  1. If the judgement was served in default you have the opportunity to request it is set aside on the basis that you did not receive the paperwork. I will take a look at this and post a link if I find it.
  2. Ok I have checked and rechecked the paperwork. £1410 - I shall be claiming from the day I requested the statements. Paperwork off tomorrow!
  3. With any luck this one will be real cash rather than a refund to my account as per my mortgage one!
  4. The statements and details of manual intervention arrived by special delivery! £449.00 please - If it makes it as far as court then we are looking at £644.12
  5. Now several calls down the line and no response from C1. 40 days expire on 08/11/06.
  6. Any of the mods able to change this for me to show success!
  7. Offer received - Full Amount As A Gesture Of Goodwill! (To be paid directly back to my mortgage account).
  8. Congratulations! I hope mine will go that way very shortly!
  9. So I sent the email and sent a few reminders. I believe I should have the letters this week. We don't want those 40 days to pass by - I shall be most unhappy!
  10. LBA Sent - How do you like them apples?!?!?
  11. The spreadsheet adds the 8% from the day the charge was made on the account. It is only applicable if you file a claim with the court.....
  12. If a warrant is issued then you can instruct the court baliffs to go retrieve! I am sure it will get paid pretty pronto when they turn up @ the branch!
  13. I would claim from Halifax, they are the same company. The complaints letter that I received had a Haliax sorry you're not happy leaflet in it. Trinity Road Halifax West Yorkshire HX1 2RG Company # 2367076
  14. Neither format bounce! I sent with a . and with a _ they both go through. A mis-spelling of the name bounces as does test.message so I can see that they do have external email, she just didn't want me to have it! I do hate it when they lie.....
  15. I'd just wait until you got back.....
  16. So in order to establish if the email address I sent to was correct or not I sent a quick test message to a random name. ([email protected]) Suprisingly, this one bounced. I can only assume from that the email I sent was received as it did not bounce. This does please me as I was specifically advised 'We don't have external email addresses.' Can anyone have a quick look over my other 2 Q's: 1 - Claiming on a mortgage account. 2 - Sending a LBA following their immediate negative response.
  17. I thought Blair, Oliver & Scott were Bank Of Scotlands people. They are both BOS
  18. Cool cool Just reviewed my psts, there are no personal attacks in my posts so i'm happy with that. I have no objections to them reading what I write!
  19. Does anyone have any thoughts about filing the LBA immediately following their response to this matter? The Prelim letter gives the opportunity to resolve the matter, their response indicates that they are unwilling to do so.....
  20. A quick telephone call to Melita Mason reveals that BOS are readers of the site! 'We received your letter that you got from the website!' I am awaiting an appropriate response as they have not broken down their charges to show they are proportionate. There are apparently no external email addresses for anyone in the bank! The email I sent in the [email protected] format has not bounced!
  21. Response back from BOS the day ater receiving mine! 'Thank you for your letter of the 9 October 2006 received by the Bank on the 10 October 2006. I write to advise that the charges to which you reere are legally applicable, covering actual losses sustained byt he Bank in administrative costs and interest. In this respect the Bankdoes not consider your request for a refund of charges and fees. I hope that I have been able to resolve this matter and I will close your file if I don't hear from you in the next eight weeks. A copy of our complaints leaflet which explains your options is enclosed if you remain dissatisfied. If you would like to speak to me about your complaint, please telephone direct line 0131 xxx xxxx. Yours sincerely Melita Mason Customer Service and Operations Manager.'
  22. I have my Mortgage with BOS - The terms state that they will be governed by the law of the country the house is in so I will be filing at my local County Court if required.
  23. I have yet to file paperwork with them directly as I submitted my statement request over the phone. The following post has an address that may help http://www.consumeractiongroup.co.uk/forum/barclays-bank/431-contact-detail.html
  24. Ok so the total is £1410 - It seems I was well behaved for about 3 of the 6 years so thank goodness it isn't any higher! 8% interest would take it to £1838.18
