In veiw of the pending test case of the OFT v The Banks, should I still begin a claim against Nationwide to reclaim historical charges from an old account which has been closed for some 2 years or so. In light of the forthcoming court case, whenever that may be, would it be worth my while or would I be starting something that may not be resolved for a long time to come or even stayed indefinately. :rolleyes:

  5. Your right Sonjia once you've been sucessful with one it does give you the confidence to go ahead with another . I did my first one against Alliance and Leicester and was nervous about what i was doing all along but when you get that letter saying that they willl settle in full its a great feeling knowing that you were right and the BIG GUNS were wrong. Good luck get that N1 posted ASAP.;-) ;-)
  6. Doo , stick with it your nearly there once they get the county court notice that your claiming against them they will pay up despite telling you all along that they are right and you are wrong. When it comes to face the music time they will cave in because they know they have been wrong all along. Good luck with your claim.
  7. I'm not i've left the account open. I transferred everything to a parachute account when I was going through the claim just haven't got around to closing it down totally yet however if they do close it down it becomes a matter of principle then.
  8. I reclaimed £938:00 from Alliance & Leicester in December last year and received a letter recently that they intend to close my account by the 4th march 2007. If they do pursue this course of action I will be making a complaint to the FOS as the charges applied to my account were disproportionate and illegal in the first place. With the FOS making the recent ruling against A & L the precedent has now been set and I agree with Bigmac - the more customers that complain the more the banks will stop and consider their bullying and retaliatory actions agianst the little man. 8-)
  9. They are not entitled to close your accounts now just because you have reclaimed your charges as that will be seen as retaliatory action towards you. The financial Ombudsman has just ruled against the Alliance & Leicester for exactly that course of action and awarded the customer compensation of £125.00. So if they do follow this course of action make a complaint to the Financial Ombudsman and pursue for compensation. The precedent has now been set the banks are no longer getting all their own way the little man is fighting back.

  11. GOOD DARTS!!!! Capital One settle in full and pay out £765.42. This settlement included compound contractual interest calculated at 21.9% a result for the good guys. Charges incurred - £339.00 Interest- £336.42 SAR payment -£10.00 MCOL costs -£80.00 Total Claimed -£765.42 SAR sent 23rd November 2006 Initial letter sent 27th December 2006 Goodwill gesture of £107 from Capital One offered 9th January 2007 LBA sent 20th January 2007 Reply declining goodwill offer sent 24th January 2007 Goodwill gesture of £107 from Capital one again offered 31st January 2007 - ignored MCOL started 5th February 2007 Notification of Capital One intention to defend received 8th February 2007 Full settlement received 2nd March 2007 SMUGG NEATHBOY 3rd March 2007:grin: :grin: :grin:

Stick with it guys once the county court notice MCOL etc. have been served on Cap One they will initially respond indicating that they intend to defend the claim- Don't worry this is a standard response and they will settle in full within a matter of weeks.   13. Trucker , I've just done a successful claim with Capital One and claimed Compounded contractual interest with the rate of 21.9% . Go for it and good luck . Any problems have a look at the thread like DONBRACHO says -Calculating Interest is doing my head in
  14. Thanks Redsonja i'm chuffed with that result . I did all the claim on the MCOL eveything was included kept it all quite basic and it worked well without any problems. I initially had the expected response from Capital One indicating that they intended to defend the claim but then paid up in full within a mater of 2 weeks or so. Stick with it and good luck with your claim GO GET EM :grin: :grin:
  15. HAPPY DAYS another result for the good guys. Received a letter from a Graham Daley from the executive office of Capital One today agreeing to pay £765.42 as a full settlement of the claim. Very pleased with this result particulary as the claim included the compound contractual interest at 21.9 % . My advice to other people considering to claim cci is go for it your entitled to claim it and using vampiresses spreadsheet 13 made the whole process relatively stressless. Thanks to everyone on here for their assistance, help, and advice throughout this claim a donation to this forum willl definately follow. :grin: :grin: :grin: :grin: :grin: :grin:
  16. OOPS- just read this thread and think I may have dropped a B****CK. I'm in the process of claiming my charges and compound interest at a rate of 21.9% and I've filed my claim using MCOL. Have I made a big mistake, is this going to jepordise my claim. I'm currently waiting for Capital One to file their defence as they have indicated that they intend to defend the claim. Any advice please. :rolleyes:
  17. Hi guys, haven't been on line for a while but just flicking through to see how its all going. Looking at the threads I see that Redsonjia calculated Brads cci as 21.99%. That looks right as I worked mine out at more or less the same and claimed 21.9% with my MCOL using vampiresses spreadsheet 13. Latest from capital one is that they've again made the same offer of £107.00 to which I have n't replied as this second offer was made after I filed the MCOL. Capital One have replied indicating that they intend to fully defend the claim so i'm awaiting their 28 day response. Will update when I hear anymore - watch this space!!! :rolleyes:
  18. mcol sent today for charges of £339 plus £10 SAR fee plus contractual compounded interest of £336.42. Total amount of claim plus costs £765.42. I've read now that Capital One are tying it on with regards to paying back interest , their paying the charges in full but no interest . Any more cases of this and has anyone challenged this practice, if so what was the result
  19. Recalculated my figures was never very good at maths but the revised claim now comes to £685.00 including the compounded contractual interest. Sent the LBA on 20th January giving them 7 days to cough up. typed out my official sod off letter to the £107 settlement offer MR uddy offered up as a goodwill gesture which will be sent recorded delivery in the morning. Just wait and see now the ball is in capital ones court. Will give them until the 30th January before starting MCOL. Watch this post!!! ;)

Anyway onwards and upwards sent my LBA on the 20th jan and typed my official rejection of the settlement offer this evening which will be sent recorded post in the morning. Have given them 7 days in the LBA but with postage etc. I'll give them the benefit of waiting until the 31st january before filing MCOL. Then they can bring it on :)

They've already done just that., i had a letter on the 15the January from Mr Uddy offering me £107:00 as a good will gestureso i'm in the process of preparing my letter of rejection and then my LBA. One question can I incorporate both letters into one, it does't make much sense sending them both seperately. Now that I've worked out the contractual compound interest which is nearly as much again as the charges the overall claim is £685. If I accept this ridiculous offer minus the £10 SAR I paid,it works out they will only be repaying me £97:00. If thats the tactic they can bring it on ;)

  24. Thanks for all your help guys i've finally got my head around it and used Vampireses spreadsheet 13. Worked the APR out now at 21.9% not the 34% I initially arrived at just as well there were more holes in my initial calculations than a string vest. Anyway the new figure from the spreadsheet is charges £339, interest £336 total claim now £675:00. Is that the final lot , I am right in thinking now that I cannot claim the statutory 8% at MCOL as well because the contractual compound interest has been calculated throughout the claim.? :)
  25. thanks fpr the support but my mind is blown trying to work this one out. I 'm not sure if my figures are right or if In got the right apr at 34% knowing my luck I'll be the one that they defend at court and look a right prick if all my figures are wrong and the APR is grossly over exaggerated. I've read lots of threads and still confused on how to get the contractual compound interest. If I don't get my head around it I think I'll just go for the statutory 8% at the MCOL stage.
