  1. Hello again, I called MCOL and informed them of the payment from Abbey. They stated that they will put a note on my claim. Today I received from DLA a letter basically wanting a breakdown of the charges and interest. After searching the forum I have found and amended a letter as below. However, I have checked my interest spreadsheet today, and for some reason the "charges amount" to £2478.00 and NOT £2510.00 as I had originally calculated. I have gone over the spread sheet and compared it to my initial breakdown that I sent through on my LBA but I can not see where I have gone wrong. Maybe I added an extra £32 charge somewhere, but I am sure I used the spreadsheet total. Quite frankly I am surprised Abbey National plc are prepared to instruct you to represent them without providing you with all the material facts. All the details and claim particulars are at their disposal both in the statements of my account and in the correspondence between me and Abbey National plc when I followed their complaints procedure, which clearly states the claim is for repayment of Bank Charges between 29th December 2000 and 18th June 2006. I would have expected Abbey National plc to have provided you with copies of this documentation upon instructing you to act for them, since all this information is at your client’s disposal. For your convenience I have detailed the particulars of the claim below. I am claiming repayment of Bank Charges taken from my account by your client between 29th December 2000 and 18th June 2006, plus I am furthermore claiming interest on each of these charges at the rate of 8% per annum under section 69 of the County Court Act, plus court costs and fees for bringing this action. I feel it best to advise you, the interest is compounding daily and was calculated at £633.63 at the date of filing the claim with the court. Interest is being added to this amount every day, so it is in your client’s interest to bring this matter to a speedy resolution. The bank charges I have claimed are clearly detailed on my bank statements which have been provided to me by your client and are of course available to you via your client.   3. Just had my letter through from MCOL stating; Deemed served on the 5th September 2006, Defendant has until the 19th September 2006 to reply. Further down the letter it states however; "You must inform the court IMMEDIATELY if you receive any payment before a hearing date or after you have sent a request for enforcement to the court". I few of you might have seen my post on another thread stating where by I went along to the bank on the 23rd August to find about £650 refunded in to my account. I then received from Abbey the following letter on the 25th August; "Dear ***** ***** Thank you for your letter dated 31 July 2006, about your bank charges. I am sorry that you feel these contravene the Unfair Terms in Consumer Regulations 1999. Having carried out a full investigation, I can assure you the charges do not contravene those regulations and therefore I cannot agree to refund all of them. However, as a gesture of goodwill, I am happy to refund £615.00 of charges that have already debited your account and £110.00 of charges that were due to debit in August 2006, making a total of £725.00. The regulations say that we must explain our charges in plain language and that we have to act in good faith, which, according to the Office of Fair Trading, means dealing fairly and openly with customers. I therefore reviewed the literature and information you received when you opened the account, including the terms and conditions. This explains that charges will be applied if you do not keep to the terms and conditions. This explains that charges will be applied if you do not keep to the terms of the account. Because of this, I believe we have been fair and open in telling you about them. The charges were correct, because you did not have enough money in your account to cover payments requested from it. When I looked at the history for your account I found that, unfortunately, this was not the first time this has happened. We can, as you asked, supply you with details of all charges on your account over the last six years, If you would like us to do this, please contact our Telephone Banking Centre on 08459 724 724 or visit one of our branches. There is a fee of £10 per account, to cover the cost of producing this information. I am confident that I have been fair and have taken into account all the points you made in your letter, but if you have any additional points that you would like to discuss with me, please call me on 0845 600 6014 I have enclosed a leaflet about the Financial Ombudsman Service, in case you are not happy with our investigation or decision. If so, you should contact them within six months of the date of this letter enclosing a copy of it, as they would need this for their investigation. I hope we can work together to help you avoid charges in the future. Little things can help, like checking your account balance as often as possible and looking at the dates of direct debits to make sure they are taken shortly after money is paid in. In addition, we might be able to help by increasing your overdraft facility to give you more flexibility. This could help to keep your costs down, as there are no charges and you only pay interest if you use the facility. So, if you would like to talk to someone about the options available, please call our Telephone Banking Centre on 08459 724 724. Alternatively, if you think you might need longer-term financial help or advice please call 0845 603 9035 and we'll be happy to help. Yours sincerely Mr Philip Blaver Customer Resolutions Manager" What do I do? Carry on with the full amount as already in the claim, or inform the court of this amount. I know a few people on here think the same as I do, that a "Goodwill Gesture" is exactly that, and not a partial refund, as I never signed anything accepting the money, nor have Abbey given breakdown of the refund. However I don't want the court to throw the claim out. Any suggestions. Thanks, Joanne.

