  1. if it's gone, don't worry about it now (did you get your letter template from another site by any chance?) other sites tell you to add the interest on from the outset! we don't, that's the only difference. just stick to your timescales as advised and you'll be fine.
  2. yes, sorry got the wrong end of the stick. carry on with your claim. IF they offer at this stage it won't be for anywhere near what you are asking (or very rarely is). the reason for the 40 days is because they're behind - what a shame lol.
  3. yes, here's one tip.... don't panic!! lol my claim was over the 5k mark too (first one lol) and they paid back every penny owing. just stick rigidly to your timescales - after all what you are inviting the bank to do is, see you in court!! of course, they won't be there you'll be paid before that stage. good luck;)

  6. nope - you'll accept it as part settlement only!!! unfortunately, the process goes on to going for the full amount and once you reject the first offer.... back to square one i'm afraid. tempting but if they're offering you anything at all.... surely it means that they're not that sure that they weren't wrong in the first place???? go for the lot jackanory;)

  9. get your highlighers at the ready and get all those unlawful charges onto a nice tidy spreadsheet... ready to send your prelim (blocking off the interest column until you file your claim). you'll be amazed at just how much you've been 'had in the net' over the last 6 years believe me. don't get mad - GET EVEN!!!! good luck with your claims - read as much as you can before you claim. mistakes are easy to rectify before you do it - costly after!!!

  12. welcome to the forum em. read as much as you can, as many threads as you can as each case can differ greatly. stick to your timescales, check over your details and you'll be fine. any questions you have - just fire away and somebody will answer you. good luck!
  13. hiya mercury looks like you've done your homework - well done!... that's half the battle. stat looking at the mcol site now (link below) and register. you can pop in and out anytime to amend/change your details. if you get stuck at any point with the particulars of claim, i can send you mine (by pm) or lattie will come along and pm you hers. always try and be one step ahead (as you currently are) and you'll be fine welcome aboard!!
  14. as rayne says, they have got 40 days to send you your statements/info. give them to the whole 40 days because if you need to use a defence in court - you giving them reasonable time to comply will be favoured.
  15. i'd just use a hammer... then get them to try and justify my reasons in court (something i wouldn't wish to disclose)!!!

  19. hi, just to clear a few things up... the 8% is added on to your claim at court stage - not hard to work out at all. if you use a spreadsheet from this site (or mse) the interest is worked out automatically. now is the time to send your schedule of charges to dg solicitors, if they have defended on mcol, you will receive your notice of transfer of proceedings in the post very soon, with your local court address (where the case has been allocated to - send the court 2 copies aswell. don't panic everybody does things differently - there is no right or wrong site (actually there is but i'm biased!!) just read as many threads as you can so you know what may happen next ok?   23. so if you sent your lba on 19th march, you should have filed your claim in court on 2nd april. hsbc don't always respond to your prelims or lba's and it's best to stick to your own timetable. it's your claim, not theirs!! read through as many threads and faq's as you can before you file your claim so you get a good idea of what's likely/not likely to happen adey... that way, you'll not be in for any surprises along the way.

  25. you will send a schedule of charges once you have filed your mcol. there is no provision to include them on the form. we usually say after you have filed, send a couple of copies to the court and a copy to dg once you have had your claim acknowledged. good luck
