    do some homework dietcoke - keep reading on here as much as you can and as many threads as you can..... that way it will take off all the worry your encountering because you don't fully understand the process. try and be one step ahead and get it right, it's much harder to rectify mistakes after the event!!
  4. have you got any written evidence to say that the cheque was stopped? was there a cheque guarantee card number on the back?? i'm flabbergasted that the bank can stop a cheque if there IS sufficient funds in the account!
  5. your loan account is seperate from your claim so NO will not offset the amount oustanding with your 'winnings'! the powers that be don't look upon the bank to highly if they close your account following a (first) claim either - i believe if this happens, you are entitled to compensation.

  20. it's quite a long wait now until they defend so start reading up on the next phase, and other people's threads so you get an idea of what may/may not happen.
  21. as long as you detail everything correctly - they won't fail to settle!!
  22. you have given them enough time to send you a satisfactory offer so yes, i would start you claim with the courts. keep copies of all your correspondence to hsbc (as evidence that you have tried to be reasonable). start looking around the mcol site and registering your details. when you feel that you have the form completed correctly (anyone here will help you with that) and then submit. good luck

    have you got any statements from the account as it's going to be a tough fight if you haven't? hsbc are telling me at the mo that they've only got records on fiche that i can download from online banking - which is the LAST 6 years only!!! if you've got the info - different ball game

  25. remember it's your case not the bank's - you're taking them to court and not the other way round. they won't be setting foot in court you'll be paid before that stage although as rayne said, they may take it right to the wire. by that time (if it goes that far even), you'll have a differentattitude towards your claim and you'll be inviting them to join you there for all the messing about they've done lol. good luck
