  1. sorry to be a pain, but the Template link doens't link to a specific letter - was it supposed to?
  2. Hi all, A few months ago my friend purchased a Sony as100v sports camera to bring on our summer holiday. These are similar to a Go-Pro and come with a waterproof case so the unit can be used to film underwater. Day 1 of using the camera in the water resulted in the waterproof case failing and water getting into the camera itself, causing obvious damage. We are familiar with these types of cameras as we already have an Sony HDRAS15 which is a slightly older model. The unit has been usedcorrectly, and at depths well within the limitation of the unit. We actually took the camera out of the case and submerged the unit in a few inches of water and, sure enough, it failed to remain water-tight. This product was purchased (by debit card – sadly!) from anon-line retailer called eGlobal. The product is shipped from Hong Kong so does not come with a manufactures warranty, but did come with the retailers own 6 month warranty. The warranty itself all seems a bit vague, but it does have a section specifically referring to waterproof cameras, etc… (fromthe site) Special Note for Waterproof Cameras/Casings/Bags Damages due to impact, exceeding recommended depths, etc. would void the warranty. Please be advised that the warranty offered is strictly for the purchased item only. eGlobaL will not be held liable for any defects or damage on any other item(s) used in conjunction with this product. Full conditions: http://www.eglobaldigitalstore.co.uk/warranty-policy.html My friend has provided proof or purchase, but has been advised by them that they will not replace or repair, as it is not covered. This seems contradictory…. I know he has some rights, but I am not entirely sure what the best course of action is to take. We would obviously prefer to avoid the small claims court if possible. Any advice on an approach would be massively appreciated. Thanks!
  3. Have just spoken to a nice chap at Croydon Council. They have on their system written notice from myself and from my ex landlord that I left the propery in April 2004. They carried the account on until August 2004. He could not tell me why this has happened. He has gone off to do what he needs to do and will call me back this morning. Croydon Council are totally useless.
  4. Thanks for the advice I just had a look through some old paperwork and found copies of my tenancy agreement from when I moved from Croydon to Bristol dated March 2004. I also found my employment contract, medial card and signed recipts for the deposit on my flat all dated March 2004. PHEW!!!! Will speak to Croydon Council tomorrow and see if I can get an end to this asap. Is it worth speaking to Newlyn to advise them I have spoken to the council and can prove I do not owe this debt?
  5. Hey PT Thanks for the quick response. My ex partner was in the place a few months longer than me. I was under the impression that the council was advised we had left the property. The only thing I have to prove I had moved out is a copy of my employment contract. This is addressed to my new address in a new city 200 miles away from croydon and dated may 2004. I moved out of that propery in 2007 so never kept copies of utility bills. I only recently binned copies of the tenancy agreement. Can they chase this debt after all this time? Its has been 7 years since I moved out?
  6. Hey All. Its been a long time since I posted here, but recieved a letter today from Newlyns regarding unpaid c/tax from 2004. I had no idea what this was about so I gave them a call. The chap I spoke to was actually very pleasent, although he did seem very sketchy. Apparently I own £600 for unpaid c/tax. This is for a rented property I moved out of in march 2004. Newlyns sent this letter to my parents address. I have no idea how they got the address. I have advised them that this is my parents address. They did ask for my new address and number. I didn't give it to them. The really odd thing is he told me that croydon council took me to court in my absence on May 29th 2005. I have an ongoing account with equifax as I like to keep an eye on my credit report, and nothing on my credit file suggests I have a CCJ. I called equifax and they confirmed that any CCJ would appear on my credit file. Should I contact Croydon Council to see what they have to say? They were advised when I moved out as were the letting agents. Should I just ignor it? As they don't have any contact details for me other than my parents address. Are they allowed to chase an alleged debt from 2004? Any advice is greatly appreciated Ian
  7. Hi , Just thought I would mention in addition... I viewed a thread on moneysavingexpert.com, and someone received same sort of letter x 2 from this debt recovery plus agent. They ignored and then received some sort of claim form from their local county court? not sure what that would be.....