  5. At 15:30hrs today, I started a claim against Abbey with MCOL; £2510.00p + £633.63p interest + £120.00p court fee = £3263.63p I can almost smell that money.
  6. When I checked my credit file a short time ago, everything was looking great apart from the Vodafone section, which showed several defaults.
  7. I phoned the "Card Enquiries" number on the back of my Current Account Switch card, 08457 404 404. I then asked re my credit card, and they put me through. Hope this helps. Mike.

Hello all, as my partner and I have been having so much good luck with claiming back our charges (Abbey Current Account & HSBC Current Account), I thought I would try on my closed HSBC Credit Card Account. The account was closed in 2004 by HSBC due to myself having difficulties at the time in paying there horrendous charges. I typed up my Subject Access Request letter with the intentions of sending it tomorrow, however I called them as I needed my account number. Whilst on the line, they asked what else they could help me with, so I asked for all my statements within the last six years. I was passed to the relevant department, and then told that someone would call me back shortly to discuss the amount I would need to pay for the statements as there where a lot. I was told that it could be approximately £1 per statement (like I was ever going to pay that!). They called back about 10 minutes later stating that after viewing my account, they will be sending out the statements, and I should have them within the next 10 working days. They also said that there would be no charge! (I wonder what they type on your account if you have asked for charges back?) Very helpful gentleman, maybe on our side, who knows??

  10. Thanks for the support. The 14 days are up tomorrow. So as soon as I get back from work at 18:00, I'll get stuck in to MCOL. Re MCOL, I have looked around this site and have found a number of useful threads, however this is my first time making a claim, and I have not even registered with them. Anyone who has been in a similar situation with Abbey please pop a reply on, along with what you typed in to your claim. I also totally agree with the notion that the "Gesture of Goodwill", that they have "stated" is nothing more than that, and NOT a partial refund of any money they owe me. I will be pressing on for the full amount plus interest tomorrow!!! - £3143.62p Thanks everyone for all your help, roll on, and I won't forget to donate some when I get it. Joanne.

  12. Hello all, I have been reading with great interest a number of threads on here regarding the removal of defaults on credit files. From the vast amount of information, I can see that people have a number of routes that they can take, however I am uncertain as to which route to take. I situation is this, I had a Vodafone contract, ending approximately 18 months ago. However whilst with them, I had several defaults entered on to my credit file for late payment. All money owed was paid to Vodafone, and the debt never got past the "default stage", e.g. CCJ etc. The defaults are now making life a little uncomfortable, and I would like them removed any which way. I have found the following letter, and was hoping for some advice as. Thank you in advance, and my HSBC claim for unfair bank charges is going well due to the support of everyone on here; After recently obtaining a copy of my credit file from Experian I was concerned to note that your company has placed a "Default" notice against my previous Vodafone account. Further to this I have no recollection of ever receiving such a notice, and I therefore require you to substantiate this data at your earliest convenience. * You must supply me with a true copy of the alleged agreement you refer to. This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit). Your obligation also extends to providing a statement of account. I enclose a £1 cheque in payment of the statutory fee. * You must supply me with a signed true and certified copy of the original default notice * Any deed of assignment if the debt was sold on I would request that this data is provided to myself within the next 28 days, if you are unable to provide this data then I must insist that it is removed from my files as unsubstantiated. As my I have moved address since closing the account, I enclose an original council tax bill as proof of my current address. Yours faithfully
  13. Cheers, I've just been thinking about additional charges. As HSBC have charged me another £90 this month. How do I now claim for that? Do I wait until this claim is over, or do I add on a line to the above letter stating I want the £90 back as well? My concern is that due to the time delay in this whole process my first bank charge(s) maybe now be a month or two outside of the 6 year time frame going back from today’s date. Joanne.

