I 'won' my claim against Natwest last July and as i still had an outstanding debt i offered to repay at £30 per month to Buchanon, Clark & Wells, under the assumption that the accoutn was closed and the debt passed onto BCW. I discovered on 17 december that my Natwest accoutn is still 'active' with interest being accrued monthly that exceeds my monthly offer?! Are they allowed to do this? I was under the impression that a debt collection agency 'bought' these debts once accounts were closed? Please could someone help me as I am now unsure what to do and the interest is just incr

Story so far....Natwest filed their defence, completed acknowledgement questionnaire and on 31 July 2006 I received a letter from Cobbetts offering payment of £1100 as gesture of goodwill...naturally i have declined this offer and told them i will only accept full payment plus interest to date and also requested that they pay all additional charges debited from my account since my original claim.....if not I will submit a second claim to the courts for the additional charges to my account....I gave them til the 4th August to respond so the story continues and I eagerly await their response.

Well.......I have now received the defence form Natwest solicitors!!! asking for information which was already given, using tactics to try and get me to drop the case...let them spend their money as i am ready to do my research and take them to court.....confident - YES...worried, a little, am also annoyed at the tactics used by NATWEST solicitors.....too lengthy to include but basically getting me to read a load of bullsh*t and supply information already submitted....hey ho, i will get my response prepared before the weekend and send off......am soooo looking forward to seeing them in Court.

Your bank does not have the right to take income from your account, i have previously had this trouble with natwest and was informed by the lending centre that they can not take any sort of income paid into the account. I would advise you to contact the lending centre and ask that they give permission (make note on their system) to allow you to withdraw your funds when they are credited to your account (they can only do this when the funds are there) then you can go into your branch and tell them that you would like to withdraw money from your account.   6. Well...to say i am suprised is an understatement!! I have just this minute finished speaking with my bank regarding my tax credits and getting them out of the account - all i need to do is go into my branch and get the money!! WOOHOO They (and i have this recorded on my phone) are not allowed to take income from your account.......to get this money you agree need a letter of authorisation or the lending centre add notes to your account approving the removal of these funds!!   7. Hi Stooly My MP agreed that if it is a demonstratable case for a breach in the law then it can be pursued through the courts. Also adding that it raises wider issues, and feels it appropriate to seek a response from the British Bankers' Association, which he has agreed to show me in due course. I have always found involoving your MP to be beneficial in circumstances surrounding money, i have always found mine supportive when issues like these have been raised.   8. Well, i first visited this forum on 16 March and sent my first letters that day to DPM, My local MP and my bank..so far i have only received a response from my MP!! So on thursday 30 (this was end of 14 days) I phoned my bank and requested copies of all my statements since October 2002, and a copy of the interest charged on my overdraft since then. Once i receive this info I shall write again requesting ALL chargeds to be re-imbursed (1st letter I only requested £950 of charges to be returned which I incurred from October 2005 - March 2006!!!)
