Hi Garry, I have spent the afternoon preparing an order to remove the stay on my case, but after talking to the Cambridge court I get the impression that it is very unlikely to happen especially as I dont have any particular hardship issues (apart from the SHABBY HAVING OVER £4,000 OF MINE FROM CHARGES). The initial cost has gone up to £40, has there been any succsesses or is it going to be more money into the black hole which is opening up????? Thanks for your time Darren
  2. Thanks all, Doesn't look like iv got much chance, i will just have to keep my fingers crossd that the banks and OFT get it sortd and in our favour sooner rather than later.
  3. I dont believe it.....I have just recieved a letter from cambridge court saying case has been postponed pending the OFT case, that culd be next year!!!!!

  5. Thanks Yeh, i think your right, im going to be prepared for the worst. I think that is the reason the individuals have failed in court becus they havent been prepared and just expect the banks not to turn up at court. Darren
  6. Hi John, I submitted my court papers online and recieved the transfer to cambridge court at the end of June and then recieved a Pre Trail Review date of 10 Sep. The good news is they havnt ask for an AQ and so wont cost another £100. They have said that i dont need to submitt anything to the court for the 10 Sep, but Im getting my court bundle ready to take just in case, hopefully the Abbey will settle before the court date. Iv read your thread an see you had to do an AQ is that becuase your claim goes above the small claims? Good luck, I will keep a keen eye on your thread to see how things go, have you got any advice after what you have been thru!!!!

The good news is they dont ask for an AQ(thats the questioneer) and it doesnt cost another £100. Hi, iv got a court date for 10 Sep 07, the court hav done away with the AQ and the £100 charge, so thats good. i hav rung the court and asked if i need to submitt anything but they hav said no, but im still getting my court bundle together just in case. i submitted a cpr 18 becus i read on here somewhere that when u get the referal onto the court that was the write time, but as yet havnt herd anything from the Abbey, is that wrong???? my claim is for just over £4000 including interest. i hav written to Abbey suggesting that i would settle slightly below but recieved a polite letter saying that it wasnt economialy viable for them to settle!!!!!!! i thought that strange becus if i wait till the court date im expecting them to settle the full amount and then i will costs.

I started the process in July 06, but as i gather is normal abbey forgot!!! or more likely didnt bother to process my request for duplicate statement, I finaly recieved them after a very helpful employee in the kings lynn branch pushed it through for me. I then applied to abbey using the forms reproduced in the Daily Mail, until i found this site, there are a few differnences in the Mail forms but nothing significant so hopefully it wont make any difference. reading through all the variouse cassess it looks like i got all the standard abbey responses and so i filled an online to take them to court in early May. all the normal corut stuff came through including an offer from abbey of 65% of the claim, told them to shuv!!! I sent them a CPR part 18, but had no response yet and last week recieved details that my court has been transfered to cambridge and no need for an AQ form, fingers crossed getting sumwhere at last.   12. Hi, I have read ur thread with interset. I filed for refund of charges on mcol and currently waiting for the allocation to be transfered to Kings Lynn, ur case sounds very similar to mine only i am with Abbey, good luck with claiming ur time costs back. I wish i was where u are!!
  13. Hi, im looking for anyone who has had a claim filed at Kings Lynn. I registered my claim on mcol and I have been through all the early stages and are waiting for the transfer details to Kings Lynn. Im with Abbey but any advice from anyone in the area would be gratefuly apreciated.
  14. i have just read about a CPR Part 18 Request, I have just recieved the banks defence so its about right to submitt it, but im not sure if i need to, has anyone done it and can advise on what it is going to achieve?? i have decided to reject there offer and hold out for full payment or at least a much better offer, in there 65% they havnt takn into consideration the £900 interest or court fees, so they are only offereing 50% in effect. NO CHANCE
