  1. Sorry about this, But since my court judgement (which I won) the DVLA has been factoring out SORN fines to a company called Capita - the same company that the TV licencing use. 1 of the directors has a distinctly scary past, I don't have any details on the other directors.
  2. Hi All, I read the DVLA thread to see how people are coping with SORN again as they tried it on with me again over another car. I did test the argument in court and won - the claim was dismissed. This was in county court though - I am quite happy to see them in magistrates court. They seem to be going down the DCA route (intimidation etc.) and taking some people to magistrates court from reading everyones posts. My argument worked in my situation, but not all situations are the same - so always seek additional advice from other people (CAB, or a free legal consultation elsewhere). To my amazement when talking to CAB, about a seperate issue - then asking about SORN (just out of interest) they gave me my own legal argument My latest SORN fun just took 1 call and DVLA have since dropped it, wish they had taken it further I can't give full details about the car and reasons behind SORN as I have agreed to sign a non-disclosure agreement about the sum I will recieve (not from DVLA, but from car finance company). So I have had two SORN fines overturned, one in court and one by a phone call. The second one I hope got overturned because they had recieved all necessary paperwork and are sorting out their systems, so that things do not go 'missing in the post' and not because of any other reason. I'll be around on CAG quite a bit now as I am taking 4 credit institutions to court, so if anyone needs any advice, or support PM me. Dani
  3. They have sent me a statement of account - with lots of (what could be deemed) unfair charges, and also an option fee charged, when it explicitly states in the contract that the option fee may be paid at the end of the contract. The insurance amounts don't tally either. Speaking to the Corporate affairs chap again tomorrow, I'll post more when I get a chance tomorrow - btw your help is always apreciated Steven4064. The fun continues
  4. hopefully all will be resolved on wednesday
  5. Quick update, my protest is on hold till tuesday as I have to await the Director of Corporate Affairs cattles reply on monday. I must admit the dialogue I have had with him so far has been very positive - my view of welcome may be changing. Anyway if his reply is positive, there will be no protest - if negative I am 'manning the harpoons' so to speak. Looks like things may be moving along - had another positive chat with them today - will have more news on Wednesday
  6. Sorry, I completely forgot I agreed with the police that protests start at 10am and end at 5pm maximum. Danny
  7. Hi Everyone, I have dealt with welcome finance for quite some time, I have even reported them to the information commissioners office for their potential breaches of the data protection act. Last week, I got a bit fed up of their practices and dealing with them, so I arranged with Nottingham Police to protest outside their head office, from may 19th onwards. The Police are absolutely fine with that and have given me an incident number and a point of contact with the police. They do have a few rules though: The protest should be peaceful The protest should not hinder anyone walking down the pavement, or any vehicles entering Welcome Finances premises. Any Placards or leaflets should not contain any copyrighted trademarks/information So if anyone wishes to join me, they are welcome(sic) but if numbers go beyond 10 people I do have to inform the police again, but they are cool about it. The first protest is 19th May at: Welcome Finance Ruddington Fields Business Park, Mere Way, Ruddington Nottingham, NG11 6NZ Danny
  8. Thanks for thoughts so far - yes I am going after the big guns, the most litigious company in the world. It is not a wind up either, I am deadly serious. I do not like being labelled as a terrorist and my clients like it even less. You may think I have balls of steel, but I am scared - they will make it rain lawyers on me, I just have to ignore them. Help is appreciated
  9. OK I was named in a court case in US as a terrorist, so I have started a civil case off here for 5K against the church for defamation of character and libel. (edit) Has anyone ot any hints or help? The claim is in and I am currently being followed, which is highly irritating. Dani
  10. Hi postggj, Do you have a link to it as I can't find the thread - hope it wasn't lost over the weekend.
  11. Quick note The intimidation tactic, as above is wrong as only a court can take action on the car and I had paid over their reposession amount in agreement #1 Thanks for your help again
  12. This is the loan the person at welcome forced me into, to cover the original loan and add some extra on - the figures seem a bit odd, bit unreadable too and also it states about interest charged on acceptance fee again. Sorry its in 2 parts - its a weird sized document.
  13. Two of Lots of letters from Welcome, only one with an actual handwritten threat on it, which wasn't enforceable anyway Blacked out any personal details and their agent's signature. BTW I have only 3 of the hand delivered 'while you weren't in, we charged you £25.00' ones, but lots of the charge £10.00 for calling me, even though nobody answered you ones, image below first.
  14. Yes they are so cheeky, I wonder if it is the cheesey band, rather than a cc company I have a card with I also have a gesture for them in return, bet you can guess what it is
  15. Hi postggj, Yes I was following your thread before and well done again. I have purposely blacked out any details rather than white, I have removed so that it shows up better. The dealer approved car finance just gave me the copies, which had been faxed through to them - welcomes was not signed in my presence as it was a presigned copy - I just signed the photocopies. I really hope mr Orill is watching as the fact I am now going after 3, instead of 2 should brighten up his day My last personal loan was taken to cover the outstanding on the original under pressure from someone at welcome finance as I was going to have to pay late - will be scanning that in shortly, oh and some more suprises to follow. Thanks for the support Danny
  16. Hi - Here is the original (my copy) of my 1st personal loan, which I havent even brought up to welcome yet (this should be a nice suprise for you mr orril) which was done via post, please note the following: No Signature by Welcome on mine or their copy I returned to them. note point d) You signed this agreement at our business premises (not true), on their copy it just said sign and return. Note the statement again - Interest will be calculated on the rate of interest on the daily balance outstanding on the Total amount of credit and the Acceptance Fee This did have T & C's on the back btw. I haven't checked their calculations on this one at all.
  17. And finally - rest of page 2 - there is no dealer name or address, and there should have been as it came from a different company to welcome entirely:
  18. Heres page 1 of car finance, with top bit of page 2 on it - there was no terms and conditions on the back of any pages and their signature was just a photocopy, I have had to blank out details and sigs:
  19. Heres the actual letter - got my scanner working as it was playing up - enjoy:lol:
  20. thanks bathgatebuyer, I've shown it to quite a lot of people and they thought it was hilarious. Is this some sort of office joke at Aqua?
  21. Hi Steven, Yes it was the difference between the amount charged for overlimit fees and the OFT 'Ordered' amount of £12, as only one of the overlimit fees was for £20. The rest were for £12. Danny
  22. Should I do that too? I have my official FOS complaint form to fill in Threats, Intimidation and flagrant breaches of the law seem to be Unwelcomes style
  23. Hi All, I sent off an initial letter to Aqua reclaiming £116 + interest. They sent me a reply saying they are looking into it, today I got a letter which has this in, are they taking the mickey? 'I am delighted to offer you a payment of £8.00' I couldn't stop laughing 'delighted' - LBA going off to aqua I wonder if I should put 'I am delighted to be taking you to court' Danny
