  2. Just going through my Nephews statements and have come across 'Unpaids out' £35.00, can anyone please tell me is this a charge, there are quite a few I have found so far. I have not done a Barclays before, only Abbey so not used to what terms they use. Many thanks:)
  3. Thanks to everyone for the well done posts! If you have not reached this stage yet, keep at it, keep positive, its a case of when, not 'if' they settle. I had loads of doubts, believe you me I did, but, I kept at it thanks to the support on here, and its all worked out in the end. Jan

  5. I really need some advice folks!!! Had settlement cheque in bank yesterday for all my claim plus court costs and interest, had Abbey letter today saying they have informed court they wish to withdraw MY claim, told court no way till funds are clear am I withdrawing my court claim.... My question is now am I able to claim my bundle costs. I rang Court today asking for advice but they are limited in what they can tell me, so I need help folks! I asked Court if i could still attend the hearing on the 5th March and try claim my bundle costs, they looked on my particulars of claim and said I had only written down claiming 'costs allowed by the court' and that it was up to me if I wanted to do that (not much help) Does this mean I can only claim my actual court costs of £80 ( which Abbey have paid) or does it mean that i can claim expenses for putting the bundle in too? I am so confused now and I feel I want to ring Inga Kirkman, but am worried what to say, how to word it, and if I need a breakdown of the bundle costs to give her, OR, I could email her if I could find her email address that is, if anyone has it please can you let me know what it is. So, basically my question is do I have a leg to stand on if I dont withdraw my claim in court, even though they have settled(funds not cleared) and go ahead and attend the hearing and ask for expenses, or would anyone think it would be ok to email Inga?   6. Thanks DS!!! (and for all your help as well!) I know I am the worlds worse worrier, but, we have to keep at it, and it pays off in the end. One final question DS please ( !!) funds wont be cleared until 27th Feb, so do I inform Court tomorrow I have money,(well once I have a letter off Abbey that is, had nothing so far to say they have paid) or do I wait until funds are clear to inform them? I also would have liked to claim for expenses, but suppose that is out of the question now ? Hows things going with your claim? I have lost your thread,can you send me a link to it please? Just found a payment by cheque, into my account for £1080.83 today(funds cleared 27th Feb) so I am assuming I have won, as I cant think of anyone else who would want to pay that amount of money into my account !!! Its £12.50 too much but I assume thats the daily interest that has been added on. Had no letter from Abbey so have to 'guess' it's from them!!!!!! I almost fell off my chair when I saw it, I cant believe they have have paid me, I am sooooooooooooooo pleased, chuffed, happy you name it, I am it !!!!!!!!!!!!!!!!!! :-) wooo hooooooo!!!!! :-) Thanks to EVERYONE for your help, could not have done any of this without you!   9. OK, Last day for Court Bundle was today and guess what! No defence put in by Abbey.Just rang the Court to ask. So, can anyone tell me what happens now please? All Court would say is it means Abbey can't rely on it in the hearing now. Court is 2 weeks today 5th March, and it's getting nearer and nearer and the nerves are starting to hit home. I have put it into my head I am going to Court, so that if it turns out I am not, it will be a bonus! Jan

  11. Well, I thought by now I would be posting here, my Court date is 5th March and still no sign of life from Abbey:( I had a 50% GOGW offer ( only in full and final) 2 days after Christmas .... I think they thought they would get the offer in then as we would all be skint after the hols! I was but I didnt take it!.....They however didnt deposit the funds in my account as they have with lots on here, I replied to them that I respectfully refused their offer, but I would accept in partial payment, but no money and no reply was forthcoming from them. Last Bundle in by date was 22nd Feb, but mine went to Court and Abbey on 12th Feb, 1 week early. So it's still a case of sitting and waiting it seems. Hope its ok to add to the posts on here, makes me feel a bit better and a bit closer to winning ( hopefully!)   12. Hi Nick, Its 8% I am claiming, so at least I can stop worrying on that one lol None of my charges are older than 6 yrs so I am safe on that too...not doing too bad so far eh!! I am just worried incase they make me enter into dialogue I know bugger all about basically, big words and all that. Just want to know what to say should the need arise! Maybe someone who has been in touch with Abbey at this stage could let us both know what was said on the phone. Best of luck with your claim by the way, I am so glad the end is almost in sight! If, no change that to WHEN Abbey ring me with an offer of settlement( said in a very positive voice lol) ...Court bundles went in today.....is there going to be some questions they may fire at me about the case, is there anything I should read up on to be prepared, not sure what to expect if they ring me, I was hoping my nerves would be calmer now, but seems not lol

