  2. Claim acknowledged by defendent today..
  3. Called MCOL who were very helpful, they suspended the first claim, and said I had to create a new claim and pay the court fees again. However they will refund the fees on the initial claim. So, fresh claim went in today.
  4. The words defendant and claimant need to be swapped. In the particulars of claim I write about the defendant bank, which is obviously them, and it's signed by me. I will call them. Worst I fear is having to repay the court fees, but it's a frustrating delay anyway.
  5. I got the claim form today. Looking at it, through admin error I seem to have FD as the claimant, and me as the defendant. but signed by me. Can I change this claim, or do I need to create a new one and biff this one I've completed in error? Thanks

  8. Thanks for the reply. The original figure I sent to First Direct was on the LBA, and this lower revised amount has been submitted to Moneyclaim. I was careful to make deductions from my bank charges spreadsheet. I notice that although i checked the 'i want to claim interest' button on the moneyclaim site, it's not on the claim form other than in the 'particulars of claim' section when I state the charged amount, the interest, and therefore the total claim. Should there be an indication of that check box ticked on the claim form?
  9. OK - revised the claim down and submitted it on moneyclaim. I will post an update once i have one. (edit) The fees actually run to £1,311.50 but with the interest from June 2000 that adds on £469.65 in interest, as well as the £120 court fee. Total £1901.15.
  10. Hello, gr8 forum. I've done the DPA, retrieved a wedge of statements, and a few hours with a highlighter later I ask for the £1,436.50 they've taken from me. Usual response, we don't agree, blah blah, and today is the 14th day so I'm ready to put a claim in. However, today I realise they've partly refunded some fees when i complained at the time, if i take these off (which I think I should) then the total to claim is £1,311.50 not including the interest. Do I need to tell them if I'm revising down the claim? Do I need to restart the process with this correct figure? It was only when double checking did I realise there were some partial fee refunds. Thanks!
