  1. Hello all,

    nothing to report really, quite a few calls from BC,

    a letter Defaulting me,

     

     

    eventually a call got me, as soon as the chap identified himself,

    I told him that the account was in dispute as they had not complied with a CCA request

    and they should not be adding interest and charges to the account but they were, and hung up.

     

    I've since had a letter telling me they were dealing with my complaint

     

    SAR not sent yet, it's the 'agg' of getting to the post office for the postal order ...

    I've found a folder with statements for Barclaycard, MBNA and OPus dating back to the end of 2009, there may be others in another folder.

     

    Am I right to think I put all the charges of any kind in to a Stat Interest spreadsheet for each card and then start claim for each, that easy?

    Can I claim any of the following?

     

    Interest on cash balance?

    Interest on Standard balance?

    Interest on Default Sums?

     

    And is stat interest at 8% the bread and butter safe claim?

     

    Is gong for contractual Interest more risky and likely to actually go to court

     

    (I know I'm being lazy for not reading, I wil, promise)

  3. Hi Slick, ta, that all makes sense

     

    They Defaulted me yesterday, not bothered about credit rating, I've opened a new Joint Account and just need to get the Account Switching service to get it all moved over before payday at the end of the month

     

    Are they even allowed to Default and add charges if the account is in dispute? Does it stay in dispute until the supply a valid copy of the CCA? ie should the account be effectively frozen?

     

    Not yet to statements, been busy and that seemed to less time critical that other things on the go

  4. She spoke to them eventually, someone at NatWest said they couldn't send her everything as some of it was confidential and would need to be redacted, she asked how it could be if it related to her, they said thing like terms and conditions, wha?

     

    They're going to send her a letter to take into a branch to confirm her identity as her printed signature did not match the actual signature they say they hold on file

     

    gibberish nonsense it seems to me, ah well, wait for the letter I guess

  5. Hello all

     

    A firm letter yesterday saying contact immediately or else Default etc etc and take money from you other Barclays accounts, the joint account is with them.

     

    Can I send a letter saying the account is in dispute because they have not complied with the CCA request? Or is that just they can't take me to court without producing one? I appreciate they can default and sell the debt on etc etc

     

    I'm making arrangements to move the joint account on to another bank, if the account is always overdrawn can they still take money, a fair lump goes through it every month to pay the bills

  6. The Lady Wife says she had a call from NatWest today asking her about her SAR, although she was too busy to discuss it (and didn't know what a SAR was)

     

    I told her it's none of their business and not to accept any oh so generous offers

     

    From what she says it's going to be a packing crate of paperwork, her dealings with them are long standing and complex, personal and business (self emplyed) with loans/credit cards/overdraft whizzing around, being rearranged/consolidated etc

  7. Hi Slick, there would defo have been some further back in time, not huge amounts but defo some, especially when the card was active

     

    Am I right to think that people can still reclaim CC charges in the old bank charges stylee? Compound Interest and so on? Even after sending a CCA and kinda establishing that there isn't one?

     

    You're going to tell me to SAR aren't you? I will have a lot of CC statements filed away.

     

    In another thread about a CC with another firm that was sold on to a DCA (who have produced a miserable CCA) I'm sitting pretty, can I still SAR the original CC co and claim charges on that one even now? Are they still not very good at producing old statement as the banks were, again I might have a decent amount of statement going back avery long way?

     

    Sorry for all the optimistic and ignorant questions.

  8. hmm, well

     

    I was out of work in September 2014 and they very nicely froze the account for six months, ! found work after three or four months and called them to go back onto my payments, they insisted the account stay frozen and I make a much reduced payment for a year. At the end of that year they turned the card back on, added interest etc, the first I knew was when they started sending lots and lots of automated calls. When I rang them I got a call centre that were clueless and eventually agreed I was not at fault and promised me a refund of the added interest and a £100 for the calls.

     

    Then someone the UK side called me and was rather curt, said it was all my fault for not contacting them to arrange a new plan, I complained formally, they responded by saying it was all my fault but it could have been handled better and paid me some compo. Then they offered me a new repayment plan with minimal interest for a further year.

