    DCA chasing HMRC debt

I would definitely contact HMRC and try and arrange an affordable repayment plan with them and not the DCA. I have found in previous dealing with HMRC that thay have been very helpful, polite & understanding.
  2. Their registered address is .... PROTECTION HOUSE 83 BRADFORD ROAD STANNINGLEY PUDSEY WEST YORKSHIRE ENGLAND LS28 6AT However according to http://www.companiesintheuk.co.uk/ltd/motormile-finance-uk 523 other companies share this address.
  3. According to http://www.companiesintheuk.co.uk/ MMF's address might be a Mail Forwarding Service as 523 other companies share the same address. I wonder if this is the reason that MMF take so long to reply to letters that are sent to them or do MMF operate a Mail Forwarding Service as a side line?
  4. Hello mr_mastiff Thank you for your reply I will put a letter together over the weekend. The bit that gets me is "In Law a creditor is in a different position to a postman or a member of the public asking for directions" i wonder where they dreamed that up from???
  5. I recently changed my business contract from 02 to Vodafone and I regret doing so. 1. Vodafone helped themselves to £198.88 via direct debit without any explanation as to why so I rang them up to ask why. To my astonishment Vodafone did not know what the £198.88 was for so I asked my bank to reclaim the £198.88. 2. .On 4th July 2013 I returned a handset to Vodafone under their 7 day returns policy. The handset was ordered online and I paid £199.00 up front viia debit card and Vodafone received the handset on 5th July 2013. As to-date I am still waiting for Vodafone to refund my debit card. 3. I have received my August bill and it's over £400 which is ridiculous as it should be no more than £130 for the 4 handsets. After looking at my August bill Vodafone are charging me for 6 handsets, when i only have 4 . On the bill there is also an equipment charge of £179.00 for a handset which I returned in June and have actually got a credit not for. I telephone Vodafone to try and sort it and was told "we haven't seen an account in such a mess and we need to send your account for re-calculation. Vodafone rang last Sunday to inform me that the re-calculation was still in process and that they would call me back on Tuesday 6th August (Still Waiting for the Phone-call) )
  6. To make the matter even more ridiculous MMF didn't pay the correct postage and I ended up paying £1.09 for having the pleasure of MMF replying to me.... I might send them an invoice for £1.09 I would like to draft a letter to MMF pointing out what they have said is incorrect. Can anybody suggest point to raise in my response to MMF?
  7. "When you took this loan you impliedly agreed that the creditor could communicate with you to discuss repayment. You do not have the contractual right to revoke that agreement until the loan has been repaid" If the loan had defaulted and then sold to MMF, wouldn't the original agreement have been terminated?
  8. I already have a thread regarding MMF and a default, however this is regarding another issue. MMF purchased an old QuickQuid debt and have been bombarded with the usual emails threatening doorstep visits so I sent them the usual template letter . In response to my doorstep collection letter I have received the following reply from MMF. "In relation to your notification of your revocation of the doorstep licence regarding our intention to send an agent to your home to discuss the debt. I can confirm that we are fully aware of this and we ensure that we fully comply with the OFT guidance regarding debt collection and home visits by agents. You are not correct in your assertion that, under OFT Rules, we can only call at your home if you agree to make an appointment. The debt is not reasonably disputed or deadlocked and we are giving you reasonable notice of the timing of the intended visit" "In Law a creditor is in a different position to a postman or a member of the public asking for directions. When you took this loan you impliedly agreed that the creditor could communicate with you to discuss repayment. You do not have the contractual right to revoke that agreement until the loan has been repaid. Barry Ellershaw
  9. UPDATE I haven't had any response from MMF to my FINAL RESPONSE letter as in post #44 However I have noticed since sending my FINAL RESPONSE on 29th July, MMF did a credit search. I wonder what the muppets are up to know?
  10. Hi BRIGADIER2JCS Tthank you for the draft and again I appreciate all of you help. i will get this posted and see what nonsense MMF come back with ... IF ANY.
  11. Morning BRIGADIER2JCS I did send the letter (recorded) you drafted for me in post #36 on this thread, however Mr Sands hasn't replied yet. If you have time I would be grateful if you could draft a follow up letter for me to send to MMF. This letter will be the last letter to them before I make a complaint to the ICO. In my opinion MMF know exactly what they are doing incorrectly recording entry titles on credit reports and are hiding behind bu****it blaming the credit reference agencies.