  8. Hi All again, Well....it went all quiet for a month. I thought that may be the end of this, then I received this yesterday from a " Debt Recovery" bailiff company. Now I dont know what to do, if I should respond in a certain way or just ignore. Do you think they can take me to court?? Any suggestions or advice much appreciated on to my next step.... Many thanks to those already responded earlier on this thread!!!! I have attached the letter I received yesterday. Debt Letter.pdf
  9. thanks guy's for all your advice, much appreciated, it's quite amusing now reading all the responses and I will post further communication from them.. To Bubblecat, do you have the link for the DCA thread, as I cannot find it!? Many thanks again, I am doing nothing as suggested yet again!!!!!!
  10. Hello All again, I received this yesterday, this is now the 3rd letter from them.. its is similiar to the 2nd one. Any views on this, I live with my Dad and he is getting a bit worried now that the bailiff's are going to knock !! many thanks for all your comments 3rd parking Ticket.pdf
  11. well, i just ignored the 1st ticket...and now received this letter, what do you think? should i still ignore? it does worry me a tad ... 2nd parking letter.pdf
  12. Hi, I have been looking at the forum on here and thought I would post this as I believe I do not have to pay the Fixed Penalty Notice. I parked in a well known local shopping centre carpark, I purchased a pay and display ticket, and on return to my car, had been issued with a Fixed Penalty Notice ticket from National Clamps. This is because I parked in error in a Parent & Child space.........I did not realise this was the case and feel that the ticket cost(£80) is somewhat extortionate and unfair... I have attached the ticket for anyone to have a look at....... Does anyone agree?.......... I was going to write to them initially explaining this, but after reading the forum on here I think admitting to anything may onyl "drop" myself in it. Would anyone suggest I just ignore this as they are a private company. Any help much appreciated. :( Parking Ticket.pdf
  13. It was basically refused on a "first come first served" basis, despite the fact that all the paperwork was signed, and I even had a end date agreed. There was small print which allowed them to retract the offer, which they did, when they realised they had overdone their allocation.
  14. If I was refused voluntary redundancy in August 2008, because there were too many applications. Can my employer legally make me redundant on a compulsory basis?? I thought I read somewhere that they have to leave a period of time between refusal of voluntary redundancy and forcing compulsory redundancy, but I can't find the info anywhere. Please help
  15. so much fro my phone call. Nobody called, so I phoned them and asked for Ben *******, who was not in. When I pointed out that I had been promised a call at 6:00pm, I was told that one of my other two 'account managers' would call me...did they? did they f*** !! It must be coming to something when you want MBNA to call you and they won't - hahah!
  16. weird thing is that I have not once been appraoched by DCA's of even their internal collection department. They seem to be playing nicely with me for the most part (for MBNA anyway) weeeeird!
  17. Got three more letters from them this moring - all threatening various horrible things... One of them was another "you've moved / evading debt" letter. I decided to phone them and get this over with once and for all. I have offered to pay off one card, providing them re-calulate the interest to something more reasonable than 34.% and refund all charges. I would then begin making payment on the other card as well. This, I confirmed, would be my final offer to them, if this is rejected, they can do whatever they want, as I didn't care, and they wouldn't get a penny more out of me. The person I spoke to was actually very pleasant - polite, apologetic and professional (he won't last long then). He is calling me back with an answer Monday evening (10 hours into his 13 hour shift!) I did record the call. Little tip - I used my mobile phone, but put the call on loadspeaker, then used my partners phone to record the call on the 'voice recorder' mode. SImply lieing the phones next to each other actually works surprisingly well. The clarity of the recording was very impressive, and I can save the file on my laptop by either bluetoothing it across or popping the phone's emory card straight in to the laptop. SO, if like me, you are impatient to move things on, but want the security of recorded communication - this might be an option for you. Cheers all
  18. I thought better of it when I got home... I do feel a bit in limbo though. Their CCA is enforceable. I have another 30 days to wait until the SAR comes back - I'd rather negotiate a sensible (re-calculated) APR etc, and pay them back or wait and risc my credit rating being well and truly 5cr3wed (if it isn't aready) !
  19. booo.... I might call them tonight anyway..... I know, I know, but I am impatient.
  20. Has anyone negotiated with MBNA via email. I understand why we don't talk to these dodgy types over the telephone, but the constant walking to the post office and paying for recorded delivery mail and, most of all, the time it is taking is somewhat tiring. Can anyone suggest an emailable point of contact who I can contact? Cheers
  21. anyone had any dealings with Dee Dillistone (Head of Customer Assistance) ??