     

    About this time I got annoyed with the messing about and following my apparent success CCAing MNBA/LINK. I thought what the hell and sent a CCA off to Barclaycard over two months ago, it was signed for but otherwise no reply.

     

    Earlier this week I got a routine monthly statement showing I was late making a payment and showing them adding interest at what looks like the old fashioned lively interest rate.

     

    1. I kinda sorta went into arrears six months ago by mistake when the repayment plan ended but they resolved all that and reset the account following my complaint

     

    2. I agreed the latest plan in principle but it was to start when I made the first payment, I haven't done that.

     

    3. I sent a CCA off over two months ago, it was signed for but otherwise no response at all.

     

    4. From memory of my new minimum payment I'm two months of full interest behind so I guess they gave me a couple of week too start the plan and then turned the card 'on again.

    I have a Barclaycard from way back in the day, i was very slowly paying it off,

    I was out of work for a few months and they were very nice, froze the account

    and when i was back in work insisted on converting it to repayment plan at zero interest, great.

    It got a bit difficult at the end of the first year because they said I should have called them to renew the plan.

     

    I found out when their ten automated calls a day machine started

    which rather removed any goodwill on my side.

    After all sorts of nonsense they offered to put me on another plan.

     

    Rather less full of gratitude, I sent off a CCA request by recorded post, and it was signed for and opened.

     

    Since then, perhaps two months ago, nada, barring a monthly statement pointing out that I hadn't made my minimum payment and lumping on some interest.

     

    Can they do that as they are now presumably in breach?

     

    Not yet up to speed on Barclaycard,

    are they as terrible at keeping CCAs as the others,

    it is an old care, comfortably pre 2007 or whatever the significant date is.

    Not a cheep from anyone on this, I sternly told the only person that ever called me that it was on my file that I was only to be contacted in writing.

     

    I got something last week and opened it with a slightly nervous hand to see it was just a statement of account. "if you are behind with your payments, etc etc"

  11. Hello all, I did some bank charge reclaim back in the day and recently some Credit card CCA (excellent)

     

    My wife has produced all the original paper work for a NatWest loan from late 2008 for quite a lot of money, I've read a few threads but so far they're all five or more years old and I'm worried things might have changed since then.

     

    But the letter from the bank asking for the paperwork to be signed and returned also includes the PPI offer along with their advice to consider what she would do if she was out of work etc? There's a tickbox to indicate agreement that Nat West is not recommending PPI and 'it is my responsibility to check it is right for my needs' etc

     

    It has the a few codes bottom left corner and the date 26/06/2008 if that matters.

     

    What's the procedure/advice from here, the spreadsheet calculator and fos questionnaire or a SAR?

     

    (she thinks at some point they paid a claim on it, does that matter?)

    She was self employed at the time and the loan (84 months originally) is still alive, at some point they merged it into a business loan

     

    I suspect I'm going to be told to SAR ...

  12. Thanks for that Hammy, sorry for the late reply, I've been blissfully getting on with it, not a single scrap of anything from anyone regarding this, nada, which is excellent and I only wish I'd done it a long time ago and saved myself tens of thousands of pounds, ah well

     

    BarclayCard are cutting up rough with me now, so about to start the same procedure with them, they were very good with me when i was made redundant, then it all went wrong at the end of a repayment plan, i complained they got arsey about it while still sending me compensation, it's from a very long time ago so I'm very hoping the same problems with producing anything valid will apply

  13. hello again, no significant news, a long blissful silence following the dubious CCA, and then a call from a young lady being a little coy as to who she was, when I realised I said my file had instructions to communicate only in writing, from the MNBA days, and hung up

     

    A week later a Statement of Account and this week after that a colourful form asking for my income and outgoings

     

    So as per advice I've filed both on the pile of paper in the corner of my desk and will continue to do so until a Claim Form arrives

    So I can ignore anything Link have to say to me in writing on the assumption that they will not go to court, and if they do I tell the court that no valid CCA has been provided?

