  6. Ooh - Lowells throw a hissy fit.

    "As a company we are well aware of our obligations in respect of the CCA. However, your guidance is certainly not required and neither do we require certain sections or sub-sections documenting or quoting. Furthermore, blah blah blah".

    And they have no intention of explaining why they say that they don`t need to supply a signed agreement.

    They enclose a leaflet for the OFT saying I have six months to complain. No explanation at all for the `phone calls made after my written and verbal instructions not to do so. Just a paragraph to say that 2 weeks after signing for my letter, they removed my number from their records. Lightening quick aren`t they.

  7. Brilliant. Those idiots at Lowells will be getting another copy of that from me if I get the court letter. So far, just a copy of their complaints procedure saying that they reply in 5 working days - sent nearly 2 weeks after they signed for the complaint.

    No CCA, no explanation of why the `phone calls continue weeks after they signed for the letter saying I am not to be contacted by `phone.

    Are they stupid, or do they hope that we are?.

  8. And today I get the next standard threat.`As you have failed to contact us (despite their signing for two recorded letters) we have now been instructed (who by?) to appoint an agent in your area to visit your home etc etc`. To prevent this unwanted intrusion I MUST contact them URGENTLY.

    I think I`ll just send them a copy of the letter I`ve seen somewhere on the site re only the postman and emergency services (??) are allowed to call.

    What should I expect next from these berks?.

  9. Got a letter from these people today re the CCA. They say that the agreement I entered into is not a regulated consumer credit agreement and is not governed by the terms of Section 78 of the Consumer Credit Act 1974. Whats the best way to proceed please. I have drafted a letter asking for their reasons for saying this, but haven`t posted it yet. At no point have they ever told me what the alleged debt is for ( so I can`t give you any info on that - sorry).

    I suppose asking for a copy of whatever they say I did agree to would be a start. I`ll rewrite the letter later.

  10. Two calls today from Lowells. Both from a girl calling herself Hannah. She claims that these calls are not harassment despite having been informed in writing that they are not to do so. So I`ve sent a recorded letter pinched from Priorityone (ta) asking for their complaints procedure and an explanation of why Lowells feel that these calls are OK.

    Clock ticking fast on their non production of a CCA as well.

  11. I wrote to Lowells asking for a CCA, enclosing a £1 P.O and asking not to be contacted by `phone,3 days ago. Today, I got a call asking for my security details. I refused. He then said "I`m from Global (Ithink?) about your account". I told him that I`d written insisting on everything in writing and suggested that he feck off.

    The number he called from was 01133 086000. Is this Lowells? I never heard of Global. Googled the number, but got nothing except that 01133 is a code for Leeds.

  12. Sorry if this is a stupid post. Wescott were chasing me for an alleged HSBC debt. They couldn`t provide a CCA and said they were returning the account. Now Lowells are giving it a go. Is the procedure the same?. Request a CCA, don`t get one, Lowells give up and then someone else has a go. Ad Infinitum. Or is there a quicker way to deal with this, once and for all?

  13. The very first thing to do is to refuse to talk on the `phone. Tell them to put everything in writing. Then have a good browse around this site. Plenty of standard letters for you to send to them. If they can`t prove an debt, then you pay them nothing. Don`t panic - just be firm with them if they `phone.
