  1. get in touch with the court first thing tomorrow mate.they have made a big blooper. hope everything goes ok.
  2. barclays never submitted their documents on time in my case and i requested a judgement from the court . this is a copy of the letter i sent to the court. Dear Sir/Madam, you -v- Barclays Bank Plc Claim No: I, the Claimant, refer to the claim as detailed above and specifically the order made by district judge xxxxx dated xxxxxx. Please find enclosed a copy of the order to which I refer. I wish to inform the court that the Defendant has not complied with the order in that it has not served upon me its evidence, or any such documents, as was specifically directed. I can confirm that my documents were both filed and served to the court and the defendant pursuant to the terms of the order on xxxxxx. It is submitted that the Defendants non-compliance creates a significant imbalance between the parties in light of the forthcoming hearing, which I believe to be contrary to the overriding objective. This imbalance is particularly exacerbated by the fact that the Defendant is represented by specialist solicitors, whereas I am a litigant in person. Accordingly, and in view of the terms of the honourable courts previous order, it is respectfully suggested that the court may be minded to make an order pursuant to Rule 3.4(2)© of the Civil Procedure Rules. Yours faithfully i was granted a default judgement by the court last friday and after phoning barclays they admitted defeat and paid the money into my account tuesday. send the letter in you have nothing to lose.
  3. elmac if you are unsure just stick to the 8% statutory interest cos working out the other interest (contractual) is bloody hard work. my charges came to £3200 and the interest came to £800 and that was using the simple spreadsheet. try not to tie yourself in knots at this early stage. if you want to go for the contractual interest ignore me and go for it someone is bound to help you out. good luck whatever you decide.

  6. it just goes to show how out of touch with the public these people are , and not just concerning bank charges , the whole country is in a mess and they just bury their heads in the sand. well while their heads are in the sand someone should shove a size ten boot up their arses and kick them into reality. what planet are they living on. my letter is going off tomorrow to my local MP and also to that other well known politician Tony Blair who will probably blame it all on Maggie Thatcher. oh well nearly time for bed said zebedee.

  12. well done DDUK , mine went in yesterday . this is what i sent to the court , just ammend to suit Dear Sir/Madam, You -v- Barclays Bank Plc. Claim Number: xxxxxx. I wish to inform the court that the claim as detailed above, in which I am the Claimant, has now been settled. The Defendant paid the full amount claimed, namely £xxxxxx, by way of credit to my bank account on (date). As such, no further action is necessary in respect of this claim. Please accept my sincere apologies for the waste of the courts valuable time spent processing and managing this claim. I do wish to inform the court however, that the decision to enter into this litigation was not taken lightly, and that ample opportunity was given to the Defendant to resolve this matter by way of negotiation before proceeding with this claim. Regretfully, all attempts at meaningful dialogue were either rebutted or ignored. Yours faithfully well done again:grin:

  15. come on madamv get your claim back on track. i would send another LBA , give em 2 weeks then start MCOL. I HAVE JUST BEEN PAID BACK £4200. £3200 in charges £800 interest (which i think yours is supposed to be as in your first thread you put £88.34ish) and £220 court costs. if you can't afford it ask barclays to up your overdraft and use their money. good luck.
  16. hey i just got back £4200 off the [Edit] and tomorrow i am going in to close my account after watching that eye opener. plus they owe me another £150 in charges since january.which i will ask the bank manager for tomorrow just before i withdraw my money and close my account. good luck with yours.

  19. buzz if i were you i would just put the phone down . i refuse to have anything to do with them on the phone because all they try and do is intimidate you , it's what they are trained to do (see daily mail article today and programme tonight on bbc 1). i have just won back all that was owed , over £4000 , which went into the bank yesterday. just stick to your timetable and don't back down , you will get it all back . good luck mate.

  24. err right bear with me on this. a mate in works missus works for RBS and they have been told that if the OFT cap bank charges at 12 or 13 quid and you start a claim they will refund the difference of the charge. so if you were claiming back 30 quid they would deduct the new charge of 12 quid and pay you back 18. now i don't know if this is what all the banks are gonna do and wether it's legal or not but that's the rumour i've heard. hope that made sense. by the way the money should be in my account today or tomorrow. and i have just won £100 in a newspaper crossword comp. heh heh things are looking up. good luck with yours.
