  2. Hi A friend is in a bit of a predicament and I wondered if anyone could advise. 'Mildred' was on a fixed term contract for 1 year that expired, she continued to work after the expiration date but now wishes to leave as she's been offered a great job somewhere else. The company are maintaining she work the 3 month notice period stipulated in the expired fixed term contract instead of the 1 month she has offered to work. Are they within their rights to force her to work this notice period? She will lose the new job if she does not start 1 month from now. Thanks Frank
  3. Thanks very much for the links - fear certainly focuses the mind. My hearing is a 'directions' hearing and not the final hearing I feared. So I will provide the 'Draft Order for direction' & Witness Statement, but I sent the Allocation Questionnaire 6 months ago, am I meant to re-submit it? with the suggested "other information" as set out on this link. http://www.consumeractiongroup.co.uk/forum/general/53570-new-strategy-allocation-questionnaires-11.html Or are the other documents sufficient. I suspect the Judge must already have my AQ. Any advice much appreciated.
  4. Hi I have a court date for this Friday. I asked to settle out of court today and have been told that they will be sending a barrister to defend. I do not want to appear in court as I feel far too nervous. I need to send a written defence to the court today can anyone send me a link to something appropriate. To be honest I didn't think it would go this far and now it has I am very nervous and unprepared. Thanks, Frank

  6. Hi Can anyone help I have a couple of questions. I've just received my AQ along with Barclay's defence. In their defence Barclays states it denies that it is liable etc and goes on to say "the charges asserted by the Claimant have been applied to to the account prior to 14 Nov 2000.....exhaustion of time in bringing contractual claims form the date of accrual, pursuant to the Limitation Act 1980" At the time when I submitted my claim these were within the limits, do I need to explain this to Barclays and to the Courts at this stage or should I just ignore it? In the last couple of months I've been charged around £100 in overdraft fees should I update my schedule removing the old dates and putting in the new charges? Many thanks, Frank
  7. Hello, Can anyone advise.. I have sent my prelim letter with a schedule of charges and recieved the standard letter - sorry you're unhappy here's a leaflet -etc etc. and 14 days have passed. I was about to send my LBA with a copy of my original schedule but in the last 14 days I've been charged £60 in charges for going over my overdraft limit again can I tack these on to my schedule?   8. Thanks for the speedy reply. I've now finished totalling my charges, Barclays owes me £795. I'm not entirely sure the interest on this amount would be significant but I'm going to try out the spreadsheet and may go ahead without requesting the interest on top. Thanks again for the link. Hi I received 6 years worth of statements from Barclays today but I think I must be a bit of a div as I've spent the last 3 hours trying to work out which spreadsheet to use for my schedule of charges. I realise at this stage I cannot charge for the 8% but I can't work out which spreadsheet I'm meant to use... sorry can anybody tell me which spreadsheet I should use?the name or link would be much appreciated. I've been looking at the Excel sheets held on this site and also those on the vampiress's google site. Many thanks, Frank

Hi I've decided to try to get my money back from Barclays after my plumber told me about this site he also mentioned that if I was successful it would help to pay for the new boiler I was going to need! I've got a lot of reading to do but look forward to getting my money back. Thanks for the great site Frank
