  1. Rejected? I thought that filing was just the next step? Do i have to send a letter of rejection then?
  2. Thanks dar£n. I realise that it's me taking them to court, and i know they are all now using this stalling technique. They just get my goat, and are the only ones charging me interest on my debt. They expect most people to give up and just accept at the court stage. BUT i'm not going to. Another question. Will it matter if i don't file for say 3 weeks, until my next pay day? Or as i've laid down the 14 day limit (which they responded within), should i / do i have to stick to that time frame?? Thanks.

  4. Hi Folks, Some advice please, if anybody is / has been in a similar situation. I finished banking with FD a while back. But as i've gone onto a debt management plan, the account is still open to pay off the arrears. The CCCS pay into it each month, and these lot are the only one of my creditors that still charge me interest. I had a loan and an overdraft with them at the time, and the amount left is around the 6k mark! Obviously, the charges i want to claim back i want in the form of a cheque. NOT paid into this account to clear the arrears. Now they have been quite good so far, and after each letter from me have made an offer. After the 1st stage it was about £50 less than the £463.50 i'm trying to claim (a small amount compared to many of you). Without prejudice blah blah. The 2nd offer was the about the full amount. That all sounds fine and dandy. But on the sign to accept sheet, they slip in the part about it being credited to the account. Snidey gets! Now i'm around a week off filing a claim. Is it worth going on with the claim in court for this amount, with all the costs involved, if i might get fecked off by them? I know i'd get all costs and interest back if i win, but....? I'm obviously tight for money at the minute, and was going to use this towards an lcd tv and Glasto next month 8-) They've had it off me already, so why should it get back to them through interest charges, when we are already under an agreement for the repayment of the debt? Any advice would be appreciated!
  5. Ok, i have a couple of questions about starting my claim against First Direct. I would appreciate any advice. Excuse me if they have been asked before, but i have not studied the forum in much depth. Is it ok if the £10 fee is sent in a cheque made out by somebody else? As i no longer have a cheque book. Can't see this being a problem. Made to First Direct i would presume? Does it need to be sent Special / Recorded Delivery, as does the reclaim letter? The only reason i'm asking for the Subject Access Request is to double check my charges. I have all my statements for 6 years, but have thrown some of the charges summary sheets. I'd calculated my charges as around £500, but on double checking my sheets this morning noticed that some fee's (overdraft fee) are on these sheets and not on the statement itself. Is this normal? I need the money, and don't want to short change myself / let them off the hook! Also, when i move onto the repayment request can i ask for the money in a cheque? As i'm now on a Debt Management Plan my account is closed with them. BUT is still active for the payment of monies owed to them. If that makes any sense? I had an overdraft and loan, which they combined into a total owed. So each month the CCCS payment goes into this. Would they still pay out via cheque, or would the cheeky gets try and put it towards the debt owing? Sorry for all the questions, but i want to get this right straight off!
