  1. hello all Claimant - Hoist Finance UK Holdings 3 LI Date of issue – 12 July 2019 What is the claim for – The Claim is for the sum owing of £ 5xxx in respect of monies owing under an Agreement with the account no.xxxxxxxxxxxxxxxx pursuant to The Consumer Credit Act 1974 (CCA). The debt was legally assigned by Barclays Bank plc (EX BARCLAYCARD) to the claimant and notice has been served. The Defendant has failed to make any contractual payments under the terms of the Agreement. A default notice has been served upon the Defendant pursuant to s.87(1) CCA. The Claimant claims 1. The said sum of £ 5xxx 2. Costs Have you received prior notice of a claim being issued pursuant to paragraph 3 of the PAPDC ( Pre Action Protocol)? I don't think so What is the value of the claim? £5xxx Is the claim for - a Bank Account (Overdraft) or credit card or loan or catalogue or mobile phone account? Credit card When did you enter into the original agreement before or after 2007? June 2007 Has the claim been issued by the original creditor or was the account assigned and it is the Debt purchaser who has issued the claim. Debt purchaser Were you aware the account had been assigned – did you receive a Notice of Assignment? I think so Did you receive a Default Notice from the original creditor? Unsure Have you been receiving statutory notices headed “Notice of Default sums” – at least once a year ? I think so Why did you cease payments? Upon not being sent a CCA following a request What was the date of your last payment? Early 2016 Was there a dispute with the original creditor that remains unresolved? Yes in that no acceptable CCA was ever sent Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt management plan? in 2014/2015 ........ hello every one again, this account relates to a SKY card applied for online 2007, along with all my other credit cards I sent off SARS etc in 2016 with routine success in that valid CCAs were not sent and I ignored all correspondence thereafter. This week I got a claim from got HOIST FINANCE using Howard Cohen as the address. After skimming a few other threads it appears to be a case of responding online to the claim form stating an intention to defend the claim, send a CCA request to the claimant, Hoist and a CPR to the solicitors, Cohen? And it's likely a case of following procedure until the discontinue? As ever, thanks for all advice and support I have acknowledged the claim online CCA and CPR are written and I'll post them tomorrow, if the POC on the claim letter do not mention any documents beyond a reference to a default notice being served and an agreement, is that all I ask them to provide or should I leave the whole default list in?   2. Hello all I banged off a ppi enquiry to every single company that I had ever borrowed from, in case, although I'm fairly sure I always declined any extra services. Egg/One Canada Square replied last to say that I did have ppi on a very old credit card back in the day. I complained and today got a letter saying that my complaint was upheld but there was nothing to refund as no premiums were ever applied, something like that. Does that sound sensible/likely? If I dig out some old statements will it show on them as a separate line? SAR? Thanks Micky
  3. deedy, fair point and I one that I'll rely on them to make, i assume the repair fee will still be paid although there is an argument relating to inconvenience and loss of something

That's good advice, thank-you Sorry about me, off work with a crocked knee and got a bit daytime tv la la They're local so will help the daughter with the letter first thing and she can politely hand it to them tomorrow Will update with progress Micky oh and it's an 18 month old iphone 6 in good order barring it wanting a £25 repair, the daughter will research it value tomorrow morning
  6. Hello, i suspect this is fairly straightforward but google is unhelpful My daughter took a damaged Iphone 7 to the local repair shop that have done loads of good repairs for us and friends. They've said they've been burgled and her phone amongst other is stolen, their initial response to her is to try and track it down online I assume i right that they have to replace it with a like for like? If they are reluctant what is the best way to go? Legal or otherwise? I'd like to quote the relevant law or legal recourse to show them I mean business. And how long is reasonable to wait for them to replace the phone? She genuinely does reply on it. Thanks Micky

