  2. But what about any CCTV evidence that there may be in the vicinity? I find it highly unlikely a traffic attendant is going to stand up, shrug and go on his merry way.

No they refused to comply under the exemptions made in Schedule 2 (section 6) of the Data Protection Act 1998 And told me also that the agreement is not void or unlawful (Wilson V First County Trust 2003) They haven't got an agreement. I remember they sent me one out and I never returned it.. not intentionally.. just because I am scatty.
  5. I prefer Sainsburys all around, but it's getting similar to Marks and Spencers in price now! ASDA have gone right down in my opinion, although others say that ASDA are fantastic when returning clothes!!

  7. I have just done a SAR - I will amend it. Can I change it to say I want a breakdown of all interest rates and charges? They have only ever charged me two payments of £5 because I was never late in paying apparently, just the last two months. I remember ringing them also now and explaining I had just had a baby and was on a much reduced rate of wages and they were horrible and couldn't help
  8. Payment Plans The service is restricted to Next Directory flexible account holders only and will only apply to purchases of products which Next has agreed can be paid for over 26 or 52 weeks. For each week of your agreement (26 or 52 weeks), Next will charge to your flexible account the weekly payment due. You will receive your statement as normal each month and in order to benefit from the interest free credit offered under this arrangement, you simply need to make the weekly repayments for your purchase that have become due in the previous month. These payments are required in addition to the minimum monthly payment required on any other purchases you have made on your flexible account in the usual way. Simply make the total repayment by the date stated and you will not be charged interest for your weekly priced item. If you do not make the minimum payment required that month for your interest free items, the unpaid amounts will remain on your account and interest will then be applied to the outstanding balance at the normal rate of 26.49%. A new required payment will be shown on your subsequent statement and you will need to make at least this repayment by the date specified to avoid further action being taken and additional charges accruing to your account. Payments made to your account will be first credited to the purchase of your weekly priced item and then to any other balance on your account, in the order specified in the terms and conditions of your existing flexible account. If you wish to pay weekly you may do so. Should you default on any payment for two consecutive months, Next reserves its right to terminate your ability to take advantage of the interest free option and the full balance outstanding for the item(s) will be added to your account. If such action is taken, Next will withdraw the opportunity for you to delay payment as described above. This means you will be charged interest on the total outstanding balance. Next also reserves the right to refuse further orders on your account if you default on any payment.   9. :D I knew you couldn't be too busy right now ASDA are awful, I remember a girl there on the till - as I was paying for my shopping, she told me the card had been declined. I was mortified, with my little girl in my arms telling her to wait there and I would nip to the cash point as I KNEW there was money in my account. I went to the cash point, apologising profusely to the shoppers queuing.. only to find my account balance was EMPTY! I was so upset I couldn't believe it and I had to leave the shopping there.. anyways.. I got home and phoned my bank and ASDA had charged me twice :-x I was so upset, I had nappies, milk, wipes.. bread.. everything I needed desperately plus all the other shopping and then to think I had absolutely no cash.. Well.. I rang up and complained and they said it had been duly noted.
  10. The woman is going to ring me back - I wonder if they record the phone calls. I think I shall just carry on as I was and take the risk - I am not disputing the debt, only them giving me a default. If they had the agreement I could not complain! 14 days from now I will do the N1. If they do issue a CCJ, it can be removed immediately if it is paid can't it? (I mean as a result of me issuing court proceedings and losing, not of them trying to get one now, as I know they wont)
  11. Hi I contacted them to organise a payment schedule. I want the debt paid off, I owe the money She was horrible, but then I suppose they assume that role the minute they converse with a customer Ideally I would like to settle the whole debt.. BUT also I am concerned.. will the default then go from the Satisfied date? And not from the Default date?
  12. Well I have offered to make payments. They want a percentage of the debt - I asked what the percentage is for. They said to stop it being passed to a Debt Collection Agency. This has annoyed me immensely. I am happy to pay but no way am I paying that amount tomorrow. And also, I am disputing it being sent to a DCA seeing as they have no agreement. I am also very annoyed the snotty woman said 'but you only have two choices to pay, one being cheque the other being debit card) - no DD. I don't know what is best to do. If it goes to Court, I want the default removed and I want to get out of the debt, but I don't appreciate being talked down to. What would you do?! I could wait for it to go to a DCA and then give them a settlement figure of perhaps half.. this would show as partially settled anyways.. she said it will affect my credit file - nothing they have the power to do can be worse than the Default already I am worried if I go to Court I will be putting myself in the firing line for a CCJ which will affect my job in Financial Services (laughable, I know ).
  13. I take it you have finished claiming against all the banks then? Customer Services is absolutely disgraceful, I don't blame you.. and I can't believe they are treating you like this.. in a simple attitude of 'we don't care, so sue us' I think everyone should boycott supermarkets personally, give the business back to the small traders.. who are disappearing on a monthly basis

  16. SAR being sent in the morning, I can request info again under CPR 31. I am concerned taking them to Court as apparently it isn't being seen as favourable by the Judges BUT I am going to request a settlement figure so I can pay the debt before it goes to a Court (if it does). I do not dispute owing the money. I initially contacted them to arrange a payment schedule and by a stroke of luck was told they don't have a CCA The snotty woman told me they couldn't enforce the debt.. Anyways.. I wonder what Simon Wolfsson has to say. Have also pritned off credit file as apparently another guy wrote to him and the default was removed. I don't want that to happen, for it to be replaced at a later date staying on my file for ANOTHER 6 years. Thanks for your reply Martin.
  17. No I didn't, just statements etc.. I can't request one anyways because it is a terminated and settled account. My only dispute is it comprises of massive charges taking me about £400 over the credit limit with charges only. I want the default removed and am going to claim for the charges back..
  18. I wouldn't be surprised if the Parking Attendant is gleefully rubbing his hands together in anticipation of compensation for this. Go to the Police, explain what happened. Do yourself a favour.. it really isn't worth the hassle.. you could end up with a criminal record.
  19. Offer them 20% They will have doubled their money then - but do it in writing You want to offer something reasonable so they are more likely to agree and you can begin to improve your credit file
  20. I have got 5 defaults on my file, some satisfied, some aren't... And my credit score is higher by more than a 100 points than someone who has 8 satisfactory accounts and only one default from 12 months ago (and for only a few hundred quid) How weird.

  22. Didn't the Rankines lose everything? Were they CAGGERs? Just googled them.. how the hell did they get to Crown Court... to LOSE?! Who footed that bill??
  23. First you need to send them a SAR notification and enclose £10 - you can find the template in the Bank Templates Library Send a postal order for £10, without your signature on. Then you need to add up all the charges, and send them a letter stating you are claiming them back and you want to remove the default.. It is hard work, I have done all of this and they have refused so I am now sending them the Letter Before Action which tells them if they dont give me charges back, remove default I will start court proceedings.
  24. Where the defaults made up in any way of penalty charges? It is unlawful to default an account if any of the balance is comprised of charges. Although Capital One are complete to55ers when it comes to this I am at stalemate with them and am having to send a LBA which I will to today on my day off.
