  3. Their letter states 'Should you now wish to accept our offer, please sign and return the acceptance form enclosed with our letter of July 29th. However if you do not wish to accept this offer it would appear we are unable to reach an amicable resolution'. Absolutely correct! Incidentally the acceptance form carries no time limit, but where their offer stands legally I'm not sure. Ta for the reply Tony, Ketto
  4. Hi all, After registering last year and meanwhile getting into difficulties with a builder I am now about to start my claim proper. It could be interesting as I first started off my claim b4 I knew this site existed and Barclays had already offered me £380 last september which I have refused with the help and advice of the people here on the site. I have combined the part acceptance of the sum in conjunction with a S.A.R - (Subject Access Request) request so I'll keep everyone posted on how it all goes... I'll perhaps need any winnings to pay the fee settled out of court with the builder!!! Plus my donation to here of course! The only thing that worries me is that Barclays replied to my initial letter of 7 months ago with their (derisory) offer and now, that offer may be out of date even though I have accpeted it as part settlement in my letter. Can anyone offer advice on that possibility please? Thanking you all, Ketto
  5. Hi folks, In early september my partner's 1989 Mk 1 Toyota MR2 was hit from behind while stationary. She has just spent several thousand pounds restoring it, including panel work and full re spray,and was eagerly awaiting the car reaching classic status in a few years time. It has a personalised number plate and was insured fully comp. The other driver admitted liability for the accident although somehow the police who attended did not charge him with any offence. We made it clear to Fortis Insurance Company that we wanted the car repaired. We also asked them not to move the car from our town. Instead they wrote the car off, as was the other drivers car written off, and moved the car some 100 miles away. We were not happy as I always understood that if it wasn't your fault in an accident, the costs of repairing the car would be paid by the oppossition insurance company. But after we complained sufficiently they agreed to return the car, pay out £1100, and not class it as a cat C write off. The car was duly delivered back, but with obvious front end damage, the spoiler is split, the paint work is ruined and it looks terrible. I complained again and they offered £1700, for 'inconvenience', but by this time the loan car had been taken back by Angel Assistance, as in their words, 'your insurance company has dragged along for too long'. So now it's back to taxi's with no obvious recompense. And Fortis are still dragging along. In short, they have lost letters, claimed they never turned up etc etc. The original estimate to repair the car was £1763, but now after the damage to the front end it will obviously cost more. I again tried to get them to up the offer to 2100 but they refused today and have gone back on their word regarding the cat C write off not having to be done. They are now insisting it has to be recorded on the log book which will knock off some 50% of it's value. My question is do I have grounds to sue them for the cost of taxis and for the extra repair or will they just suck me in, chew me up and spit me out if I try it? Any advice would be gratefully received. Many thanks ketto
  6. Hi TNTUK, Don't worry about the comment I don't think it was meant to be that sarcastic, probably just a bit of black humour. I've been a member for just a few weeks and everyone here seems really helpful, so don't feel offended and just get started in claiming back your cash. Besides mumof three boys is a platinum customer and has probably offered loads of help to others that have gone before you! Best of luck Ketto

    False Start

    Hi to you all again with apologies to Olliebear, but due to my partners business moving huge changes at work and a granddaughter arriving, and now unbeilievably the granddaughters other gran being rushed into hospital seriously ill, I've had to put my claim on the back burner. I'm beggining to wonder if my stars are in recverse:(. But looking again at OllieBears reply I've realised I don't have all my bank charge documentation. I'm missing 2004 records, also 2001 and 2002 as that was around the time my marriage broke up. In my original letter to Barclays I calculated for three years only which came to about £750 I then extrapolated the other years would come in roughly the same. How about I use the basis of the letter suggested by Olliebear, (accept 320 as part settlement) but then enclose my £10 and ask for them to supply details of my bank charges in order I can get my documentation totally in order, before I proceed any further? Anyone agree? Also I've heard that if you sign up for internet banking with Barclays you can access all your bank records for the last six years. Does anyone know if that is true? thank you all ketto
  9. Yes, been here and got the t shirt. I tried through a claims assist no win no fee and they were useless. Now the deadline has passed and I've missed out. Go it alone, lay it on thick, and you should get some joy. If you don't, yoir mum in law will only receive another letter like I did yesterday informimg me my payout has now dropped by approx £12,000. Incidentally my policy was taken out in 1986 for £32,000.   11. Hi All, Sadly I started to take on Barclays Bank by myself because I was unaware that CAG was up and running. Now I feel I've reached an impasse with Barclays whom I have been with since I was seventeen (silly me), given that several decades have now since passed:!: To cut a long story short, I fell into the trap of letting a Customer Advisor from Barclays construct and send off a letter for me as I had called into the bank, furious at my latest brace of Paid Referral charges plungeg me deeper into debt. I got the standard letter, then an offer of £320, some £700 short of what I asked for. I promply winged off a reply along with four years statements, plus pointing out to them how much they were ripping me off with o/d charges and ridiculous interest rates on loans, how they had contributed to my debt etc etc I then received a final letter saying 'it would appear we are unable to reach an amicable resolution. unless you sign our original letter accepting our goodwill offer of £320.' As I have not signed and accepted would any of you kind people who has read this post, advise me to start afresh following CAG guidelines or move straight to step 2 and ask for my six years of charges? This could all be complicated by the fact that when I phoned Barclays to discuss their final letter I was informed, as far as they were concerned, the case had been closed as I had not responded quick enough, and they refused to discuss anything further with me in regard to my claim. However I scared them by telling them I was a journalist (which I am sort of) and they said they would try to re open the case, and that they would ring me.   12. Hi All, Firstly I'm kinda relieved there are other folk up late, (last newbie twenty mins b4 starting this post) all with the same intention of taking on the banks and hopefully winning. I'm trying to recover from Barclays, but feel sure I made the mistake of getting sucked into the bank by allowing them to draught a letter on my behalf which they sent off for me. I was offered £380 which I refused. Now the bank tell me as I did not accept the offer my case is now closed! How I wished I'd found out about CAG sooner:x I shall follow the good advice given on this site and spend two or three days looking over the forum. Hopefully I will find someone in a similar position.and I will keep everyone informed as to my progress. Once again Hi to everyone who has read my first ever post Kind Regards, ketto