     

    And I promise to gen up on the other threads (and send a SAR to MNBA)

  15. Good morning and thanks for the prompt reply.

     

    umm, good, I hadn't noticed that (yet). So the T&Cs they've sent are not those from the time of application and they've added my name and address? It does look like that, I didn't expect my name and address to appear on the T&Cs, have they done that to make it look more authentic?. My signature appears in the expected place on the application slip right at the start. If it has been pasted in how would I ever know?

     

    The first page of what I imagine is supposed to the original T&Cs refers to conditions 10, 1 etc when the first page start halfway through condition 10.

     

    Assuming the CCA is reconstituted at best and incomplete at that, where would that leave me now? I'll sent off a SAR to MNBA as advised but do I need to ask Link for anything else?

     

    Can I now rest easy knowing that should any sort of court action begin I can send in a defence that no valid CCA has been supplied, or I am getting way ahead of myself?

     

    Thanks again (working seven day weeks at present in case anyone thinks I'm being ever so lazy in reading up on things

    here's what they sent me in reply to the CCA, with anything resembling a code or barcode blanked,

    apologies for the first effort and thanks for not letting it go up.

     

     

    As said the original T&C, straight after the slips with me 2011 signature seem to be missing the first page at least,

    and I can't see any signature from them,

     

     

    there's something hard to make out in the middle of the slip signed by me but it looks like a date stamp of some kind.

     

     

    And presumably those slips are tearoffs from a larger page?

    Is that significant or can they stand alone?

     

    Am I right to think that a CCA or a SAR puts the account into dispute, if so how will LINK know that if I send a SAR to MNBA?

    They'd need the original what to be approved in court? I appreciate this is all known to you but not to me, thanks.CCA or T&C, they both look to my inexpert eye to be from 2001, although the T7C is missing at least a page

     

    As regards a SAR, at the time I was only interested in seeing if they could produce a valid cca, and the question now is whether sending a SAR might extend the time off from action by more months, this place, with all respect seems have become a little less polite than it used to be.

     

    I'll edit the pdf and upload over the weekend, thanks for the non-approval, yikes and sorry about me, I thought I'd been careful

  18. Hello all, I sent the demand for the CCA off as suggested not long after my last post, had the standard 'we need more time, about a month' reply and then it all went blissfully quiet and I started to think they couldn't find anything.

     

    Sadly an envelope arrived last night with what looks like a copy of the original agreement with my signature from 2001, the copy just about legible and a rather spick and span terms and condition running to a dozen odd pages, I've done no more than skim through it and sigh, and I'm yet to read the doubtless splendid document from this site on what constitues proper compliance. I'll scan it all and upload this evening.

     

    That was a short letter enclosed stating I owed 9.5k and was welcome to post them a cheque, yeah right.

    Here\s what I got in response to my CCA request. I can;t see any signature from MNBA bar what looks like some sort of stamp in the centre over the small print.

     

    The first set of T&Cs with my address at the time of the application start at what I assume is 10 ©, at least one page seems to be missing. That's two pages.

     

    The second set with my current address is 8 pages.

     

    There was a covering letter and what looks like all the things I would have entered into an online application, gawd I earnt a lot back then.

     

    Does a missing signature from them and a missing page of T&Cs (and any other T&Cs that would have existed between 2001 and 2015) make this invalid? I will read some other CCA threads, promise but grateful for any insdights

     

    And given it took them four plus months to respond to the CCA request, can I now send them a SAR for some more time off?

  19. Well yes but if they're allowed to reconstruct then that's the easy way out surely?

     

    I recall getting one from someone, may well have been MNBA and it was a raggle taggle collection of photocopies and whatnot, with my signature on it somewhere, perhaps I might have given it more scrutiny at the time

     

    Oh well see what come from this one, if nothing else it's going to put off la Link for w hile I suppose

    But if they have whatever you originally signed then they must have the original document

    and if they don't have the original document then what do they have to produce to prove an agreement?

     

    (I appreciate you might say this is in the Copies of Docs and Cancellations Notices which I suppose I should read)