  10. It's defo stamped as June 2017. The older ones are harder to challenge? I though it was the opposite, the older the better as regards challenging. I've been assuming the deathly silence from the other side after the early flurry of activity was a good sign? And I have done a spreadsheet of the statements that I had, a few years from seven or eight years ago when it was active, I'll SAR at the end of the month when I've got more then 10p, but i doubt that three years or maybe even six will add too much to the pot.
  11. Slick, from memory it's June 2007, I can confirm that this evening, certainly 2007 dx, I've have seen plenty of the regular CCAs including a couple of my own, this document though is a new one on me and I've not seen them anywhere else yet Thanks both Micky
  12. Hi Slick, splendid news, I was a little unsure because it was an online type thing and the esignature angle. For my understanding though, why not? I appreciate there's no terms and conditions for one, is it even an agreement at all, is it just an application? Umm, no other then i added up the charges from the statements that I did have, been working four months of seven day weeks so time has rather slipped by for me, Need to SAR still don't I? Now I can rest easy on this one I'll get on with the SARs etc, I've seen the other threads with people probaly getting them back at Comp Int which is good news, my charges are old charges. Hi, apologies for the ridiculous delay in posting what they sent me, anything blanked is correct and looks like what i might have entered on an online application, the big lower left blanking is a handwritten 12 digit number.   14. That figures, thanks Any idea on the print out of the web form data, quite apart that it could have come from anywhere as it's not signed by anyone. Does the Subject to Credit Approval stamp mean that's it's not an actual agreement? Thanks
  15. hello all apologies for my feeble updating of this thread, been on seven day weeks and rather let paperwork slide I'm clearing a mountain of post and picked up something I clean forgot about at the time, it' something that came back in response to my CCA in June. They call it a 'Copy Application'. It appears to be a print out of whatever I might have entered into a web application so personal details of me and my employers, it has 'Created on xx/xx/2007 and it's stamped 'SKY CARD, xx xxx 2007, SUBJECT TO CREDIT APPROVAL' and someone has written on in biro a 12 digit number. (I've xxed out some of the dats and times) Does that satisfy the CCA request? Sorry about me, Arvarto seemed to have moved it on to someone calling themselves Allied International Credit in late October, they call a lot and try to take me through security at which point I say I don't give personal details to cold callers. I'll update on my SAR and spreadsheet as I start catching up with things Thanks Micky
  16. Hello again, the debt has moved onto someone else now, Alliance something or other I think. They've callled on the landline at 8:30am most days last week, I've told them that no CCA has been sent to me and hung up so far, are they allowed to call like that under the circumstances? It's not like the calls are going to go anywhere after all is it. Doesn't bother me but it ags the wife and the kids and the mother in law Thanks Micky

Hello all Now a letter from RBS with a list of 4 loans, 4 overdrafts and 3 credit cards, one of the credit card showing as having ppi, as well as a form asking for a fair amount of details to help them deal with the complaint. Fill that out and return it? RBS owns Natwest I assume? It seems to me that they haven;t complied with the original SAR despite being prompted to do so, perhaps I did not list all these accounts that I had no idea the Lady Wife had Should i SAR again for the three credit cards with a view to claim charges back and fill out the form for PPI? The card with the PPI has a column at the end headed Insurance Premium with a number a little under £2k, from 2007, is that subject to 8% stat interest? Thanks Micky

Hello all, long time I had a few letters that i suspect are all routine and dull, A rather furious legalese one saying the CCA they send me on time in Feb was perfect, quoting all sorts of case law including one that proved that something without my signature or a date on was still an agreement, wha? I replied in writing to say I had not received a CCA and had therefore not paid anything, believing the account to be in dispute/not valid etc and to send me the CCA And now a series of letters from Arvato, pay up or else, then make us an offer and now today another pay up or else we sell the debt Am I right to think this is all indicative of them not having a CCA to send me? Send a new CCA request should they sell the debt? As ever thanks for the advice and reassurance
  21. oooo, there was a reason to post other than a general update I moved the joint account to another bank as advised so all good there, after a month odd Barclays bank have now asked to clear my overdraft, I haven;t responded yet but plan to repay a small amount monthly until it's cleared, all humdrum non contentious stuff I assume? Are the BC account and dispute effectively separate from the barclays debt? Thanks Micky
