  1. Thanks guys that's great. I will request their official complaints procedure and that will at leaast buy time whilst I am on holiday. This was for a loan, so I don't know why they are saying it was a current account??

Is it worth seeing if they will accept a low amount in full settlement?

  6. Thanks Multay I will send the letter. They have quoted lots of laws so I think they are trying to baffle me. Luckily I have every letter they have sent me and also all of mine that were sent offering payment WHEN they provided the CCA. I also have a letter sent in July accepting my offer of full and final settlement (less than a 1/4 of the debt) I guessed this was them clutching at straws
  7. Hi eastend boy they say the following ...The prohibition under section 78 for possible enforcement of an outstanding balance is a prohibition against a creditor "under the agreement." As the agreement ended by the creditor (vendor) issuing the Formal Demand Notice (subsequent to an unsatisfied default notice) the agreement had ended. Therefore, there is no reason why a creditor cannot enforce the agreement. Long winded eh? They are really getting to me, I go on holiday at the weekend and this is a great way to start it off They are really confusing as they say that it doesn't matter about the CCA but their letter sent in May says that they will no longer pursue the debt!!
  8. Hi all sorry to but in on you thread Maz but I really need some advice about non-compliance to a CCA. Brief version of events so far - sent for a CCA request in Jan, in Mar had a letter saying they were no longer dealing with debt, in May received my cheque back and a letter saying they couldn't provide a CCA and they would no longer pursue the debt! Then received a letter accepting my previous offer of full and final payment!! In the past few weeks have received 6 letters threatening legal action. I wrote to them using the template "no cca received" letter and received a reply today. They are saying that the letter I received in March was an error, and they are saying that they don't need to provide a cca and are asking for full payment in 10 days. I go on holiday at the weekend and I really don't want this hanging over me, please help anyone!!
  9. Hi all, I sent the "no CCA letter" to Rockwell and have today received a response. They have said that the letter they sent in March saying they were no longer pursuing the debt was an error and they apologise!!! They are saying that because the agreement was ended with the vendor there is no reason why a creditor cannot enforce a debt. They have enclosed a copy of history of payment but still no cca and they are saying this is sufficient. They now want full money in 10 days - despite accepting my reduced offer a few months ago!! Please help

  11. Hi guys, hope someone can give me some advice. I have been dealing with Rockwell on behalf of Tessera since Nov last year. I sent a CCA request in January and received a response in May saying that they were no longer dealing with the account. Then in June I received my cheque back for the CCA and a letter saying that they could not provide it and that they would not pursue the debt any longer. In July they sent me a chase letter, which I ignored. Then at the weekend I received 3 letters from then all dated 19th August. 2 of them were identical and thanked me for my recent correspondance (which I haven't sent any) and asked me to pay X amount within 14 days. The other letter said that despite several attempts I had not responded and I owed X amount within 7 days or they would take me to court or send the bailiffs over. Shall I ignore them or send a copy of their "no cca" letter? Any advice would be greatly appreciated x

  13. OMG!! This company are driving me up the wall. They sent me a letter in July chasing a debt that they had told me they had no CCA for (see osts on 13th July). I ignored their letter and today received 3 letters from them all dated 19th Aug. 2 are identical and thank me for my recent correspondance (I haven't sent any) and say if I send payment of X amount within 14 days they will accept it as full and final payment. The other letter is threatening court action, bailiffs etc. Shall I send them a copy of the letter they sent months ago saying they would not pursue this debt? Surely this is harrasment? Any advice greatly appreciated.

  15. No it was standard car finance. From what I remember the car was a problem and he couldn't sell it so the finance company advised that after he paid so much he could hand it back. Which is what he did, he has the receipt from the date they came to get it. £5158 is excessive, in fact thats probably what he paid for the car originally.
  16. Hi all, Wonder if you can help. My dad has received a letter from Marlin regarding a car he had on finance in 2001. He handed the car back on 01/10/2001 and heard nothing else until a couple of weeks ago. He has now received several threatening letters - one threatening bankruptcy regarding the original car loan. They are asking for GBP5158.65!! Can they pursue a debt that is almost 7 years old? When my dad handed the car back he was under the understanding that he would hear no more as he had paid half. Until now he still believed this was the case. He has not responded to any of their letters but their last one was extremely threatening. Any advice?? I have found a letter re statute barred, shall I just get him to send that?

  19. Hi All, I have been trying to sort out a debt with Rockwell since November last year. I have sent CCA's to them and received nothing. In May (4 months after requesting it) they wrote to me saying HSBC bank have been unable to provide them with a copy of the original application and therefore they will not pursue this account any longer!! Great I thought...yesterday I received a letter from them accepting my one off offer to clear the account (this offer was made in Dec last year). Can they now ask for payment after sending a letter saying they will not pursue the account?? This company are so confusing - any advice welcomed.
  20. Hi citizenB I will send a letter to Rockwell asking them to tell me who now has the debt. They are an absolute nightmare, seems you can't do right for doing wrong
  21. No I haven't made any payments to them as yet. When they took over the debt I wrote to them saying I would continue with the monthly payments I had been making to the previous DCA. They didn't accept the monthly offer, I then made an offer of full and final payment and have had no luck.
  22. I sent my letters to Rockwell making them an offer on both accounts. I received a letter back regarding one of the accounts just saying "we no longer deal with this account!" Nothing else, no notice of who is or if they will accept the offer. Well it's nice to see what they do when you make them an offer! I am going to write to them and ask who is now dealing with the account, they have only had it since before xmas. Complete madness

  24. I have found your link as I am in a similar situation. Last year Rockwell took over 2 debts for HSBC. I have been paying these debts to Intrum Justitia for the past 2 years. Rockwell have said they won't keep my monthly payments the same! It took me 2 months to get the correct cca paperwork from them. Once I had that I made them an offer on both debts of 20%. They replied to one of the debts yesterday saying they cannot pass on the information until I complete a financial assesment. Do they have any legal rights to this information as I really don't want to give it to them?
