  1. In English? In English,from a Scotsman, Start by sending a SAR then read,read,read and everyone will know what you might mean. I have interent banking too and I didn't not get my statements from anyone apart from the bank like. He can send a 40 day letter but can he send one to me because I've never not not seen a 40 day letter. If you mean a SAR - OK If you mean a Prelim - OK If you are ready to go to court - OK AGAIN!!!   3. Can I suggest you write my letters? I think you've got it all covered. I'll watch with interest to see what the reply is. Only thing I can see is that you've asked for £95.50 of charges to be refunded but haven't mentioned any interest. Not the s69 - 8% but any interest added on to the debt because of charges! I used Admin of Justice 1970 against my builders who were sending round heavies for payment for a half assed job. I certainly wouldn't like to be accused under it as it covers any action likely to cause alarm, distress or humiliation. That could be anything!! good luck A D
  4. Hi, Have you thought about using MCOL (Money claim online)? If your claim is under £5k it's really quite easy and the system sort of does it all for you. You can have a bit of a play with it before you actually commit to anything (you have to pay before it becomes live - so exit before that bit). There are hundreds of us on here who have used it so there will be plenty advice too. Of course the way you are going is fine too. I just liked MCOL. Here's a link MCOL A D
  5. Remember the amount that you will have spent on postage and possibly phone calls, claim that back. There's also a box when you file for 'solicitors costs' (max £80 I think). You might not have used a solicitor but your time costs money too and with solicitors costing £150/hr+ they're getting off lightly! Make them pay! A D
  6. Phonesurgeon, You say above that you are chasing Halifax first then BOS. A friend of mine was doing a similar thing £4k Halifax £300 BOS but lumped them all together on the prelim and only sent letters to Halifax, he filed on MCOL and got a full payout last week! Maybe another option! A D

In sorting out the masses of paperwork, statements, letters etc that accumulate whilst doing this I noticed that there were charges in 99/00 that I didn't claim for on my first go because I was still a virgin and scared! In total it's £275 before interest. So nothing ventured nothing gained prelim and schedule will be winging their way south this afternoon! A D
  10. When I made my first SAR for my current account I had to chase them by phone on day 39. Chancing my luck I then asked for CC and mortgage statements as a gesture of good faith!!!! The mortgage statements turned into a nightmare which is in my current thread. So I didn't pay for them but I would think if you were starting from scratch it would be reasonable to assume you would have to pay the tenner. Of course if it goes to court you get it back. If you feel up to it you could always chance it like I did, look through my threads for contact names and numbers. The guy who eventually paid up was Iain Blackwood on 01383 426865. don't mention my name he'll probably hang up!   11. They just refunded me every charge they ever made on my mortgage. Set up fees, payment fees, deed despatch - the lot. I just argued and argued until they got sick of me! A D
  12. If you are going to accept the list of charges your next step is to send the Prelim. Prelim letter Also complete your schedule of charges and print that out without the interest showing and attach it to your prelim. Spreadsheets We then worry about the next bit in 16 days or so, it's essentially the same just a different wording in the letter. All of these are in the library. I suggest you have a good read through the steps and FAQs. A D

  15. In a nutshell - I don't know! But! And there's always a but! In my (last job used to deal with it) opinion. a request under the DPA is for EVERYTHING held under electronic, magnetic, data storage etc. This has been corrupted by us asking for just six years of statements etc. And usually suffices. You have pieces of a jigsaw there which only you can piece together. So, if it all comes together after the fourteenth time of looking, great. If not re-evaluate. The charges that you are 100% on, my advice - continue in the way we all do/did. The ones that you're not sure of, send a letter asking for clarification! A simple - Dear Sir, re xxx what do you mean about xxxx? Yours x Only when you can seperate everything and are happy can you really start to threaten court action etc. Take your time. I mean no offence but would strongly advise that you do one at a time. The strongest case first, then, as you grow more confident and knowledgeable proceed further. Hope I've helped, let me know. A D

  18. I found MCOL to be a piece of p Heres a link, you can go in and play at claiming money off your friend then delete it. If you don't like doing it that way download a form N1 from the library and follow the many instructions available. A D MCOL website

  20. I had a similar thing in a phone call with them yesterday. The ombudsman says we have 8 weeks to investigate etc etc etc... I said "That's nice, now about the claim that I submitted? I gave you two weeks". We're not complaining we're claiming, on our timescale and on our terms and conditions! Power to us!!! A D
  21. Well, well. Lot's been happening. Been with Aaron over Easter holidays - somethings are more important than bank charges! On my mortgage account I decided to settle for the £277 they finally offered. This is almost a hundred more than before. I wanted more but thought I might be on a sticky wicket if it were to go further. It's all money though. The last post I made on the 23/3 said they should be back to me in a couple of days re my credit card. When I rang yesterday they said that the 'complaint' was logged on 13/4! Considering my prelim was received on 24/2 they're not doing well are they? Full of bon homie after the holidays I agreed to give them until Tuesday then I'll file on MCOL if I don't get the whole £300 back. They don't scare me - and don't let them scare you either! Even better news was the claim I've been doing for a friend. After they filed a defence we were a bit down but lo and behold he got a letter today offering £3800 ish which is only about £150 short of the claim. He's bitten their hand off and I don't blame him. We both sent our SARs on the same day 1/9/06!!!! I was paid on 30/11! No wonder he's losing his hair! So here I am folks. If I can help just shout. A D

  23. That's what I was thinking. So is it until close of play on Tue before I can press the judgement button on MCOL? I've been through the MCOL website with a fine tooth comb and I can't find any allowance for bank holidays etc. It seems to be a simple arithmetical equation, ie issued + 14, acknowledged +14 = judgement. I would always like to appear in the eyes of the court, a reasonable man, but I also don't want to give these b£$ta%ds an inch if I can help it! A D

  25. In my latest claim for my friend the 14 days since acknowledgement runs out on Monday. Seeing as yesterday and Monday were/are bank holidays in Englandshire, can they submit a defense online? Or, has he as good as won but has to wait until Monday to file for judgement on MCOL because it is calendar driven? Haven't been this far before, would appreciate any help. A D
