  1. As i said above, once you have been on the receiving end of it then feel free to comment. Its not offensive at all - unless of course your a little upset because you are bailiff.

Correct, it is disgusting, but then you have probably not been threatened that your business will be ruined, and then mugged for thousands of ££'s by bailiffs infront of a crowd of Police officers, for a debt you had nothing to do with? When you have been on the receiving end of that feel free to share your experiences. I have however, had dealings with ****** filth who have no comprehension of their actions, total disregard for the law, no guilt, interest, pride, logical or legal thought etc etc etc blah blah blah, so, therefore yes i.m.o it is called for. and rather than pulling out the politicaly correct red card, you should realise that I was actually refering to the story that the aforementioned killer had total disregard for the fact he had done wrong, he 'helped' the Police, in interview he came across very well and convinced people (for a while) he was innocent, thought he could get away with it, but in the end didn't and got locked up. Exactly what should happen to bailiffs who steal. Either that or they should be executed in the back of the head. This is because they are not dissimilar to bent Police officers. Should be easy then. but no. If I was them, it would be a fairly long definitive concise answer, in fact I would be able to end the thread. But no, because the truth is, neither High school or Twonames can really give the definitive answers required because they don't really know, (by their own admission) Here we have High school, searching this forum day and night for tips, hints and legal advice on how to carry out his day to day job, but in truth, he hasn't pis*ed off enough people during the day so he has to find an additional vent. ..hoping that his gravy train career isn't about to come to an abrupt halt when the MOJ change the rules, hoping that some case against a bailiff isn't about to set a precedent, and clinging on to what he thinks is right or wrong but is unsure and lacks confidence, but in essence, as we all know, most of what he does is loosely made up on the day, to fit. Hce, you may want to use: www.torproject.org This handy gizmo will secure anonominity online, it will prevent someone using a command prompt on you, the whois nick_name, or indeed the netstat command or similar. There are several ways to do it. I have detailed files.

Whilst i'm on it HCE you also say that the bailiff is there for goods not money. Again, knowing a few bailiffs they would all disagree, taking goods is the last option, taking cash is far easier, quicker, and cost effective. You're telling me you would rather load and unload vans all day or take a wad of notes. Bit of a no brainer really isn't it. Lastly, you may want to remove yourself from 192.com, as your home address is listed on there, if you search through occupation, 'certificated bailiffs', strangely enough, all the bailiffs are listed.

Of course, every individual bankrupcy is exactly that, judged on individual circumstances, Of course, if the head rent of the house is 1k, no one in their right mind is going to say that they pay the parents 950. It doesnt stack up. What Iam trying to get across is that in many cases I have come across, the O.R has little definate info to go on as to who lives in the house, who pays what etc etc - there are 100's of bankruptcy cases going through each week at the moment, and its not often you hear a family of 5 being individually brought to court and questioned on their circumstances. In theory yes of course Spamheed everything you say is correct, In practice no, there is simply not enough resourses at the moment like there used to be. There are a 100 and 1 ways to make things look reasonable on paper. As I said, "unless of course the rent is ridiculous in the sense of no reasonable person could agree" I know of a case where the mortgage the parents pay is 1300 per month, but neither work. The son and daughter actually pay the 'rent' for the mortgage. The son pays 650 as does the daughter. The son goes bankrupt and tells the OR he is paying half the mortgage. Nothing illegal, nothing wrong. If they dont pay the mortgage then all 4 are out of a home. Its the circumstances that the OR would put up with, or the local authority would be picking up the bill for rehousing 4 people. This is not cost effective.

