  1. No, the DCA have never written to me at my new address. I haven't got access to the paperwork right now but it must be at least 5 years old ( iknow 6 is the magic number!) but will confirm this at a later date. The address that the DCA wrote to is my permanent address but Im in Scotland at the moment looking after my disabled aunt and have been here for a few months now. My neighbour collects my mail and sends it on to me every couple of weeks but she was on holiday for 2 weeks therefore I got a months worth of mail yesterday.
  2. I have just found out that I have had a CCJ awarded against me. The claim form was sent to an address at which I no longer live. All the mail was forwarded to me which I received yesterday. In this mail was the claim form. I tried to defend it this morning but found out that judgement had aleady been made against me. This is for an extrememly old debt and I have already had dealings with the DCA regarding proving the debt is mine, which they have never been able to do. What can I do now? Thanks Spot

  4. If you are really struggling to make the minimum payments, write to your creditors and ask them to accept lower payments. As you have no real issues with any of them at the moment, you might be pleasantly surprised by their responses. The template you need is here: http://www.consumeractiongroup.co.uk/forum/general-debt-issues/20758-creditors-dcas-letter-templates.html and use letter B. Please take the advice of those here who are much further down the road than you and have a wealth of experience. Try this first and if the creditors don't agree at first, come back to us and we can advice you what to do. Good luck Spotnot

DCA's can get, well a little creative shall we say when it comes to signatures!! NCO are under investigation at the moment by Trading Standards so if they don't comply with your request, report them to TS. However, at the mo, send them the above letter and see what they produce.   8. No one will turn up! Its just a scare tactic. If you do a search for NCO Europe you will see that Mr Brown(?) will be calling on at houses all over the country at the same time on the same day. Don't worry about it. Can you give any more detail on the debt and we can help you get rid of NCO for ever. Spotnot
  9. As far as I can remember, the CSA will issue him with an estimated amount to pay, usually far in excess of what he will actually need to pay. This usually invokes a response. If the CSA have his NI number they can eventually take the payments straight from his wages. However, unless you badger the CSA on a regular basis, you won't get very far. This is what happened in my case although it was a few years ago and things may have changed. But if they can't enforce payment, what is the point of the CSA?
  10. I had this problem with my ex. He has maintenance taken from his wages but his employer wouldn't pass it on to the CSA. Eventually the CSA took the employer to court and they were issued with a £2,000 fine for every time they didn't send the money in. I get it on time now! (However, it did take 12 and a half years to sort it out!)
  11. Hi Welcome to CAG. First of all, NEVER speak to a DCA, they will lie to you, threaten you with all sorts of nonsense. What you must remember is that the DCA monkeys work on a commission basis. The more money they get from 'clients' the more they earn, and they will stoop to the lowest levels to try and get you to part with your money. So now just wait until you have something from them in writing. If they keep phoning you, send them this letter. http://www.consumeractiongroup.co.uk/forum/letter-templates/131250-dca-creditor-harassment-telephone.html If you do answer a call from them, don't give out your details ie DOB etc, just repeat, 'ONLY IN WRITING' and then hang up. Moorcroft are well known in these parts and if you search for them you will find many threads and how they can ge defeated! Good luck, get reading and start feeling stronger.   12. There are plans afoot regarding a certain Preston DCA. However not too much more can be said at the moment...........trolls are about!! Also on another note, HMRC are conducting various investigations into certain DCAs. Again as I am involved with this, not too much can be said, but rest assured, things are happening...............   13. I've recently had a meeting with Trading Standards and happened to mention NCO Europe to them. The reaction was quite spectacular to say the least!! 'Biggest bunch of idiots to ever walk the face of the Earth' was one of the many phrases uttered by the gent from TS. The Preston TS is inundated with complaints against them and they have said that they have no choice but to act on the complaints. So if you have had any trouble with NCO Europe, please, please contact Preston TS at the address below.   14. HSBC have 130 CCJs 103 in the last year. They have 106 unsatisfied CCJs totalling £275k.

  16. Got next threatogram from Moorcroft detailing just how much it will cost to go to court. At the bottom it states " we have confirmed with a major public utility company that you live at the above address" Hmmmm.......well considering this letter has been sent to my address but with my mates name on it, how can they confirm anything???? Silly, stupid people!!

  22. You can get a CCJ set aside after it has been issued. I am currently going down that road on behalf of a friend who is too ill to do it himself. If Amex added charges to your account the amount on the CCJ will be wrong. That in itself is grounds to apply to get the CCJ set aside.   24. Not retracting anything. If you have read enough of the threads on this site, you will know that RMA/NCO are pretty hopeless. If they got as far as getting a CCJ against you then you didn't do enough research. Anyway, there are various ways you can get a CCJ set aside. If you want to go down that route, let us know and we can try and help.