  15. I would like to claim expenses when in court 5th march, time, travel, bundle etc, how do I go about this, can anyone help me please! Do I add a very polite paragraph to my claim summery, and if so, can anyone please help me word this.... If not and it turns out I ask Judge in the hearing for it, IF I win, then what happens if Abbey settle prior to court date I wont be able to ask judge for it then! I really want to claim these expenses if possible, but really not sure how to go about it, call me thick if you want ( many do !!) but thats me! One more question! You know the interest I am claiming for the last 6 yrs on my charges, totaled up to when I filed my claim, if I win, will the judge make them pay interest up to the court date? And if so, will they work that out or should I prior to court, dont want to get caught out! Thanks! Abbey £782 refund requested.   17. Thanks Bish! Don't suppose I can pick your brains again can I ? Have read on here that people are claiming somewhere in the region of £9.25 per hour for preperation expenses and that a court said 49 hrs was the norm. Is this correct and if so, when could I ask for expenses? Do I add it to my bundle or what? Very unsure about even asking for expenses to be honest, even though, as we all know, it takes hour after hour to research etc and do the bundle. I have printed out my bundles now, just need to index them and stick in binders. Have also spotted that some folk are emailing Inga to see if they will be prepared to negotiate a settlement. Not sure if I should do this or not, yes, once again, the nerves are back!!
  18. Hi Bish Thanks for your reply. Yes, all documents to be in to all partys no later than 14 days before hearing, and original documents to be brought to hearing. Just also noticed another piece of paper that has small claims notes on it and is titled Final hearing - small claims, notes for parties.....so it looks like the end 'may' be in sight. Could I ask another question please! When doing 3 copies for the court bundle, do I have to copy all my microfiche pages 3 times too? I have copied only the ones that have charges on them so far. Also, as my husband is joint account holder, is he able to come to court with me (in the event it goes that far) My nerves have kicked in since reading the court bundle file I am afraid, all very 'real' now and scary.
  19. Had a court date today, for the 5th March. The paperwork states A Notice of allocation to the small claims track (hearing), my question being is this THE court case that decides I get my money back or is it a pre hearing whatsit thing? I am at a loss! Have already begun to get my court bundle ready, my poor printer is shattered! One further thing of interest is: Abbey wrote to me on 28th Dec offering me 50% in full and final, which I refused,stating I would only accept it as part payment and would continue to persue balance through the court (no money has appeared in my account though) and sent a copy of my reply to the court, but in the judges directions it states: Defendant to notify court by 4pm on 7th Feb whether there is to be any application in relation to defendants letter of 28th dec which has been provided to the court by the claiment. Am I right in thinking this is the judge asking them to reply if they are willing to settle in full as I requested in my letter to them? I am hopeful it is this and I may not have to go to court, and advice is welcome here!
  20. Writing this on behalf of my Sister in Law. She has claimed £455 in bank charges, Abbey have paid £200 as GOGW offer, which she accepted as part payment. She has a few questions if anyone can help please: Today she is filling in her N1 form for court and would like to know how she goes about it after having a GOGW payment, eg, does she claim for the full amount of £455, and write that Abbey have paid her £200 of that as GOGW or does she just claim for the remainder of the charges being £255. Also does she claim interest on the full amount of £455 or only on the balance of £255. Is there a template anywhere we could use to help please, I have looked and cant find anything. Thanks
  21. Hi DS:) Thanks for your reply. I don't mind you asking at all DS! Both Abbey and the Court have had copies of the schedule of charges, the last one sent when I filled my claim 5th December 06, (Abbey having had about 5 copies of it!!) I followed what to do from here, double checking everything about 5 times! I hope I have done this right, I don't want to start panicing now! Abbey did offer me 50% of my claim ( minus court costs) which would have been in full and final settlement, which I respectfully refused, and in any case, has not been put into my bank account. The AQ was sent to court only, hope that was correct. Am I correct now in thinking the next stage is waiting for a court date? Best of luck with your claims DS. Jan
  22. Filled in and sent to Court my AQ, deadline tomorrow, 22nd Jan. Can anyone tell me what happens next please. Do Abbey have to fill it in by the deadline, by the way, I wondered what happens if they have not done it by 22nd Jan what happens then? I have been ok'ish' till now, but not sure what happens from now on. Is it worth ringing Court tomorrow to see if Abbey have sent in their AQ? Thanks!
  23. Had Abbeys defence today. They have also offered me half of what I am claiming, (not including court costs), but want me to accept it as full and final settlement, which i am not prepared to do. No money has been paid into my account, so I am going to reject their 'kind' offer. Any ideas what I can write back in reply? Thanks in advance.