Hmm,, personally, I kept an orange monthly contract going with no probs, on DD and still have it (despite the OR telling that he would inform them and they would then cut the phone) , got a friend to step in as Director of one of the companies for us, ( he then employs you) and if you want an apartment, then go to a private landlord. I know several people that have declared bankruptcy in the Uk and gone on to form Ltd co's in Cyprus. I dont really think that other countries are going to check your credit profile in the UK. In any event why do you want to be a director? You will probably only be BR for max 12 months anyway. In essence, nothing really physically changed when BR
  12. Wouldnt bother to tell the OR you have a debit card. It means nothing to them anyway.
  13. This does depend on how much the parents want for rent though. If your wages are 1000 per month, and your parents say the rent is 950.00, and give this in writing to the OR there is absolutely nothing the OR can do about it. This can also include a share of the bills. The OR has no legal right to become involved. Never can the OR argue about how much rent you are paying or comment that it seems expensive or that the bankrupt ought to seek cheaper accommadation, unless of course the rent is ridiculous in the sense of no reasonable person could agree.
  14. Hmmm. These officers havent really acted professionally. They shouldnt be asking the truck driver to clarify the law. I have a complaint filed against several officers of **** Police for the following: Lack of fairness and impartiality Complaint summary: Complainant reports that the officers acted unprofessionally in siding with bailiffs when they came to his property and rather than remaining independant in doing so assisisted the bailiffs in fraudulently obtaining money from him. This is a serious offence commited by officers named. Dont telephone. Just write letters to the chief inspector. Only write facts and dont whitter on. good luck DB
  15. Correct the OR cannot and will not take these loans into account. I wouldnt even mention them. IF you did pay them these creditors would be seen as preferential. The law views it as why should these loans get paid and no one else, and of course far more importantly, legally they are not your responsibility. They can also deduct wages from source to pay your creditors, unless of course you pay your parents rent which includes all of your wages and there is none left to share to your creditors, and in turn your parents feed you and generally pay for your day to day living. (which of course is quite possible)

  17. Ignore all the fees and charges. they will be written off under the bankruptcy order. They are being added just because the creditors can add them, and of course they dont know, but there may be loads of big assets to come out of the bankruptcy, and hence a payout for them. Calls will stop as soon as he is adjudged BR. It is an offence to call a debtor once they are B.R
  18. From what I know Victor, they dont have time at the moment to go through too much - can you imagine going through all the credit card statements from the last 5 years on 1 card alone? It would take far too long, and in any event who cares whats showing on there? They will be looking at the overall situation, not dwelling on the fact you took a flight to a meeting. They will only really be interested in big assets that you maybe hiding. If you havent got anything then theres no worries. Unless you have been completely reckless and stupid If theres any wrong doing on your part, you will be putting this info down on the forms to petition for your bankruptcy. The O.R now realises that many BR's at present are down to company failiures which yours is. BR for 12 months and an early discharge in 6 is more than possible, as you can argue you had no control over the world economy plunging downwards. After your discharge no ones really knows about your BR anyway, so its not like you have to go into an investor meeting saying, well first attempt failed , I went BR but here I am again.
  19. P.s Not sure if someone makes you bankrupt and you dont attend court what happens? If it were me, I would want to do it first, and get it done properly. Remember, however wierd it may seem, the court will never judge you in bankruptcy, unless of course you have been entirely reckless, but having read you post above, its a repeat story of 1000's of cases. and everything there seems totally legit. All you wanted to do was keep the thing going, and thats all of us ever want to do.. P.S forget the amount you owe, as it is entirely irrelevant. my o.h had to go BR for big money, bank guarantees, the lot after a massive business failure, and it was all done and dusted in one morning at court.   20. Hi Victor, been there done it my friend. I know its easy to write on a forum dont worry, but seriously, DON'T! In my opinion, you would be better petitioning for your own BR, as it can be a little long winded, 'waiting' for someone to make you bankrupt. i.e a few more questions from the official receiver as to why you didnt make yourself bankruupt. Nothing major I know, but you get my drift. It is NOT an offence not to have an address. If you are concerned, simply open a holding address. Do this at 'MailBox' in the high street, or look on the net. There are tons of accomadation addressesyou can 'purchase' for a monthly fee in which to send mail.
  21. yes, it is a standard HP agreement with BMW. It may be that they say they will collect it because bankrupts can't legally have credit in sum of £2,300?, and it covers BMW's backside? i.e they took all steps to end the agreement? Maybe just an auto letter they send out. Would rather know 100% though!
  22. By the way, you have children, so the Official Receiver will not want to throw you out of your house, and sell it. It is only in extreme cases that the equity is that big (it would really have to be in excess of say 20k) that the OR would be interested. Even then, it doesnt happen overnight, anyone can buy the equity in a deal with the O.R, and in most cases has a year to pay the equity to the O.R, but dont worry as you are in negative equity anyway..
