  1. Right then. The 14 days I gave them to reply to my request letter is up. And (no surprise really) I have no reply. I've recently found out that they've also lost my deferment notices for this year too! Still, I suppose it will add weight to my case in court. Noomill do you have your POC I could use please? Ta

  4. OK. I've sent my LBA to the SLC. They have 14 days to respond to my complaints and then it's off to the small claims court. I sent copies of my correspondence to their rotweillers, Thesis Servicing. Let the games begin!
  5. Just a quick bit of advice, please. I've been going through the Data return from my Access request with a fine tooth comb. It appears that SLC pssed responsibility for my loan onto Thesis Servicing last year. I'm just wondering how this will affect who I issue my court proceedings against. Shall I make my claim against, SLC, Thesis or both? I'm figuring that as the problem was caused by SLC, that it will that shower I take to court? Thanks again.

  7. Hello Chaps, I'm trying to get my charges back for the Co op. I know the results are on hold for now but I wanted to get my claim started. I wrote to them in July with my £10 and did the SAR. They haven't replied and my cheque hasn't been cashed. So, I'm assuming the letter has been lost. I think I'll write again, enclosing my original letter, along with another cheque, and requesting that they act urgently. Can I threaten them with a complaint to the Ombudsman, or am I just going to have to wait another 40 days? Thanks, Rich.

  9. I think it's time I took further action against the SLC. A little history: I have sent back all of my deferment notices since I graduated in 1997. I have never earned the minimum amount to start repaying my loans. However, the SLC have lost one of my deferment notices from a few years ago (I have the dates at home). I made a complaint by phone at the time but it was ignored and I was intimidated into paying a "debt" which had become due because, according to SLC, they had no deferment notice for that period. However they did accept my late deferment notice but wouldn't budge on backdating it. I paid £100 but then realised I wasn't liable for this as the error had been made on the part of SLC. Subsequently I have been accruing "charges" for letters and recently they have passed my "debt" to Thesis servicing. I complained in writing to SLC last August but I had no reply (I do have a copy of that letter). Things have started to get a bit hairy now with Thesis servicing ringing my parents, an old ex girlfriend and her mother!!!. Thesis have my address but, thankfully, not my phone number. I plan to do the following and wondered if anyone had any advice. I will write to SLC (enclosing a copy of my letter from last year) and remind them of my complaint. In the same letter I will ask that they refund the £100 I paid them; that they cancel all charges on my account; that they reinstate the deferment and that they call off Thesis Servicing and, if they have made any notes on my credit record, remove those. I will send copies of this to Thesis, telling them of my dispute and insist that they contact only myself and in writing. I will give SLC forty days to respond to this. If there is no reply I'll take them to the small claims court. Does this sound like a viable course of action? I'm fed up with dealing with these klutzes and I just want to be clear of a problem that wasn't caused by me. growl. Looking forward to any advice. Thanks. Rich.

  11. Hello, Hope that everyone is well and all actions are proceeding well. I am about to take Lloyds TSB to court for a refund of my charges. This afternoon I'll nip down to the court (handily just round the corner) and pick up one of their N1 forms. I understand that I have to make 3 copies and send one to the bank, one to Lloyds and one for myself... Am just a bit nervous about all this as I have never been to court or taken any action like this before (my brother jokingly suggested that knowing my luck they'd hire a top barrister for their defence!). I have followed the process on here clearly and read posts about court actions. It seems like a bit of a nailbiting process but I'm prepared to go through it. Also have been promoting your good services to anyone and everyone who has complained to me of bank charges. I think I'm becoming a bit too evangelical about this now.   12. Hello Hope that everyone is well and your actions are proceeding smoothly. I bank with Lloyds TSB and am claiming back £1100 in bank charges. I have sent my LBA and am due to make my small claims action on 8th Feb. My situation with Lloyds is that they made lots of charges against me and then lent me the money to repay the charges by extending my overdraft limit (so very kind of them!!). They then asked me to pay back £19 per month and reduced my o/d limit by the same amount each month. When I found out I could get my charges back I stopped paying the £19 per month and began my claim against them. I also changed my account to one with the Co-op as I was so very unhappy with Lloyds. My question is whether to ignore this default notice and continue with my court action. The Default notice gives me until 14th Feb to pay back around £500. Which I can't do. When I get my charges back I am planning to pay off the overdraft and close the account. Look forward to some help Regards Richard
  13. Hello Everyone, Hope that you're all well. Given this website by a friend and was amazed to see how much I have been charged by banks and credit cards over the last 6 years (£822 Lloyds TSB and £220 Caital one). I am at the stage of sending preliminary request for payment but am a little confused about claiming interest. Can I do this on all chargres going back to 2000 or does interest only apply after I have made my request? Looking forward to some help Please:) Regards, Richard
