  1. So it is more of a moral argument than a claim in law?
  2. Hi Did you ever get an answer to this? My daughter (3yrs old) had to have a tooth out under a GA. We were told we'd have to wait one year on the NHS - but there was a risk of the infection damaging the adult tooth or jaw. So had to pay 1500 quid for private treatment. I felt very angry at the time as any parent would.
  3. Hi, I requested my account CCA at the end of November along with my SAR - enclosing both fees. I've now received all my statements for the past 6 years, but no CCA. I initially requested this information as I am paying PPI that I am sure I didn’t agree to. However, as they seem to be unable to supply my CCA and are now technically committing a criminal offence what options do I have? From reading other threads it sounds like that any balance I have, I still technically owe (don’t have a problem with this), but they owe me all my PPI payments, all charges, and compound interest on these. What I wonder is if I can claim back all the interest they have charge me as the actual terms of the alleged debt are null and void. Also, I requested any record of manual intervention to my account, they replied saying they don’t keep a record and therefore will not supply it. This confused me for two reasons, I’m sure all interventions would be electronic and if so, logged - therefore falling into my SAR? Or have I totally missed the point?
  4. Hi Had a thought - can i claim for all the time it takes for me to compile my claim? So far i must have spent 10-15 hrs reading and doing background research. Although interesting, it's not really what i want to spend my time doing. If i can claim for time, is there a standard rate or should i apply my contract work rate? Thoughts please...................

  6. Hi, Send my letter to BOS last wednesday (6th Dec) - ive had a CC with them for the past 10 yrs and been paying PPI and charges each and evey month. Not sure i've done it correctly but i have submitted both my data protection request giving the 40 days with 10 pounds and in the same letter requested my CCA agreement with 12 days notice and 1 pound fee (used the wording from somewhere else on this site). Once i posted it all, it dawned on me that perhaps they should have been seperate letters. Do you see any problem with this? Anyway - no reply so far. Thing is, not sure how my claim is affected by the value of caliming back the PPI (i'm 100% sure i never agreed to PPI, in the 20 odd credit agreements i've had i have never had PPI) i think my PPI payments for the past 6 years will be around 5k and charges will have to run to well over 1.5k. But i guess i shouldnt jump the gun and should wait for their reply. Also - i sent two cheques for payment, but this evening i found a post saying use postal orders, whys that? I've waffled enough and will update you as and when. If this goes OK then i'll start looking at the other CC and accounts.
  7. Hi Had a similar experiance with TC this time last year. Had a horrific holiday to the Maldives August 2005, made a complaint in resort, on the way home and then repeatedly for several months when we came back. Eventually after talking to trading standards and still not getting anywhere i obtained the home address's of each of the directors (£1 from companies house) and wrote to each of them a few days before christmas, telling in detail what had happened, the run around i have had and what i was expecting them to pay or that i would start court action against them. I also clamed 50% of the cost for distress. They settled before new year. Might be worth a go!

Hi This is my first posting - I have been lurking around these pages for weeks now, and to be totally honest I am rather shocked at the way financial institutions act, lie and bend the law to their own ends. Anyway, I am trying to get my finances in order (after years of thinking about it) and have only just noticed that I am paying payment protection on one of my credit cards; I am 90% sure that I never agreed to that - to date I have never had PPI for anything and by now I must have had 20-30 agreements over the years. So my first question is do I request a copy of my application form or consumer credit agreement? Which would bind me to PPI if I had agreed (which I am sure I didn't) at a quick guess I must have paid around 5k in PPI fees over the past 6 yrs - Secondly I've had the card in question for more than 6 years, so would he 6 year limit apply to the claiming back of any payments for PPI if I didn’t agree. Going over the pages on the site also made me think about my other cards (I do have rather a lot) and I am sure that I have never done more than fill in an application form and then got a card. If I am correct, does this mean I am not bound in to any contract as there is no CCA agreement? (I have tried looking for a guide / overview on the site to CCA and credit cards but cant find anything...links please?) So what I was thinking is as follows Apply to the first CC for my CCA to see if I did agree to PPI, if I didn't agree I will ask for all PPI payments back - or does it make any agreement invalid? If they can't find my CCA agreement what do I do - I have no objection to paying monies I have spent on my CC but do object to paying PPI and to be totally honest if I don’t have to pay interest on any balance, I have no objection to claiming back all interest to date (they wouldn’t bat an eye lid in my shoes). Regarding the other cards, would I be better of requesting my CCA from each of them or requesting information under the Data protection act? Once that’s all done I’ll look at my loans and bank charges. Sorry if I have gone on a bit.............
