I presume you filed your claim today, it will probably be deemed to be served on the 18th or 9th Jan, (you will be notified of acknowledgement) and then the defendant (NatWest) has 28 days to file defence. They almost certainly will. There is some tolerance to the 28 day rule. The process will now followed an established process, with some variables depending on the size of the claim.

  2. Just a quick addition, write a letter to Cobbetts first class saying you have banked the cheque at barclays into account xxxxxx, as the NatWest account is closed. Once the cheque has cleared you will be able to address the issue of discontinuance and the other matters referred to in the letter. Blah di blah

  3. You should have an analysis of the charges prepared prior to submitting a legal claim. You have compromised your claim. Go through all you statements and extract the charges, apply them to the schedule as set out in Vampiress Spreadsheets. Ensure they are accurate, you will have to then write to the court attaching your schedule, and send a copy to the lawyers who will defend the claim. However if your schedule differs from your claim significantly then you may have a problem and will have to restart the process. My advice is to read the FAQs and the step by step procedures, and follow some of the threads on this site, it seems you may 'shot your bolt', however the situation is recoverable.

  4. An interesting saga, however the bank, as you have learned are not really interested in the details. First step is to take you time and prepare an accurate analysis of your charges, then calulcate the interest. You will have to be patient and wait until you have all your statements, the process cannot be rushed.

  5. Thank them for the offer and you can accept as a partial settlement, but you will be continuing with you claim for full settlement etc etc. Swift polite reply ensures your claim does not get stuffed to the bottom of the pile.

  6. Well I have successfully tackled the Cobbetts/Natwest combination and a few of the other financial monoliths, and now I am almost ready for the Lloyds TSB showdown. I will monitor this forum, and offer help where I can, I guess I can expect the same kind of tactics from Lloyds. I am giving myself a target of 10 weeks from the prelim letter.

  7. You are playing the waiting game now. It is likely they will file a defence around 28 days from the date of deemed service. You have made the crucial step of a legal claim against a major financial instituation and it will now proceed to settlement. Well done it is a big deal and you will recover your charges and interest in due course.

  8. I believe it pays to remain anonymous, and it is a more relaxing way to conduct your claim.

  9. Do not delay by even a day, you are dictating the pace now so crack on. You are about to begin the legal process, and it is a significant step to file a claim against a multi national financial coporation. Therefore make sure you have correctly prepared your schedule and calculated your charges and interest. The more professional you are the more certain you can be of the correct outcome.

  10. OK I would just like to confirm that this case is offically over, having received a full refund of bank charges and interest and costs claimed.

    I would like to thank all who offered advice, the moderators, and the site itself which is quite outstanding.

    I will continue to offer any advice or help based on my own experience as a sole trader reclaiming charges, and I will suport this site practically and financially.
