Hi My husband works for a road traffic management company, because of the olympics no road works can go on throughout the olympics which will last approx 3 months, he has had a letter saying that they will have to lay him off for 3 months and when the work picks back up he can go back. This doesn't help us financially though, as he is the main earner and I dont know how we will manage without his wage coming in, just because they have decided they should have the olympics in great britain should not mean people should suffer for it through loss of jobs. Does anyone know if there is a government subsidary for things like this or give any advice. Many thanks Hayley
  2. Hi I am asking this on behalf of a friend. My friend sent a CCA Request off to American Express, as she is having a few problems with them at the moment, she received a letter back a few days later saying: Please find enclosed a copy of the online application and Terms and Conditions relevant at the time the account was opened and closed. These documents form the executed agreement between you and American Express. Attached to the letter was credit card agreement regulated by the consumer credit act 1974 (printed on the bottom was executed agreement) this credit agreement was not signed by my friend. Am I right in thinking that although it doesn't have her signature on it is still legal as it states it is an executed agreement? Thanks in advance Hayley
  3. Hi all I am after some advice AGAIN! I am still trying to sort this issue out with Welcome, I received a letter back off them after sending the letter before action, they refunded me part of the charges, which I accepted as partial settlement. I still wanted them to reconstruct all three accounts though to take into consideration the partial refund they had given me. They ignored my request when I asked them to provide evidence that they had reconstructed the accounts. I then sent off all the information to the FSA to see if they could order them to reconstruct the three accounts as IMS suggested. After taking 12 weeks to look into it a adjudicator has contacted me. He has asked me for 1. Evidence the fees and charges that have been applied to the loans held with the business were done so unlawfully; 2.Evidence the refund of the fees proposed by the business is less beneficial than a refund of interest that may have been incurred had the fees not been applied. Since receiving this off a guy called Graham Harber at FSA, Welcome has offered to refund the remainder of the charges, I have declined them at present until they provide evidence that they have reconstructed the three accounts and a few questions I have outstanding about loan one. I replied to Graham Harbour answering question one, basically saying that they were obviously unlawful otherwise Welcome would not be refunding them, but I don't really know how to answer the second question because I don't know what he means?   5. Good afternoon all Right, I finally recieved my SAR back from Capital one and am a little confused. I have gone through all the statements and made up a speadsheet From Dec 04 - April 07 my debits were £1384.18 and my credits were £1598.18, so my credits were more than my debits (by £214), they sold the debt to Arrow on 19 April for £398.20. I then looked closely through the statements provided and up until August 06 my debits were £1344.18 and my credits were £651.91 then an additional £40.00 was added for overlimit fees and late payment fee so that left me owing £732.27. Then in September 06 £732.20 was credited to my account the breakdown was £33.41 insurance charge off £60.29 interest charge off £202.56 deliquency charge off £435.94 other fees charge off my October statement then started with a balance of £732.20. Also they defaulted me on 2/9/06 I really dont understand what they have done, in November 2006 they also credited me £200 for late refund fee and overlimit fee refund. Can anyone offer some advice on what they may have done. Many thanks Hayley
  6. Great thanks ims. I have issued a MCOL before for bank charges but was years ago, I remember it being quite straight forwrad but not sure if it has changed since. I have actually started filling in a mcol this morning for Welcome, I am definately going to take it all the way. I have looked for the letter before action this morning as I was sure from years ago I sent another letter, but cannot seem to find it anywhere, could you point me in the right direction.   7. Good Morning After some advice again. I sent the preliminary letter off to welcome concerning all the different charges and gave them 14 days to respond, I have not heard anything from them at all. I checked Royal Mail and it was signed for on 7 July. Do I send out another letter now or just put a claim in straight away? if so is it easy to do? Many thanks Hayley
  8. Ah ok thanks for explaining that. I am not trying to get out of paying the debt, I had the items so am happy to pay, I only owe around £160 anyway and as soon as I recieve the SAR i will be sending a letter to settle, so it wont go to court anyway. All I would have liked to do is got them to remove the default as it is affecting my credit and wont be off for another 2 years , my mortgage deal is up in February and would like a better mortgage but with this default I doubt they will even give me a good rate. Thanks for the info though

  11. Hi Tingy and Teaboy I am sorry that I have not responded but only just seen your comments when I come on to upload this letter I have recieved from Next. Thank you for all your information, I will download the EU Directives and see if I can make any sense of it. I have received the letter attached off Next in response to my SAR and was just wondering if someone could look at the points made and make sure they are not fobbing me off.   12. I never ever signed a credit agreement with Next, I also have a letter off Next saying that I never. I never set out to open an account, I went online one day to order something and was going to pay off my debit card, but it automatically opened an account for me with a £300 limit.
