  2. Dont give them your account details, ask for their bank details, keep that email and their reply In fact keep all your communications Email, letters. I would communicate with them by email. Do you have their email details ??? Talking on the phone creates more pressure and worries.
  3. Which is the important bit on the blog that refers to my POC ?? Sorry to ask it is just a bit confusing for me. As I cant see post judgment only pre judgement interest on my POCs..Cheers
  4. Did you see on the POC they are claiming 9p per day from date of issue, dont think the judge will like the delay by them to build that up.

  6. DCAs usually accept plans and you may find that as they bought the debt for a smaller amount the would also be open to offers less than the amount owed. Dont be scared about going to court as they will be fair to you and will only agree a payment that you can reasonably afford according to your income and expenditure. I have been to court before and been successful in reclaiming bank charges, it was fun.
  7. Have you done an i/c and expenditure sheet for yourself stressedx to see how much you can actually pay them per month without getting yourself in any other difficulties ?? Also I would think your personal financial circumstances have changed since you became pregnant and will do more after the birth of littleun maybe they will agree to a repayment plan if they knew about you expecting as it may creep into their criteria for a repayment plan. Also you could consider allowing a judge to decide how much is actually owed and how much you are reasonably able to pay. You could end up with a ccj mind you. Personally my credit rating is bombing anyway so a ccj wont matter to me, but may to you. Bear in mind, going to court could take months giving you a chance to save up enough money to pay them what a judge agrees you owe, and if you pay the amount within a month of the judgement, you do not get a ccj. Indeed the judge may rule that you only owe half the amount claimed by PE. OR before you actually go to court but after the summons, bearing in mind the amount claimed by PE you could make them an offer. Also remember that once and IF PE go to court the amount claimed usually stagnates and doesnt increase.

"The Claimant further claims interest at the rate of 8 percent pa under section 69 of the CC Act 1984 on the said sum calculated at 7.29 pounds." "And the Claimant further claims interest under the above act at the rate of 9 pence per day from the date of issue of the claim until judgement or earlier payment" "Claimants claim 411.50."
  10. What I did was email them with a settlement figure I could pay, this was refused. Didnt hear from them despite emailing them for a few months, then received a court summons filed my defence etc Havnt heard anything from the court or minicredit since Januaryish. BTW keep your email trail it can be very helpful should you need to use it later. Their refusal to answer your emails wont look good in court. @vjohn82 this is my wifes thread I have sort of taken it over for her as I am dealing with it for her.   11. They are not allowed to send someone round without you making an appointment, which you will never agree to. Send them something along the lines of this.... In regards to your letter to me, dated xx.xx.xxxx, , under the Office of Fair Trading rules, you can only visit me at my home if you make an appointment and I have no wish to make such an appointment with you. Therefore any charges cannot be incurred. There is an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v Sheppard & Short Ltd [1959] 2 QB 384. per Lord Evershed M.R.). Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and, if you do so, you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance." I advise you that any attempts to contact me must now only be in writing; Your threat to force a home visit will be recorded and noted down in my complaint to the Office of Fair Trading. A copy of this letter will also be sent by recorded post."
  12. Stressedx Try an think of yourself offloading some of that stress by posting on this thread. There is no rush to get this sorted, you can only pay what you can pay, when you can pay it. Dont let them put you under pressure. There are people on here that can help you through this and support you as well. They like to rush you and make you think something worse will happen. Just take your time dealing with them, think of it as breathing exercises at baby class. You and your babies health are more important than a few hundred quid which will be sorted one way or the other. Take Care Delboy

  15. Roxy they are claiming 400 plus from my oh on a 100 pound loan, So that figure seems about right for MC BUT if you have paid them 165 pounds already it shouldnt be that much have you checked your online account ???

  18. Hi Margot, received a court summons from MC 7 Jan 2011 Chose to defend as didnt agree with total owed and other things Have you received a hello goodbye letter from Minicredit and Fredricksons. Do you agree with the total amount owed?? Was the account in dispute before MC handed it over?? Cheers and dont panic and dont rush decisions