Dear [named sender or Sirs] Thank you for your letter dated xx/xx/xx I respectfully decline your offer of settlement and request, once again, that you return to me all charges imposed on this account, totalling £xxxx I will accept the sum offered only as part settlement and on the clear understanding that I will pursue recovery of the remainder, with a County Court claim if necessary. My letter before action sent previously indicates that you have until xx/xx/xx to respond before Court action commences. You are reminded that there will be no extension to this timescale. I trust this clarifies my position. Yours faithfully [signature] [print name]

  16. Anyone know of the correct template for a response letter stating I will be continuing but will accept this offer as partial payment? Also, the letter I received read; "Thank you for your letter dated 7 August 2006 requesting a refund of your bank charges of £2151.00 going back six years. In circumstances where you have authorised a payment that would, if met by us, lead to your account going overdrawn or over an agreed overdraft limit, we have to consider whether to make this payment. A fee is payable for this service provided by the bank, details of which are clearly set out in our published price list. The circumstances in which the fee will apply are clearly set out in our Personal Banking terms and conditions which you were provided with a copy of when you opened your account. If your claim for a refund proceeded to Court, we therefore believe we would successfully resist any legal challenge in relation to these fees. HSBC is, however, mindful of the management time and irrecoverable legal costs that it may incur in relation to such a claim. For those commercial reasons alone, and without any admission of liability whatsoever, HSBC is prepared to make a payment to you in the sum of £1935.00 representing the charges applied in full and final settlement of this matter. If you accept this proposal please sign and return the enclosed copy of this letter to us within 10 working days and we will arrange for a refund to be made to you. Please allow 7 working days for your account to be credited from receipt by ourselves. Thank you again for taking the time to write." So what does everyone think, have I got a leg to stand on if I press on...I want too!!!
  17. Hello all, you may have read my other posts, but this one is for my fella. He obtained all his statement on-line, and sent in his first letter on the 7th August asking for £2151 (no interest at this point). As you would imagine, no reply. He sent his Letter Before Action on the 22nd August. Now this morning (25th) we recieved a letter from HSBC stating the usual..."We are not accepting any liability, however will you accept £1935. If so please sign and return the attached letter". Not bad for two letters and no personal contact I can hear some of you say. I just wanted to ask for advice. Our thoughts are, they can stick the offer (I know its only just short of what we asked for), but we want the full amount...plus interest. I know this sounds greedy, but what do people think, are you with us, or are we just being stupid. Cheers, Joanne.

  20. Hello, I'm pretty much at the same stage as you. If the 14 days are up on the prim letter, then send the Letter Before Action (LBA), don't forget "registered".   22. I think its another stall tactic, to sway some people to drop the claim, and be happy with £650. There in for a shock. Also looking at the letter from the above link; "I understand you are unhappy with my decision, and as a result I have reinvestigated your concerns further. I can assure you our charges are not unlawful and therefore I cannot agree to refund all of them. However, as a gesture of goodwill, I am pleased to confirm I have credited £622 to your account, and cancelled charges of £40 that were due to debit your account." I find the bit of "gesture of goodwill" very interesting, as this states exactly that, not a refund. Well, I'll keep there goodwill gesture, but I want my money back!
  23. Thanks everyone, I'm still pushing on with the support of you lot and this site. Another quick question though, re what Joanne.Hunt said. Deducting money off what I am claiming, where do I take it off, e.g. the earlier charges or the later ones, as I'm just thinking of the interest I will be applying at the next stage (court). Could I just play stupid about the refund, and push on with the full amount, as I have not received any letter from them stating that they where going to do this, (does anybody know where we stand legally with this?)   24. I'm over the moon to finally see some money from them. How can they now not give me the rest, as this OBVIOUSLY shows that SHABBY are in the wrong, as who would hand over £650 if they where in the right??? BRING IT ON!!!
  25. Hello all, my fella and I have both just sent off our LBA's, however there is now a twist. I took myself along to the bank this morning to withdraw some money, and what did I find...an extra £650'ish in "Unauthorised Charges" refunded to my account. What’s going on? The money was refunded in to my account on the 18th of this month. It's still no where near the £2500 that I want back, but its a nice start. One other thing through, as the money was refunded to my account on the 18th, and I sent my LBA yesterday (22nd) still asking for the full amount, does that throw any spanners in the works?