  13. Good Morning IMS Can I just ask, would it be ok to use the bank charges spreadsheet to work out the charges and interest and also, should I put on the spreadsheet the interest on the charges they charged me, if that makes sense. Cheers Hayley
  14. Ok thanks for putting me right, I was under the impression that a company could not process any data about you on your credit file unless they had permission of you, as it is your personal data, i.e. permission in the form of a credit agreement.
  15. Ok thats great, I will start the ball rolling tomorrow. I think I will leave the PPi as I am sure Medicare was something like if you have an accident they pay you so much per night you were in hospital something like that. I have reclaimed charges on a few other things in the past I may have even tried with Welcome without any success, but will have another go I will keep you posted. I dont understand though, I have never signed a credit agreement, therefore I have not given them permission to place any data on my credit report so how can they place a default on there? or am I missing something. Also, I never received a Default notice through the post although they have sent me a copy saying that they have.
  17. IMS, Thank you so much although it has confused me even more , it doesn't take much though lol. Do you suggest I write to welcome first to try and claim back the charges and insurance or go straight to the FOS? I dont really know if I could claim the insurances were misold, as with another company (citifinance) I managed to get the PPI refunded as it was payment protection if I was sick or had an accident, but I work for a LGA so get full pay for 6 months anyway. This insurance was differentwith Welcome it was for homecare and medicare so dont really have a good reason for why it could have been misold, also I am sure I may have used one of the homecare insurance once as my boiler was playing up As far as you can see though all the figures look right?   19. Hi Was wondering if anybody could give me any advice. I sent off a CCA a few years back for a next catalogue I used to have, after checking my credit report and seeing that they had put a default onto my account, I never received a default notice. Next basically wrote back to me saying that they did not have a signed credit agreement, I asked them to remove the default notice as I had no knowledge of it being put on but they refused. This has been going on since 2007 and they still refuse to remove the default. I have always made payments off the debt of £10 p/m, I currently owe £179 and am desperate to get this default removed, I am currently in a position to clear the balance or offer a a percentage, does anyone have any experience of this, and being succesful in getting the default removed?   20. Thank you for your advice. If Capital One has sold the debt to a DCA would they still hold all the infomation, and if they do send it who would I write to regarding reclaiming the charges put on the account, Capital One or the DCA? Cheers Hayley
  21. Good Afternoon I was just wondering if anyone could give me a few answers. I had a Capital One Credit Card around 2005, the credit limit was for £200, I got into a bit of financial difficulty and struggled to pay, resulting in a default on my Credit file. In 2007, I sent off an SAR to Capital One and tried reclaiming the charges, I cant remeber exactly how much they come to but I know they offered me £200 refund, I accepted this which took the debt back down to around £300 it was only £200 to begin with but with charges and interest it mounted up. About a month after accepting the refund of charges Capital one sold the debt, but they never removed the refund of charges, and silly me lost the letter as proof of this so there was nothing I could do. So to cut a long story short the debt was passed to numerous dca's adding more charges over the years. I have always made payments of £5/10 every month but still owe a few hundred pound. I just need to know 1. If I sent off snother SAR to the current DCA would they be able to sent me all the info that I would have recieved in my first SAR in 2007? e.g. statements with charges on etc 2. Does a DCA have to have proof of postage for a default letter? and if they do and cant provide it could I ask for the default to be removed? Thanks in advance Hayley