  12. The following was a response from Callcredit (Noddle) and not from MMF Hi drob, I’m emailing regarding the dispute you recently raised against a financial account that appears to be labelled incorrectly on your credit file. While it may seem strange, the lender has deemed this credit agreement to be a mail order account as oppose to a personal loan. Lenders will have their own guidelines in regard to how they report on accounts and how they choose to do this will have no impact upon the rating we give you or your ability to obtain credit. Regards Noddle
  13. *UPDATE* Not surprisingly I haven't received a reply to my letter sent to Mr Sands as per post #36. I did raise a query with Call Credit regarding MMF entering the description as 'MAIL ORDER' & not a 'LOAN' and have responded with the following reply, which confirms that MMF haven't got a clue when it comes to recording personal data. Hi drob, I’m emailing regarding the dispute you recently raised against a financial account that appears to be labelled incorrectly on your credit file. While it may seem strange, the lender has deemed this credit agreement to be a mail order account as oppose to a personal loan. Lenders will have their own guidelines in regard to how they report on accounts and how they choose to do this will have no impact upon the rating we give you or your ability to obtain credit.
  14. I am sorry to hear that your wife has lost her job, however I am nor surprised in the least at The Funding Corporations attitude. It might be a good move to see if The Bill of Sale has been registered properly at the High Court of Justice. There is a charge for this (£5 if you know your Bill of Sale reference number & £40 if you don't) Enforcement Officer Royal Court of Justice Room E17 The Strand London WC2A 2LL Dear Sir or Madam Re: Bill of Sale - Ref No: XXXXXXX With reference to the above, I write to request a true copy of the registered Bill of Sale; details of which are below: Debtors Name & Address: (Input your name and address) Lenders Name & Address: (Input Lenders name and address) Bill of Sale Ref No: (Input the known reference number of the Bill of Sale - if you don't have it you will have to send a payment in the sum of £40 with this letter - if you know it, then you only have to send a payment of £5.00) It is common knowledge that a Bill of Sale can be lodged with you and be done so as an 'out of time' registration; with this in mind, can you confirm whether the said Bill of Sale in this matter has been registered out of time; and if it has been, would you kindly advise if there has been any application made to rectify the registration. I look forward to your early reply and enclose the sum of £xx.00 as necessary. Yours sincerely (sign your letter) XXXXXXXX NB: Post it recorded delivery and keep copy of your letter and copy of recorded delivery slip.
  15. Good Morning BRIGADIER2JCS Thank you for the draft letter. I will get the letter posted today and see how far I get and see if Mr Sands actually responds without passing the letter to another desk.
  16. Hi BRIGADIER2JCS Have you had a chance to draft a letter for me to send to Bumbling Barry?
  17. Morning BRIGADIER2JCS I am stunned as to how many times Bumbling Barry contradicts himself. If & when you get time I would be really grateful if you could draft a letter....you do have a way with words! I do appreciate all your help BRIGADIER2JCS, thank you
  18. UPDATE Here is the latest response from 'Bumbling Barry' drob, We share data with all three CRA’s however, we do not have access to view the data or have any control over when the data we share with them is reported or how it is updated. Please provide us with a screenshot of your credit file from the CRA that holds the incorrect data and I will be happy to re-request they update the record. I look forward to receiving the above information. Regards, Barry Customer Relations Manager Motormile Finance UK Ltd (MMF) This is an interesting quote = 'we do not have access to view the data or have any control over when the data we share with them is reported or how it is updated'
  19. I think I might take my complaint straight to the ICO. In the reply from 'Bumbling Barry' he states l'classification on your credit file is determined by the individual credit reference agency' and then later on in the letter he states "The outstanding balance we have been reporting is £570 the original debt amount was £689 and we agreed to reduce the balance in order to resolve the matter with you. Your credit file should reflect both amounts. Again should this not be the case, I will be happy to send a request to them to amend ."accordingly" The reply from MMF just contradicts itself!! and as you said renergadeimp he's obviously lying.
  20. I will send an email to 'Baffled Barry' and inform him of MMF'S responsibility when recoding data and give him 7 days to comply before I escalate my complaint with the ICO. I do actually think there is a sneaky reason as to why MMF are recording defaults as 'MAIL ORDER' and it's not the simple case of 'classification on your credit file is determined by the individual credit reference agency'
