  2. Hi, Filed my N1 form and subsequently received my A.Q this was handed into the court on 30-01-07, what happens next as I havent heard anything from either the court or Lloyds? Thanks Aaz
  3. Al, thanks for replying. The default date is March 05 and was down to my own doing, went through a period of financial difficulty and missed around 6 payments, I never received their default notice as I have gone back through all the correspondence. I just find hard to believe that they can quote a date, reference number and not be able to back this up with the corresponding paperwork. Thanks Aaz
  4. Hi All, Need some info on having a default removed. So far I have issued my SAR to Mint who sent back incomplete info, sent the LETTER BEFORE ACTION, Section 7 – Data Protection Act 1998 detailing information missing etc. Mint have now replied and enclosed the information requested, however they cannot supply me with a copy of the default notice as in their words 'These are computer generated and therefore original copies not retained'. They go on to say 'There is no legal requirement for us to provide you with a signed and dated copy of the notice but we can advise you' - with this they have given me the date and their internal reference for this notice, the reference appears to be a std letter template reference. Not sure what to do now? Are they legally bound to supply the dated and signed default notice? Thanks in advance Aaz

    Well thats the N1 served today, should hear back in the New Year. Interesting point the clerk made when I said 'I bet you're getting a few of these now'? 'Yes' he replied and 'Lloyds are starting to defend most cases now but cave in when the court dates are set'!! Thanks Aaron
  6. Hi all, Almost posted this in the Egg forum but its more of a general question really. I have an Egg card and an Egg loan. My loan has been passed/sold to Moorcroft, not sure which as I have never received a letter explaining that this is happening from Egg - should I have done? What I need help on is, a) I want to request the CCA on both of these accounts do I send it Egg and Moorcroft or just Egg as when I look online at my accounts the loan account is still there and reducing? b) Is there a template for requesting the above, been looking around the site for ages and I cannot find it, could I be pointed in the direction of where its hiding pls? c) Received my credit history from Experian and Egg have defaulted me on the loan account, I have never received this and do I request a copy of this letter with my request for the CCA or do it separately?     SAR - Missing Info

    Well chaps certainly got you 2 delving deep into the SAR, thanks for the info though. You've both confused me now - so I really dont know what course of action I should be taking to obtain this information, I do have to admit that I would expect to see all the information relating to the account/s mentioned in an SAR, please find their comments on the letter enclosed with my statements:- With reference to your request concerning any manual intervention to the admistrative charges debited, these charges have been process in accordance with the terms and conditions of our current agreement with you as a result of the activity on your account. In the event that you breach the T's & C's, we will take the appropiate action, contacting customers when appropiate, or handling customer enquiries regarding their account status. When a customer has raised a concern in relation to this process, the matter will be investigated and the decision will communicated to the customer and where appropiate noted on the account. Phew, got to be an easier of entering the contents of letters than typing them!!! With the above in mind I would have thought that any information noted on my account should be supplied in receipt of SAR, if so what do I do next, if not - what do I do next and if there are any templates (can you point me in right direction of there location) look forward to your replies thanks Aaz

  9. Thanks to you both for the info, Lloyds have until Friday so will wait and start down the N1 route on Monday, if nothing has been received. Is this where we start getting nervous taking on the 'big' boys!!!! Cheers Chaps

    SAR - Missing Info

    Hi, Received my statements from Mint after sending the S.A.R - (Subject Access Request) but an interesting point has crossed my mind and wondered whether anyone could help? In the S.A.R - (Subject Access Request) it makes a statement to send any manual intervention notes referring to the account in question, I have just found out that Mint have defaulted me for late payments but this isnt detailed within the statements received nor have I ever received a notice of default, there arent any notes regarding my negotiations with them to reduce my interest to zero for life of the balance on the credit card - should this information be supplied by my SAR letter?   13. Hi all, Sent out my LBA which runs out on Friday this week, do I call them to see whats going? I have read lots of posts but I really cant determine what I should be doing now or what the next plan of action is. Any help and advice would be most appreciated! Thanks
  14. Thanks orfoster for your quick reply - Credit Cards are Mint, Egg and Lloyds Mastercard. I will have a look the T's and C's but to be honest I wouldnt know where to find this information or what it would be under! I have also just found out that Mint and Egg, Egg for a loan, have both defaulted me for missing payments and these were done late last year, had no idea that this had happened until I received my Experian credit history. I understand that it was my fault for being late on payments but is there anyway of getting rid of the defaults? Egg have passed my outstanding account on to a company called Moorcroft Debit Recovery, I only missed 2 payments and this was due to my online D.Debit never being received by them, probably my fault for not checking my bank statements as well I expect but hadnt realised that this would incurr a default! Thanks again

Hi all, need some help, having claimed from 2 banks now, 1 won and the other still on going, I would like to move on to C.C's but i am concerned that if I attempt to have my charges refunded that these companies may start to demand that I settle the outstanding balances on the credit cards? Does anyone have any info on this happening, can they legally demand their monies back? thanks

  18. Afternoon All - thank crunchy its Friday, Sent of my letter asking for payment of charges but until today I havent received a response, today I did but it was a day late from my timescale. I have been out of the country for the last week and asked the missus to check my post, if nothing was received by the 30-11 to send my LBA on 01-12 (already had a written up as wanted to keep to the timescales I had set out). Now on my return I have received a letter from that explaining that they have a right to charge for their services and do not agree with the OFT, apparently in discussions with them regarding these issues, from reading the threads I think that this is pretty much a standard letter? Questions are, I am right to send out my LBA even if their response arrived a day late, what will happen next, do need to prepare anything as they have only 14 days to reply to this LBA? Thanks
  19. Thanks Androobe Do you mean, dont do anything until my 14 days is up, then send my rejection of settlement ? On their letter offering me £655 it states the offer will remain in place for 10 working days. Also, when i send my letter of rejection do i sign and return their offer of £655 slip and cross out the full and final settlement? Thanks again

After sending the prelim letter asking the charges to be refunded, i have now received their 'without prejudice' letter, which seems to be a std letter by the posts in the forums. they are offering £655.00 against my original claim, do i now send the rejection of settlement with an additional 14days notice or does it continue from the 14days as per the date of the initial prelim letter? thanks in advance

    Thanks for the info. Worked out my charges to be in excess of £2000 but how can you calculate the interest, understand that I will be liable for some interest on agreed o/d but how on earth can you work the interest out on the excess o/d due to charges, some of the interest payments can be anything from 30 -65 pounds a month? Appreciate any help!!

Hi, Applied for loan that runs alongside our current mortgage and was turned down due to having 2 default notices against me. 1 - was for an Egg loan that when changing banks and filling in the online D.D form, 2 payments were missed (from memory) and then the loan was passed to Moorcroft Debit recovery, never missed a payment with them. Didnt think that this would show on credit history as a default and Egg refused to take my account back. 2 - Mint, have given me a default even though I am paying a min agreed payment with them, I did struggle with the payments to start with and missed some but I havent missed a payment in 12mnths or so now. My question is, how do I go about removing the defaults so I can keep the wife happy and have the 'new' kitchen?? Appreciate your comments Thanks
