  1. Hi Everyone, Right, requested my signed agreement under the CCA - their time has now passed, which means they have committed a criminal offence. I have sent the letter stating payments will cease etc etc. Now, no doubt they will drag this out and pass it to a DCA etc before going to court. I want it sorted and out of the way sooner rather than later so that i can move on and start re-building my life. I have never gotten to this stage and really need as much help as poss with what to do regarding court, what to prepare, what the correct/incorrect things to say are. Im REALLY REALLY nervous as i've never done something like this before. Is there a thread or some guidance stuff on the site to help me - or is anyone willing to help me a little?! I've sifted through the site quite a bit and cant find all that much that helps me after this stage. Thank you so much in advance to anyone who helps. Nathe :?

I would of thought they can go ahead and cancel your contract and apply the necessary charge including your outstanding billing amount - i would call and TELL them whats happening, dont accept them saying "Oh but we cant" O2 tried a similar thing with me - i just told them, im cancelling my contract (sent an email so there was written proof) here's my 30 days notice, forward the required amount and i'll pay it!

Hi, I recently got details of all 3 credit reports from the CRA's - i have a bit of a weird question, there is a loan which i am awaiting a copy of the agreement for under the CCA (final date for it is 12/12/2006) The thing is - it doesnt show on any of my credit reports at all?! What does this mean??? Does this mean it doesnt exist etc - does it mean if they can produce the agreement that when it goes to court they dont have a leg to stand on??! A little confused so any help is welcome! Nathe

  8. Yep, i have and it is absolutely appalling - i even got a snooty letter! Just report and follow all advice here with regards to reporting them, maybe send them one more letter with say 7 days to furnish you with the details - i did that and magically they all appeared within a couple of days special delivery! Laiste, Firstly - thanks for your input as its clarified a few things for me, like you also said this is a really interesting thread and i have been reading with much enthusiasm as i myself am in a bit of a pickle with a bank who are not producing a signed agreement. Their (BoS) time is up on the 12 of december so at that point im going to send the following letter : Can you advise if this is sufficient?! If any amendments need made could you let me know.   13. As far as i am aware it cannot be used as evidence unless you have advised them that the call is being recorded. Its the same reason most stores/banks etc have a recorded message stating "This call may be recorded" I might be wrong though so i wouldnt quote me Nathe
  14. It's a Consumer Credit Act request - its applicable to lending under 25K, i used the act to request a true copy of the agreement for a personal loan
  15. It really annoys me that companies can make people feel guilty to come in and rectify their errors, in this case the Job Centre.... I am of the opinion that your health is far more important than anything else but i understand it may have been necessary for you to attend the job centre. Anyway - the best way for the court not to take your gym membership away is to go down the health route and by that you would need something from the doc - make an emergency appointment and explain briefly the circumstances and they should be able to accomodate! As i previously said - they cannot take something away from you if it is beneficial to your health - the last thing they want is someone to commit suicide etc, explain this to your doc, also once you go to court explain it to your solicitor and hand over any letter from your GP, its your solicitors job to advise the judge of your circumstances etc. I would HIGHLY recommend NOT calling the judge every name under the sun as he will most likely hold you in contempt of court, but i doubt it would get to the stage where he/she will order you to stop going to the gym. Especially not with the reasoning you have provided - like i said, get something from your doctor!! Hope this helps. Nathe
  17. I believe they can tell you to cancel some things deemed not necessary however - excercise is apparently fantastic at combating depression therefore if you get a note from your doctor etc they may let you keep this under health reasons. Its worth a try! Hope i've helped a little. Nathe
  18. I agree completely with regards to getting the run around and then just heading straight to the top!! On two occasions i tried to sort out a complaint with my broadband with Orange and also a mobile contract problem with them - got the run around from their customer service centre therefore just went straight to the CEO and got it all sorted within a matter of days!! Going to the top works, lol Nathe
  19. Just received a letter from the bank stating i didnt enclose the £10 fee under the data protection act?! I enclosed a cheque for £1 as my request was under the Consumer credit act - this is right isnt it? Any suggestions on what to do?!

  21. I would advise her to get the doctor to write a letter stating there unwillingness to show sympathy is not helping and could lead to her being off for a longer period - it appears to me that they are trying to bully her into coming back with scare tactics! Nathe

  23. Hey Everyone, Sent a CCA request to BoS - their full one month plus 12 days is up on the 12/12/2006. So far i have received absolutley no correpondance and i have sent the original letter and a reminder, about to send a third letter formally reminding them. Any ideas what bits i can put in it to enforce the point so that they pull their fingers out, also if the time constraint passes and they still havent sent a copy of the signed agreement, whats the best course of action?! And once it gets to that stage and proceeds to court, where they still cant produce the signed documents, if i tell my solicitor to advise the judge that i'll pay say a lump sum of £2K so long as the remaining say 20K debt is written off without adverse affect to my credit rating - will the judge consider this and accept?! Its just to see what details have been written down regarding me - i actually had a friend who got this info and on there was a note saying "This customer is a nuisance and constantly complains" He took them to court, however the bank made an offer of compensation and settled outwith court!
