  5. Hi no response from capital one or any defence filed. Have requested judgement from the court as no defence filed by capital one. Hope this is correct action. What is likely to happen next?

  9. Hi has anybody tried to claim back charges imposed by this company and are they bound by the same agreements? Any advice welcome
  10. Just received a standard letter back from capital one informing me that all fees have been added correctly and as promised in my agreement and will not be refunded. Expected reply. Will post full letter if required. Should i send another letter infoming them that i will be going to court to recover fees. etc. Any guidance appreciated or just go straight for a claim? I would draw your attention to the terms of the contract which you agreed to at the time that I opened my account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law. I am frankly shocked that you have operated my account in this way as I had always reposed confidence in your integrity and expertise as my fiduciary. I calculate that you have taken £571 in fees plus interest for the sums which you have taken since my account was opened in 2001. I require repayment in full of this money. If you do not comply fully within 14 days, I shall begin a claim against you for the full amount plus interest plus my costs and without further notice. Yours faithfully,
