  1. It was a police officer that stopped me as soon as I pulled out of an adjoining road. I would have barely got above 5 - 10 mph before I was pulled over and it was never mentioned about speeding. I haven't had anything else through the post at all regarding this apart from details regarding the fine which I had originally presumed was wholly for the no insurance. I will definately look into the police complaints procedure and take it from there then because speeding absolutely and categorically didn't happen and wasn't even mentioned by the officer! And so the date won't be a typo, if anything the whole section on speeding was a typr. Thanks all for your help. Tony
  2. Hi green and mean, there aren't even any cameras on the road. Its a side road. So should I ring them before I go to court or should I wait till I appear as I obviously still have to go to discuss how to pay the fine for at least the no insurance? Its all very weird as its the same ticket number, same time and same road but completely different date. Thanks for your help.

Vehicle Registration: KP02 WJF. Speeding - exceed 30 miles per hour on restricted road - automatic camera device. Victim surcharge - £15.00. Costs to Crown Prosecution Service - £35.00. Fine - £35.00. 02/07/2011 - Regsitered Fixed Penalty Ticket Number : R83011021 NTO issued on: 09.10pm at GREENACRES ROAD OLDHAM. Vehicle Registration: KP02 WJF. Use a motor vehicle without third party insurance. Fine - £300. The second offence being the correct one. This happened on the road at then end of my street. I only moved here in April 2011 and so the first offence never even happened. Plus I was stopped literally as I came out of my road onto Greenacres Road and the only offence was no insurance and no tax. I barely got to 10mph before I was stopped so I have no idea where they have a speeding offence. Thanks for your help . Tony
  4. Hi All I have received a summons for non payment of fines. However, they have listed two offences on it and a breakdown of the amounts imposed and one is correct and the other cannot be correct. The dates are completely different by approximately a year yet the Registered Fixed Penalty Ticket Number is exactly the same. The earlier offence is impossible as it on the same road as the second offence but I didn't live in that area until slightly before the second correct offence. What can I do now, if anything? Hope someone can help and hope my post makes sense! I am willing to copy and email the letter to someone if that helps. Thanks Tony

  6. Hi All Could do with a bit of advice regarding a Notice Of Intention To Prosecute and the request for the name and address of the driver. The apparent offence was doing 37mph on a 30mph road. It apparently happened at 23:36 on 30/09/2011 and the date of the notice is 18/01/2012. If this was myself which I am not certain whether it was or not as it was that long ago then it was possibly around the time that I bought the car so it may not have been registered in my name in time for the notice to come to me and may have gone to the gentleman I bought the car off originally. Any advice on how to proceed would be greatly appreciated. Thanks Tony

The thing is I don't mind wasting more of my time to ensure that people like that respect the way things work and with this respect that when you click buy it now on Ebay, it is to buy it not to view it. This happened to me a few years ago selling another car and it isn't fair. And I believe it will be black and white and he has reneged on a contract then the court will find in my favour and I will get back any costs. I just need a little help in the processes.   8. Hi everyone I recently sold my car on Ebay. The gentleman came to pick up the car but when he arrived he made a few excuses and then refused to complete the purchase. After looking around Ebay forums one seller had the same problem and made a claim through MCOL. I wish to do the same and wanted peoples thoughts on this. Any transaction completed on Ebay is a legally binding contract and not for a viewing. I believe first of all I need to send a letter before action. What should I put in it and are there any templates for one? Also, on Ebay the name of the buyer was a lady yet I presume it was her husband that used her Ebay account as it was a gentleman that came to complete the purchase. The address for the lady was also a works address and I believe that to be his works address. Where do I post/email the letter before action and then what information should I put on the MCOL form? I would really appreciate someones help and opinions. Thank you Tony
  9. Hi all This is my first post so I hope its in the right place and really hope someone can help! I bought a paid of trainers from getthelabel.com and I have had them for approximately 2 months. Both trainers have developed a split on the underside of the sole and leak water everytime it rains. I sent them an email claiming for a replacement under the sales of goods act as I would have expected them to last more than 2 months. They sent me the below email which I am not happy about. They are asking me to send them back to inspect at my own cost and will only refund that if they agree its a manufacturing fault and they are also the only paid of trainers I have so if I do send them back I will have nothing. I think I am being really inconvenienced by this and am looking for suggestions. Good Afternoon Anthony, I am sorry to hear that you are unhappy with your items. Without looking at the items we would be unable to say if the items are faulty or if they have general wear and tear. My best advice would be to send the item back to us. If it is deemed to be a manufacturer fault then you will be refunded the returns postage cost and will be replaced or refunded in accordance to your instructions on the returns slip.   12. In fact after re reading it whilst I was copying it to this thread I thought the same thing so I checked the DVLA website and did a vehicle enquiry and it says there is a SORN in place and it doesn't expire until 01/08/2011. I knew I had done it. So what now please?

From 1 October 2008 changes to legislation mean that enforcement action can be taken against unlicensed vehicles even if kept off the road. Your vehicle has been seen at Abbey Hey Lane, Manchester and an offence has been committed. However, I am prepared to offer you a final opportunity to pay the out of court settlement of £230 requested in our previous letter. Please make your cheque or postal order payable to 'DVLA' and return with this letter to the above address. We are unable to accept installments. If you wish to pay by debit/credit card please phone the above number. Full payment must reach this office by 2/03/2011 to avoid court action.   14. Hi All I am in need of some desperate help before I get ripped off by the DVLA. My car is declared off the road and is in deed off the road and I have received a letter from the DVLA stating that iy had been spotted with no tax and they were offering me an out of court settlement of £230. I wrote to them and said it would have been spotted off the road behind my house on a grass verge but I have the car SORN'd. I have now received a reply from them saying that the law has changed recently and that fine can now be issued to cars declared off the road even when they are off the road. They have then said they will still accept an out of court settlement of £230. Surely this can't be the case because what would be the point of SORNing your car? Any help would be greatly appreciated. Thank you Anthony Dunn
