  2. I have filed my MCOL today but how long usually does it take before people get their money back? How long do the halifax have to either file a defence or pay up? Christmas is coming and I will be getting fat....need my money to buy my slimfast!!
  3. Nice one cheers for that, I wasnt that far off....ahem!! It's going to cost me £250 to file my claim just before christmas too! (if my girlf hadnt dumped me then i wouldn't have been able to afford to pay it.... so thanks to her i can!!)
  4. Hi, I think I get you! I have ammended the changes, is this right now? The Claimant has an account xxxxxxx with the Defendant, opened 1992.2,Since 31/3/01 the Defendant debited charges and interest in respect of purported breaches of contract.3.Defendant is aware of all details as a list of charges has already been supplied. 4.claimant contends:(a)The charges exceed the Defendant's losses caused by the breaches;(b)The Term permitting the defendant to levy such charges is unenforceable under the Unfair Terms in Consumer Contracts Regulations 199

  6. I am doing my moneyclaim on line and I am now stuck! Can someone tell me if this is correct? The Claimant has an account xxxx with the Defendant, opened 1992. 2. Since 31/3/01 the Defendant debited charges and interest in respect of purported breaches of contract. 3. Defendant is aware of all details as a list of charges has already been supplied. Another copy will be sent. 4. Claimant contends: (a) The charges exceed the Defendant's losses caused by the breaches; (b) The Term permitting the Defendant to levy such charges is unenforceable under the Un
  7. Yeah it was my LBA so I am going to wait while the 14 days is up then file online McCol but, how do I accept their offer as partial payment or dont I?! Do I just file online court form and dont reply to their letter or do I send them letter thanking them for their offer and accepting asd partial offer but will be pursuing them for the full amount? Thanks
  8. Hi, I have recieved my letter today offering me goodwill gesture of £1900, obviously I want my whole lot back so do I respond to them with the letter they have sent me or do I send them one back with usual accept it as partial offer but will be pursuing full ammount? Also, where are the next letters to send and shall I just go ahead with the McCol? So many questions!
  9. So after waiting 40 days for my statements and two phone calls chasing them up and being told they hadnt recieved my letter (even though they cashed my cheque sent with the letter) I finally got my statements yesterday and calculated how much the buggers had taken off me. So having eventually got them after chasing them up I go downstairs today to find that another set had been sent with 32 envelopes on my door mat! (It's like waiting for a bus....) My approach money for bank letter has gone off recorded delivery yesterday and I know what to expect. My charges are over £5,000 s
  10. Yeah forgot to send it recorded delivery, however, the cheque was cashed on the same day they allegedly recieved the letter?
  11. Thanks, I phoned them prior to posting on here and they said that they hadn't recieved the letter until 2nd Oct and therefore the 40 day deadline is this friday and they will send them before then. This is different from what I was told before, plus I was also told they would be sent before today and they havn't! So with them saying thwy will arrive before friday would you bother sending the letter or wait to see if they do? So many questions!
  12. Cheers, any idea what sort of things to put in the letter? They are annoying me now!
  13. Hi, I sent my SAR to the Halifax on 27/9/06 and they will have recieved it 28th. The cheque was cashed on 2/10 ans still no statements have arrived. I contacted Halifax twice and they said I would have them asap and at first denied that they had recieved the letter until I pointed out they had cashed the cheque that was with the letter, they then managed to somehow find the letter! My 40 days time limit has elapsed, what should I do now?
  14. So I sent the Halifax my SAR on 26th sept and still nothing recieved, so I contacted them on 24/10 and they stated they hadn't recieved my letter which was why I hadn't got my statements - until I told them they had cashed my cheque and then they somehow found my letter! Anyway this was going to be dealt with by them as 'matter of urgency' - still nothing recieved so phoned them again today and I 'should have them on friday or monday'. In the meantime I have had another £170 charges taken off me from last month and as a result cant pay my bank loan so they have blocked my account and fro
