google the company, send a CCA request and say you do not acknowledge the debt If it is yours, it will stay there until 6 years from the date it was placed on your file, unless you can get out of it with an unenforced agreement And even then, that will be a fight
  5. Well the default balance is £1400 + but the actual balance now is £1600. Once it defaults, the agreement is terminated and so it shouldn't be going up. Mine have only ever gone down, as I have made payment!
  6. I think you just have to both write the letter and both sign. You can use a curly font to sign the letter, or, if you choose to use your own.. put a line through it so you would recognise it if they tried to copy and paste it onto a document at a later date Provided you put the account details.. it should be the same. I am 98% sure I am right

  8. Who are these companies regulated by? (stupid question probably?) I think everyone who lends money should be regulated (not that it makes a blind bit of difference to their unscrupulous collection methods) Lesson learnt there ... sorry it cost you so much
  9. That is absolutely dreadful!!! Report it to the local newspaper See what they say... it is a horrifying story that beggars belief! Are you male or female? I would have been very upset had that been me.. well.. hopping mad actually and my temper would have kept me warm on the walk home But still... just because he's been sacked doesn't mean you don't have cause for concern! And a weeks free bus travel?! As if you would want to use their service again!!!!
  10. Great, I will send them a CCA request tomorrow and see what I get.. although the swines demand proof of ID etc etc... delaying everything for me. My time is nearly up before the default drops off.. but I want to get them before then for charges
  11. Interesting! I noticed CitiCards cashed my £10 cheque for the SAR.. I don't recall anyone else cashing for the tenners... anyways.. Should the original agreement arrive with the SAR.. or do I need to send a further CCA request? I would LOVE to receive one of those letters
  12. is there any case law similar to this? You can apply unjust enrichment to several different scenarios - does anyone know of any case law on this issue?

  14. I would happily be a test case, I owe a couple of small debts to Red but my main debts have been passed back to the OCs. I would of course need someone to write the POCs! Next reckon they are passing it over to Lewis.. so there's 2k if it does get passed

  17. I unplug my landline and use an internet phone, so everyone can ring me but the DCAs/banks only get my landline voicemail. The phone line works and is activated, but I get free landline calls from my VoIp line I never get stressed out by these people...
  18. That is a disgrace, you have to do something... great idea reporting it to the media.. maybe others will come forward to Is a log book loan where they give you money against you car? Or is it a car loan?
  19. Excellent!!! Well done I am so pleased with you .. I can't believe how easy you found, some of the companies really drag their heels and reply with bull5hit! And you didn't have to threaten with legal action either! Stuffy! If you need to remortgage to get a better rate.. or anything big like that, now is the time to do it.. in case they slip the default back on!

  21. Well I don't suggest anyone contacts FOS to complain about the HSBC!! Surely the Financial Ombudsman shouldn't have someone who actively works for the HSBC on their board?!
  22. Could you try for a crisis loan? Contact them and explain the situation On what grounds have they refused you a budgeting loan?
  23. Yes it's £10 for a SAR. Send a postal order, or sign your cheque with a different signature so they can't copy and paste
  24. I think it's sloppiness on their part really, not unexpected though, they don't give a 5hit about the people being forced onto these Managed loans to begin with. I shall send that email and see where I get I can't believe how easy it was to get an apology out of them
