  1. Hi Madhoose, Good luck for tomorrow we are all routing for you. Have you checked your c.c. balance yet so see if lloyds have paid any money onto your card. This happened with me with bos after I had won my case by default. What you will find with your c.c. is that if you have an outstanding balance on your c.c. they will just pay the money onto your card. I do not think that the bank will appear in court so check your balance in the morning. Hope to hear from you tomorrow, and good luck. Eileen
  2. Hi Pauline, Just phone them and tell them that you have won your case and you have a decree against them. They might want to see the decree, so if they do wait until you have received it from the court (it usually takes about 2 weeks to come from the court), if this is what they want send them a fax of it, you can do this at your local library, and inform them that you want your money, preferably within the next 2 - 3 days if not you will send in the sheriff officers. I have found that by the time that you have got to this stage they will pay up. If you have any problem with them inform them that you will go to the sheriff officers and that the cost will be met by the bank. The price for a sheriff officer to do this is about £180.00 Good luck any problems just ask. Eileen
  3. Hi Brucie, Glad to hear that you got your money. What I couldn't understand is why lloyds put in a defence when they had already paid out some money. What kind of defence could they have had. I am so pleased that you received all your money, but you do not need to go to court because lloyds definately won't be there. CONGRATULATIONS anyway on winning against them. Eileen
  4. Hi Brucie, I don't know any answers to your questions but how can the bank put in a defence if they have already paid you the money. When I messed up my sons claim i.e. not going down to the court after the return date, but going down after the calling date and finding out if the bank had put in a defence I was told that his claim had been dismissed. When I was talking to the clerks and I explained that he had already received his money, but not all of it they said that we could do something else (sorry can't remember what). What I think you should do is phone the court and ask they're advise, they are very helpfull at Glasgow Sheriff Court the number to phone is 0141 429 8888 Hope this helps a little. Eileen

Hi Maryhillgull, I also had an account in Byres Road, had it for years and one day I went into pay my abbey card and I was asking the girl if I could also pay any other bills and when she was answering me the girl beside her butted in and started to reply to my questions, but she was already serving someone else at the time. My face must have been a picture, because the girl who was serving me looked at me and then her and then aplologised for her interuptions. She really did try to make me look stupid, as if I did not understand what my girl was saying. I went absolutley balistic, so I just shut my account there and then. I really think that the people in that branch think that they are so superior to anyone else that they cannot see out thery're own behinds. Twits. Eileen.
  6. Hi Tracey, You now take the papers back to the court, but remember to take a note of the calling date and the return date and also the number of the claim. I forgot to do this for my son and when I phoned the court to ask if the bank had made a claim I didn't know the number of the claim. You will find it on the top right hand corner, it usually starts with SC and then some numbers. Don't forget to phone the court the day after your return date and find out if the bank has put in a defence, if they have not go down to the court, preferably that same day and you then have to write something on your papers. I am sorry but I always forget what you have to write, but the clerks will help you. Don't do what I did with my sons, I thought I was to go to the court after the calling date and when I did go down to the court 2 days after the calling date, his case had been dismissed. Luckily he had received his money from the bank by then so he did not lose out. Hope this helps. Eileen
  7. Hi Roxie, What part of the claim are you at. Have you actually filed a claim at court and if so what kind i.e. small claims or summary clause. The reason that I am asking is that both of them get treated in a slightly different way. If you do a small claims i.e. £750 and under you do not need a sheriff officer. If you do a summary clause i.e. anything under £1,500 you will need a sheriff officer. What happens is that you file your small claim and you pay your £39.00 and the court does everything for you. No sheriff officers. If you go down the summary clause claim what happens is that you go to court, pay your £39.00 and the court takes your papers. The court then sends them back to you with the return date and calling date and this is the dates for your claim at court, you then take them to the sheriff officer and he then sends them to the bank. You still keep one copy and then you go back to court with the remainder. The sheriff officer will keep you right after all this is what he does everyday. I am on first name terms with the sherrif officers that I use. You can find any sheriff officers in the phone book, but what I did was to get one near the court so if I was at court there was no hassle to go to the sheriff officers.   8. Hi Chocolatte, I think what has happened here is that after the return day you did not go down to your court and sign the papers. I was doing a claim for my son and I thought that I went to the court after the calling day and when I did go down I was informed that the sheriff had dismissed the case. Today I have received my son's court papers and on the back it says the same as your one. Did you go to the court? Luckily my son got his money before the court date so he did not loose anything except the sheriff officers fee (which I paid for anyway). When I did go to the court I was told that we could do something else, sorry forgot what they said, but you could ring them and ask. Hope this helps a little. Eileen
  9. Hi Roxie, I peronally have done 3 summary clauses, 1 small claim for myself, 1 summary clause for my son, and 1 summary clause for my other son and I am now going down the FOS route. All of my claims have gone through Glasgow Sheriff Court and they went without any bother. If you need any help this is the best site to get information, so just ask. Good Luck. Eileen

