brilliant work people
I look forward to skipping lightly across the shoulders of you giants
-
I was thinking more about small crying children looking destitute than expense to be honest
It might signify me yawning from being so bloody tired all the time although the youngest is more or less sleeping to a decent time lately, there was an ugly and protracted spell of 5am starts that wear a man down
I should confess that my wife is a barrister although only in here third month so far so now real sacks of used tenners to use as pillows yet
-
I suppose they're heard it all before
and Smile are obviously only coop pretending to be someone else
-
can't have too many dramas, a closed account with bailiffs actioned to reclaim their overdraft and make you homeless would be a splendid prequel to my thread once it gets started
you can do the smooth efficient thread
I'll do the one with screaming, wailing and pleas for immediate help and advice on an hourly basis, I've got small children and a huge mortgage and numerous dreadful debts
Seeing as I'm the newbie with no arguments at all, sussed or otherwise
-
yes
this smile forum needs some decent long running roller coaster stomach churning marathon claims to pep it up
-
no 8% if you've claimed CI, you mihgt be able to claim 8% in the variance (plan b) at the court stage
and claims over £5k are different, fast track or something like that, best check that out, especially if you're claiming CI, sorry to be vague, I;n new myself
I'm going for CI myself
-
indeed
although I'm still ever so slightly dithering about claiming compound CI
ah well, the letters are posted now
-
uh huh, I hear you
from my finger and moving lips reading of that summary, he still pretty much said that 8% was ok instead
ish
early days for me, doubtless I'll get more frantic nearer the time
thank-you for your input and sorry to Porcupine
-
yes, that's it, certainly the same file name and the url rings a bell
it's a cracking spreadsheet
-
I would strongly suggest that you only use the materials on this site, it's all here, you need nothing else. some of the stuff elsewhere is outright shoddy (unless you're referring to vampiress's google chhambers thingy, I haven't been there)
if you charge the bank CI at either the authorised or unauthorised rate, you can't add the court's 8% as well
to be honest, the compound interest adds so much it'd seem indecent to add anything else
-
I reckon they're rubbed him out and he;s wearing concrete boots at the bottom of the Thames
At what point does the account in question go into dispute?
-
they stand out pretty well from my experience
PAID etc
UNAUTHORISED etc
try the sticky thread that details what's claimable
they're usually nice round numbers, £25, £30 etc etc
-
it's the right answer if you didn't request them with a SAR under the relevant act thingy surely?
otherwise they're a good and friendly bank, other than being a bit evil with charges if you get caught
and the Smile board is a sub board to the COOP board
-
I have them at home ...
Use the forum search to find one of his posts and there's a link either in his sig or his profile, that's how I found it
not 100% sure that's the right spelling for his name, sorry
-
thanks, that tallies with what I've read
my biggest claim is for £3.5k
As long as my claims shows the basic charges plus basic interest on charges, and the CI interest separately with the s65 in variance to the CI, wouldn't that cover me if CI is a problem, how can the case be struck out if the question of the legality of the CI wasn't considered?
On what basis would they strike it out?
genuine question, sorry if it's simplistic
-
if you claim CI then you can't claim the 8% after that
Mindsai's works out interest on charges, as does vampiress' complex sheet
it then works out two further sheets, one shows the court 8% on everything which you can claim once you enter a court claim
and a second that calculates compound interest at whatever rate you enter, usually the authorised or unauthorised bank rate, this adds a stack to the totals, some argues it's a high risk tactic but plenty have had it paid, I'm going for it, seems to me that you can still claim the 8% in variance so there's nothing to lose
I am new though
-
it's the forum norm to get steely and determined, I'm a new fish, barely starting
read the threads about the more than six years data, the banks will squeal and try to get out of this but others have been working on this and it's starting to work
find the bong post about microfiche (and gawd knows what else) records being valid and subject o SARs, and the bit about their something officer having to sign a statement confirming data has been destroyed if they won't supply it
-
this is covered over and over again in other threads detailing NW claims
they're trying to worry you, read the other threads or wait for a veteran to arrive to soothe you
there's nothing to worry about
-
yes, do it
separate claim as long as you haven't signed any 'full and final' settlement agreement
even then I think there's a wriggle to get out of that, posted elsewhere
getting the bloody statements might be the tricky bit, I've just sent off a SAR for the older ones, sadly without an excellent para from bong, elsewhere with some very pointy directions to the bank regarding older statements and their dreadful excuses as to why they might not be entirely available
-
good reading this subforum, lots of short happy threads, other than the SARs stage
goody

Ash v Smile
in Smile
no expert but I think it'll be ok to show the charges as they've sent them to you, they can hardly complain if you show no details if they didn;t give them to you
I'll gladly bow to someone that knows better
hopefully before I get my statements back in that state
-
I tried this via Secure messagng a while back and got the big fob off
all legal and as agreed, yada yada, pass onto the relevant department blah blah
proper SAR posted today
pleased it worked for you though
-
I'm claiming compound CI, why not?
the worse that will happen is that they'll pay only the charges, perhaps the interest on the charges
the best is that they'll pay the lot
this all revolves around them really really really not wanting to stand up in court and explain their charging
really really
-
NW used to do this to me, move money to and fro, usually with disastrous results
Might be worth reading their T&Cs, or waiting for someone that knows the score
It sounds bang out of order to me, especially if they've given no reason, SMILE tend to have good helpdesk in my experience, get onto them and stick onto them for explanations, complain long and hard about what they've done to you, kids, shoes, bellies heating etc etc, mention MPs, CAB, local papers, this ain't going to sit well with their happy smiley image
and remind that their charges are illegal and you are already starting to claim them back, again
might be worth reading the sections on this forum about harassment from the banks
best of luck

grrrrrr
it would have stood out pretty badly when you started entering your figures into the spreadsheet
I do think it's just rank incompetence, others are getting different peoples' statements and so on
I'd have thought a non compliance stating what you have had and what you haven;t had with a short deadline, like 7 days
