  1. I will keep you posted on how it progresses. I did have a complaint in with the FOS for Cap One, but it's taking months, thought I would just go for it with the court as I now realise you can use an English Bank/CC address to serve papers on if you live in Scotland, Mike Daley, Govan Law Centre has a great piece about Juristiction.
  2. Thanks for that Uk,I thought that, but when I submited my order for costs to my successful Abbey claim the court told me that the case was dismissed and I would have to recall the case? I will have it all ready for the court date this time though, so I can present it to the court.

  4. Hi there, I'm about to submit my court papers for Crap 1, do I ask for wasted time costs etc at this point, or do I wait until the hearing date and ask the Sheriff then? Thanks

  6. Phoned Halifax yesturday after I had sent the 1st letter and LBA to ask what they were intending to do, well, apparantly they sent me a letter refusing my request, but, get this... It hasn't been saved on computer? Errr? What??? I'm confused, with the recent uproar and regarding claims for bank charges and the whole media coverage, you would think they would save important correspondance? Fools! So, now I take them to court and highlighting that they ignored my request? Interesting!
  7. It's worth remembering though that a lot of the threads here suggest that the FOS can't retrieve the interest.
  8. I think I'm gonna let this one go as I have many more claims to process through the same court and don't wanna p-off the sheriff, but I will be sure and add my costs when I file my claim next time. Thanks guys X

  10. Hi Panic, deep breaths, in, out, in, out, Seriously, don't panic. Start again from the beginning. Firstly, I would write a letter to the courts explaining your change in circumstances, offering an amount you can comfortably afford. And then sit down and start the claim process for your charges from the begginning, there are loads of friendly people here willing to help and offer advice, just as I am doing, but remember too, that there are templates for all your letters here and spreadsheets to help you work the Math out. Have a good look around the site and have a read of some of the other threads and familiarise yourself. Remeber to keep the courts informed. Best Wishes.

Right, here's what to do, take your £35 off them and insure your new car with cheap online car insurance and home insurance quotes - elephant.co.uk without any No Claims Bonus' and tell Hastings to go to hell. That's what we did and the insurance is still cheaper? How does that work then? I'll tell you why, this NCB is a out and out [problem]!
  12. I think so Rory, the jist I got was that I should have went to court and asked for the costs then, I can recall the claim, just searching through all the legal mumbo jumbo on the Scottish Courts Home Page site now.
  13. The court have sent back my Extract of Dismissal, so as far as they are concerned that's that and I should have claimed costs either before the case was dismissed or in court on the hearing date. Grrrr!

  17. I received the Extract of Dismissal today from the Court, and when I phoned they said that that was it over with and if i wanted to claim costs I should have done it before the case was dismissed? So now I think I have to recall the case, I'm totally lost now???
  18. This didn't work for me as the Sheriff Clerk told me that because the Extract of Dismissal has been granted I can no longer claim for costs. If I wanted to claim further costs I would have had to do it before the court date? ie, before the case was dismissed????

  20. Then slightly ammend the template to say something like... 'I am dissapointed with your response to my letter dated...' Does that help at all?
  21. Done it, written to OFCOM, ready to post tommorrow. They ain't making this claim any easier on themselves!
  22. Nice one surprise, I've had 6 calls from them today, one they didn't answer and cut off, then I spoke to someone who doesn't have details on my account about the harrassment letter I sent them. Can we complain on line to ofcom? I'm off to visit their site now and see. When she asked me for the £199 tonight, I said no and asked her if she would be able to pay me the £1500 they owe me, and if it would be alright for me to call her every half an hour? Ha ha, she said no, funny that:lol: I'm off to complain now!
  23. Is there a piece of legislation/law they can provide to show that there is no way you can make a subsequent claim? Do you have a link?