Hi Lol, I am also going down the FOS route with the BOS and I received a reply from the FOS stating that because the bank did not tell me to go to the FOS within the six months period, all that the FOS have done is to send all my papers to the bank and ask them to look again at my claim. The bank has 8 weeks to reply to me and if again they say no, then the FOS will intervene. ( I think) It seems that everyone is getting different answers from the FOS depending on their correspondance from they're bank. My bank said that they where declining my claim, so what I cannot understand, is that as far as I was concerned the bank was giving me a final NO. Hopefully the bank will come back with an offer and it will all be finished with. Stick to your guns and hopefully you will have a result soon. Lol Eileen:)

  12. Hi Frostdog, if you have given them all this time why do you not just go down the court route. I have found that if I had waited the 8 weeks for the bank to respond and they then said no I had wasted the 8 weeks. If you go down the court route it usually only takes a little longer and you haven't wasted all that time. Also why don't you do a summary clause because you are still under the £1,500 ceiling. Your total is £1,190.00. You put on your form this amount, plus interest, plus costs so you get everything back. Eileen
  13. Hi bonnie, this is just the normal procedure from the banks. They hope that if they send out these letters people will not know what to do next. Send out the lba letter in the templates and give them 14 days to reply, when they say no (which they will) you then go down the court route. Don't worry it is not as bad as it sounds, I have personally done 7 court papers and if you need any help this is a great site because we have all done it before and we are here to help. Ask any questions even if you think they are stupid. I can guarntee someone, somewhere has already asked them. As you are in Scotland maybe you should post on the Scotland site. I am from Glasgow so I know something about the Scottish Proceedure. Eileen
  14. Hi Jaybees, Me again:) just to let you all know that my son has received a letter from the bank with an offer of the rest of the money he was claiming. Just goes to show if you stand your ground you will get what is owed to you. The amount is slightly less than he was entitled to so I will just give them a wee phone on Monday and ask for the rest. After all the court will award all the amount, just not what the bank wants to pay. The bank does not want to give him all the interest and no sheriff officers fee but I am sure that I will get that back for him. So remember phone or write to the court and tell them you are continuing with your claim, and hopefully you will soon be writing here that you have won. lol Eileen:)
  15. Hi Liasmum, definately go ahead with your LBA because you have to tell the bank how much exactly you are claiming. When the bank writes back with a no answer you can then go down either the court of fos route depending on what your balance is. I have had to go down the fos route because of the size of the claim, but because the bank said no I included in my complaint my spreadsheet, my no letter from the bank and also the letter that I received from the IOC concerning the non arrival of my statements. All of these are good letters to back up your claim. Eileen
  16. Hi me again, just read Lindar post and lloyds put some money into her? account and then faxed the court that the claim was settled. Lloyds did not put in the full amount, so do what I said and even phone the court to find out what the bank is up to. Just in case they do the same to you d**** underhanded ****** Eileen
  17. Hi Jaybabes, make sure that you send a letter to the court informing them that the bank has only paid out part of your claim and that you want the claim to continue. BOS has done this to my son and they put the money into his account as full and final settlement. I posted a letter straight away to them demanding that they DO NOT put the money into his account. When the money went in I informed the court of this just incase they write to the court telling them that the claim is finished. My sons return date was 16th May and calling date is 23rd May, so far the bank has not put in a defence so he has won by default. When you inform the court the bank cannot then turn round and say that you have accepted the money. p.s. also inform the bank that you are still waiting to see them in court for the rest of your money. It is always best to cover your back with these banks. Eileen
  18. Hi Liasmum, Why don't you write to the ICO and complain about non compliance. I had to do this for my son. I also told the bank that I was doing this and before you know we had 2 lots of statements. My son's claim is over £3,000 so we are having to go down the FOS route and it was good to be able to put in the non compliance letter with our claim. Every little bit helps. Eileen

  20. hi rory sounds as if I was lucky, but in the end the bank still did not want to give me my money, I had to stay in the bank until 5.15 on a Friday night to get my money. But I am a tenacious little person and I got it. eileen
  21. Hi Tracey, sorry to but in here, but is your 2nd claim for a different account or the same account that you have already filed a claim for. I claimed against lloyds at the same time for 2 different acconts and that was fine because they where different. What I understand is that you cannot claim for the same account more than once at any given time, but if it is a different account (at the same bank) you can. That is what I did and both claims where filed at the same time and won at the same time. Eileen
  22. hI lush I would write to lloyds and tell them that you are not accepting this final settlement. When they put this money into your account (which they will do) do not spend it. What I would then do is go to court for the remaining amount. You said that you claim was for £1,700, what I would do is raise a summary clause for the outstanding amount i.e. £950. plus interest, plus costs and go the court route. Keep a copy of all your letters to lloyds and also inform the court what is happening with the claim. I personally think that lloyds have shot themselves in the foot here, because they have paid you £750. it leaves your balance under the £1,500 summary clause and leaves the way clear for you to do this. This is only my opinion but I think I would do this Eileen

Hi Honory I have just read your post for the first time and I am not surprised at lloyds, I received £2,700 back from their solicitors SCM on a Friday afternoon and when I went into the bank to get my money they did not want to give me it. My account was in collections for £500(all charges) and because collections finish at 3.30pm on a Friday I was told to come back on Monday. No way. I had 2 decrees against them and I informed them that I was not leaving the bank until I had my money. Thank goodness I stood my ground. I eventually got out the bank at 5.15 with my money and I haven't been back since. Your post is a great reminder to all of us that the bank's are unscrupulous and totally immoral. Eileen
