  6. Thanks Zoot. I got the idea from here & followed the guidelines for filling in the form, I used the hardship paragraph, then deviated a little to show how my case is different to the test case. Didn't put all the case stuff in because i didn't understand it. So I could take all that with me, as evidence, right? I've read on someone else's thread that they argued about not receiving the banks bundle or something, well I didn't either, so thought I could mention that at the hearing? Didn't think about using the details from the litigation section, thanks! Michael, thanks for that link, that's going to be useful for lots of other reasons too!!
  7. I ticked the box 'without a hearing' but I don't mind, i'm happy that i'm getting a chance to heard. How do I argue my case besides what I wrote on the form in the first place? What info do I need to take with me & is this the same as the hearing that was stayed? Could they make a decision on the whole case or is just to see if my case can continue? One worrying thing is that the letter says it could be heard by another judge in a different court. I really couldn't afford to travel too far away from home. Thanks in advance.
  8. Received a letter from the courts today. I was due in court next week. They've now ordered that the claim be stayed pending the ultimate determination of the proceedings of the test case. I've filled in a form n244.
  9. "basis for disputing and substituting as approrpriate an alternative suggested charge." how would I do this? What is the general opinion of a reasonable charge? thanks in advance.
  10. phew!! a typo for sure. the person I spoke to at the court was not impressed with the clerk's typing & proof reading skills. lol. I now have the correct dates. I've emailed Dino in the litigation team as well. Emailed him yesterday, don't really mind if he replies or not though. Unless he sorts something out for me before i start all the hard work of getting my bundle together. Is he still one of the best for replying?
  11. I have a problem with the 'notice of allocation to the small claims track (hearing). court date 16 august 2007 Received this today, dated 25th June 2007. However the instructions state - 1. the claimant shall by 4pm on the 21st june 2007 send to the court and to the defendant a schedule of the items claimed for indicating: date, amount, basis of charge, basis for disputing and substituting as approrpriate and alternative suggested charge. 2. the defendant shall by the 18th august 2007 send to the court and to the claimant a counter schedule as above and indicating the basis of charge and basis on which it is defended and setting out the cost to the defendant of supplying that service. 3. all other documents to be copied and exchanged and send to the court 14 days prior to hearing. THE PROBLEM - a) the deadline given for me to send a schedule of the items is dated before they sent the notice. b) the counter schedule is due after the court date Help please, i'm very confused
  12. An update for you - phoned the court today as this is when the AQ had to be returned. I wanted to see what stage my case was at. I was told that the bank hadn't returned their questionnaire yet & that they had until 4.00pm to do so. it was 12.30 when I phoned. So what do you think? What should I do now?

  14. thanks Tanzarreli, I've spent ages on here trying to find that info without success. Cheers Dar£n, It's great how everyone is so helpful to each other. This is a fantastic site. I've now sent my AQ to the courts & a copy to the contact address for the bank given on the defence notice. Should I send my bundle as soon as I have it organised or wait until it's asked for? What's the usual waiting time between sending the AQ & getting a court date? Oh & for those that settled out of court, did anyone get their default removed?
